Although the Empire was fragmented, it still contituted a political entity of sorts. The peace negotiations themselves were attended by Imperial estates "in the form of a Diet" and was signed by representatives from the Empire in the name of the Empire as a whole. It was a very weak institution, but it was still an institution.
To bad the US was not part of the treaty of Westphalia, (yes, i know they did not excist yet). But maybe then they would also respected te sovereignity of Mexico, Japan, Philipens and guatumala.

No common kingdom really. The HRE existed almost in name only. Plus the Emperor was more or less Austrian.
