I lived in a house this year with girls that made me feel unwelcomed and I was going to sign with them again but change my mind and now want to get out of the lease. I signed the lease but one of the terms of the lease is your have a parent co-sign and notarize it and send it back to the land lord. Well neither of my parents have signed as co-signers or notarized it and they haven’t sent it to him. So basically our copy would be the copy to have all the signatures(aka the official copy). Since my parents never signed the lease would that make my lease not complete and voidable?
Good question Taylor! Without getting to "legal": If the lease itself states that it must be signed by your co-signers (parents) and notarized in order to be valid, then until that is done the lease would not be considered legally valid. So our opinion would be that the lease has not yet been fully executed. There is nothing to "void", but you should still be able to walk away from it. Hope that helps!
Kiera - The lease agreement defines the relationship including what you are responsible for. So if you are being charged something that is NOT referenced in the lease you should push back on that.
It is going to be very dependent on the attorney, but most real estate attorneys will 'sell' you their pre-approved lease for a nominal fee. So very funny show thing that tends do wrong what about the people who are rent the apartments. That dont want to fix crap and raise the rent after you sign the lease saying the rent isn't going up and. You get a letter saying it's going up 250 dollars
Good grief, adding to the animal welfare problem and overwhelmed shelters by encouraging tenants to simply abandon pets to avoid fees?? What a sick policy... !! Just charge for the pet deposit and don't contribute to animal abuse.
Subrogation is totally normal in the insurance world. Have any of your tenants been harmed by that clause in the lease?

If you didn't agree to it in the lease, then you are probably not responsible. Request a copy of your lease and go from there.

Any real estate attorney should be able to provide a state specific lease agreement for you. Just be sure it is state specific.
