So if A sells an encumbered property to B which is under the possession of C who has an agreement to sell with A and also has full possession of the property after making full payment, ref: Supreme Court of India, Ghanshyam vs Yogendra Rathi of 07/06/2023-Sec.53(A) T.P Act. Will this be a fraud, U/S. 53 also, as both A and B knew of this agreement to sell, which was not registered?
