    I'm so glad the judge is allowing the public to view the case and allowing transparency. This is obviously a very high profile case and the entire country is invested in how the trial goes and the outcome. Without transparency, it would leave heavy speculation on the part of the public.

      Yes, I think Federal cases ought to to be able to have cameras as well. Right now, I am especially interested in the SBF trial with "Sammy" himself on the stand~~~!! We watched him squirm both physically and mentally in his frequent interviews post FTX collapse; it would be most interesting to see what he does in a court of law. Same with the federal cases around DJT. I do think years ago, that cases like the OJ case were affected by the use of cameras but now-a-days everybody is used to it and all these damned lawyers go on TV all the time anyway. One person made a good argument regarding that really, today - 2023 - transparency really does include video since CTV's are everywhere in our society ~ we cannot escape them ~ so why should court be any different since the law requires trial transparency for the benefit of the accused.

    Logically, it doesn't really make any sense that a Grand Jury held to decide if there is enough evidence to warrant a trial should be "beyond a reasonable doubt" ... THAT'S what a full blown official trial is for. The standard to indict in a preliminary hearing is also not "beyond a reasonable doubt". Only a true trial to convict or not must hold the standard of "beyond a reasonable doubt".

      They are no where nearer to the initial preliminary hearing than they were a year ago. The prosecutor's office seems to be simply overwhelmed
      and unable to forcefully respond to the defense's delaying tactics.

    It's terrific that Judge Judge ruled to not throw out the Grand Jury's indictment of BK. It's wonderful that cameras will be in the court room with control by the Judge.

    I guarantee you that Kohberger himself cooked that one up. A ruling to throw out the indictment would have undone decades worth of precedence in other murder cases, possibly leading to thousands of convictions thrown out.

    I think this career academic defendant fancies himself as brilliant and has taken it upon himself to parse law without a degree and passed on his thoughts to his lawyers. Best of luck to him, both he and his lawyers are going to need it.

    7:49 Grudgingly I admit, it is a smart argument, however by that standard why not just call it a conviction, instead of criminal indictment, and skip the trial altogether. The purpose of a grand jury is to decide it there is enough evidence to warrant a trial not to determine guilt or innocence.

    To force the court to use beyond a reasonable doubt as the indictment standard would mean trying every case twice.. the indictment process would have to involve all of the testimony and evidence from both sides with cross examination and expert witnesses…exactly like the trial.

    Grand Jury standards are invariably quite a bit lower than those of the trial jury itself. The idea that in Idaho the grand jury has to meet the same standard as the trial jury is really quite absurd. To demand the grand jury’s standard be higher than that of the trial jury is absolutely insane!!! Who tf has ever argued that before!? His lawyer is a dunce…

      It is absurd! If they were to throw out BKs grand jury for this reason that would mean that all grand jurys that used the probable cause standard in the past would have to be over turned too! Like the judge said it was a "creative" argument tho 😂

      At the end of the day it's their job, that's all there is to it. You also get notoriety, a book deal, and a lot of money if you pull it off. Look at OJ Simpson case as a prime example.

    I'll agree, the argument is certainly creative. But thankfully, the judge has a good head on his shoulders. And hes not gonna be swayed by a bunch of crafty loopholes. Even if they didn't get a grand jury indictment, they would have indicted him at the preliminary hearing. I'm not saying he's guilty however the evidence is overwhelming

      In ID, a grand jury is made up of 16-23 jurors.
      At least 16 (out of 23) grand jurors must be present for a vote, and a unanimous decision is not required. At least 12 members must concur to indict a defendant under the Federal Rules of Criminal Procedure.

    A grand jury doesn't decide guilt or innocence it is saying there is probable cause to have a trial and let 12 jurors decide the guilt or innocence when they hear all the evidence. Their standard is beyond a reasonable doubt.

      lmao. I suggest you go research Touch DNA and learn the difference between substantive DNA evidence and traditional DNA evidence. Touch DNA is everywhere for any reason, on dollars and coins. You have hundreds of touch DNA in your house.

    This is a strong argument from the defense. In Oklahoma, the state prosecuted all cases. The McGirt argument came up. The statue says Native Americans who commit crime on Native American territory are to be tried in Native American courts, so even though the state had prosecuted all cases for 100’s of years, the Supreme Court ruled with statue law, because it had never been changed! So many cases have been thrown out and are having to be retried. I would much rather see this point argued at the highest level and let them make their decision before they prosecute him, possibly get a conviction, then have it overturned because of how the statue is written!!

    The defense arguments just point to his guilt! The Grand Jury can't be held to that standard because ALL of the evidence is not presented to the Grand Jury. It's an indictment, not a trial.

      It's something to do with the way the jury views the defendant. They have a right to not be in jail garb, therefore not already looking like a guilty criminal as your first impression with the jury members. At least that's why they allow the suits, I'd assume haircuts are kinda part of that so they aren't forced to enter the trial looking like a mangy jail rat. Haha

    I know there’s a gag order, but it seems like the prosecution only has touch DNA at a party house and a car similar to his in the area.
    Main thing that bugs me- there is ZERO cell phone evidence. His phone was OFF during the murders- THATS A LACK OF EVIDENCE NOT ACTUAL EVIDENCE. Just cuz he doesn’t have phone evidence to exonerate him doesn’t mean that in itself is evidence. It’s like using someone’s right to remain silent as evidence

      They have tons of surveillance of his car. His PCA and other official court documents never once said it was Touch DNA, they said single source male DNA, not Touch DNA. Touch DNA notion comes solely from UA-cam not the courts in this case.

    I am a law student in Uni (defense Lawyer). Haven't looked into this case for a few months now and regardless of whether he did or didn't do it later on down the line, provided it gets to that point. His defense actually have a strong point as there have been many cases of the wrong person being found guilty or being framed and the wrong person being given the death penalty!. It's happened, it still happens they have a point considering this is a potential death row case and when that is the case you have to be sure without a single shadow of a doubt that you have got your everything right and no mistakes. You do set the standards high when the sentence may be death because there's no coming back from that once it is already done.

      I understand this argument, but truth to be told, there are cases and cases. This particular one raises no feasible explanation for there to be anyone else who could be guilty. Bryan had never taken his trash out with gloves before. Germophobes don't become that way from night to day. He was purposely disposing of his trash, gloved, in the neighbours trash cans. Pairing this with his dna being found in the knife sheath of the murder weapon, his very unusual travelling pattern at night, mysteriously turning off his phone for a couple hours (tell me which young adult turns their phone off for hours now a days? Ill tell you , the ones who dont want their location known) and I really don't know that many cases with so much consistency. He was vegan, 2 of the girls worked at one of the only nearby vegan restaurants. He had photos of mogen saved on his phone. Justice systems all over the world keep failing victims like these teenagers, we're so busy trying to protect the accused while meanwhile the real people who lost everything are 6 feet down. Robbed of such bright futures. Sometimes we can't prove beyond doubt, we gotta deal with that and accept the 80% for a common good. How many victims were left unavenged by the opposite situation? Yeah I mean Sometimes innocent people get the death penalty. But many more times cases go cold, unsolved, no action, even while knowing who the perpetrator is. Why are the accused lives more important? If this case goes unsolved while the answer is right in front of our noses , someone may do justice by their own hands. I'm telling you, if bryan puts their feet out of jail, he's done for. People know he did. Everyone knows he did it.

      Absolutely they have the wrong guy! I am a civil rights activist who works alongside many police officers. I live in a major west coast city. The majority of these officers think he is innocent. They don't mind speaking the case to a friend. I find it disgusting when I hear the evidence against him is so strong. No! So weak!
