1] Quo warranto is a Judicial process. The Supreme Court is the best place to settle it, naturally.
2] Impeachment is political. Corona doctrine applies.
Sereno got what she asked for. Either way she is screwed.
IMG OTD.. have you study any jurisprudence regarding Quo warranto petition? have you read Article 11 which it is very clearly stated that only the Congress will removed the impeachable officers? have you read Article VIII paragraph 3. The Members of the Supreme Court may not be removed except by impeachment. although there is a word "may" but we cannot disregard the word "except" meaning, no other way but impeachment trial.
You are correct to say that impeachment is political process but you cannot cite Corona case because this is Pro hac vice or meaning "only in this case" therefore, the Supreme Court is not the tryer of Facts only Impeachment Court and the danger here is that any sitting Justice of the Supreme Court will be subjected to Quo warranto petition and the Congress now has no power to exercise its constitutional mandate because there is a grave abuse of discretion on the part of the Supreme Court. I would suggest that you watch Oral Arguments on UA-cam about Quo warranto petition v. Sereno. This is my humble submission.
@@theboilingpoint15 Preposterous. I am not a lawyer but I try to think in a jurisprudential manner. Article VIII, Section 5.1 of the Constitution states that the Supreme Court shall, quote, "Exercise original jurisdiction over cases affecting ambassadors, other public ministers and consuls, and over petitions for certiorari, prohibition,
mandamus, QUO WARRANTO, and habeas corpus." The Constitution clearly states that the Supreme Court may remove ANY official appointed by answering/granting a quo warranto petition filed before it. And, if you still question that, the Supreme Court is SUPREME, hence the name. It is the interpretative body of the Constitution. That is why we have landmark decisions. The Supreme Court ruled prior to the granting of the petition that removal by quo warranto was a LEGAL REMEDY, i.e. an acceptably-LEGAL manner to remove a particular appointed official like the CJ. The Supreme Court ruled on the constitutionality of granting the petition 9-5. A true majority. That rule on constitutionality aims to END all debate about the legality of the removal.
@@stephencarmelo6741 It does not make sense, In sec.5 of Article VIII, there is nothing mentioned about that you can file any petition against the members of the Supreme Court, only Lower Courts in connection to that, paragraph 7 of Art. VIII on Independence of Judiciary, it states there that the S.C. has EXCLUSIVE power to discipline the lower courts. But not to discipline themselves, yes its a majority first votation 8-6 then now 9-5 because of Abuse of Discretion of S.C. which highly irregular. And another matter is even the R.T.C. Judges are allowed to file a quo warranto petition, do you see the danger here? So it is possible to Quo Warranto one of them(S.C.) because S.C. is not a simple office or organization. The problem here is Seniority Culture and my I advice to you is listen to Oral Arguments of S.C. (Quo Warranto Petition v. Sereno) and try to listen very carefully to each questions especially in my opinion the questioning of Justice Leonen. Study your constituion and its jurisprudence.

The Constitution gives power to the Supreme Court hear cases about quo warranto and there is no provision in the supreme law which states that the Supreme Court cannot grant a petition for quo warranto in relation to its own members. The Constitution also, on that previous ruling, states that the word "may" clearly indicates the presence of another legal remedy to remove not just impeachable officers like the Chief Justice or the President. The quo warranto petition sought to QUESTION which authority gave legality to an appointment that was made in the presence of clear non-compliance with the requirements posted by the JBC, especially the financial disclosure statements that Atty. Sereno failed to submit. She even told the Supreme Court that the SALNs she has failed to submit had copies-which she LOST. This is another smear factor for her integrity. The issue of granting quo warranto is a simple constitutional concept exacerbated by politicization.

Her appointment as Chief Justice was null and void ab initio because she failed to submit the necessary requirements as dictated by law for all public officials -their notarized SALN. Yun lang ang reason why she is disqualified. Napalinaw ng explanation ni Solicitor General Jose Calida sa Quo Warranto petition. Dapat si Sereno respect the Supreme Court justices.
have you read any jurisprudence on that? even in SALN Law provisions that the filer will have a time to correct its SALN... are you brilliant enough to claim that the decision of the JBC en Banc is unconstitutional? have you watch or heard on UA-cam the Oral Arguments: Quo warranto petition v. Sereno? if not then do not persuade other people in your one-sided opinion, you have never cited any decided cases which in fact in Dublada case (precedent decision) would enough to junk or quash the Quo warranto petition in fact let's wait the preliminary hearing conducted by the Justice Committee of House of Representative then craft their articles of impeachment then have a debate in plenary and vote at least 1/3 of the members of Lower House then proceed to the trial (Art. 11 Sec. 3 paragraph 4)

Poe was removed by Comelec unanimously but was reversed by SC. And Andres Bautista's impeachment was turned down by Justice Committe but was later on reversed by voting in Congress.
