      Cops are still investigating and you don't know how much evidence they have or don't have so the "how do we know" question is irrelevant at this point. That said, 95% of the time the first person cops name is the culprit. Many 78 year olds don't have the best vision and it was a huge boat with a huge bow to look over.

    I have heard of so many tragedies while people boating here in california most of time alcohol is part of it, and the driver really never knows if a person fell. but also i want to ask if the boaters pulling that girl raised their flags? its a sign that someone is in the water.

  • @VILJL
    @VILJL 21 день тому +1

    At this point is anyone sure this guy hit that girl? He looks really hunched over in the video. Thats a lot of boat for a guy that's having issues walking. The "water ski area" (not an official area) is north west of the Rickenbacker bridge. Next to the condos in Brickell. They may not been able to ski there because the water is shallow and the boat they were using was large. I don't see people using a boat that large to waterski so just that is unusual. I think there also needs to be some review of the operator of the boat the girl was on.

  • @dc2355
    @dc2355 21 день тому +1

    It was a bad decision on the captain to tow people behind the boat in that area. I always picked places with low boat traffic in biscayne bay to knee board etc. it is very possible in a high traffic area while operating a large boat to not see things or people in the water. This wasn’t a situation where there was a dive flag visible and the other operator was basically towing people in a high traffic channel. I blame that operator more than the guy that did the hit because of putting people in that situation to begin with. I hate to say it but it’s impossible to prove anything, even negligence, in this case and he should be givin his boat back and no charges filed or lawsuits proceeded. I know Micheal Adler and have done work for him. It’s a tragedy for his family but when you go out and have fun bad things can happen

    At this point I don't know if I believe the statement that he was on the boat alone. But understand he wasn't docking the boat at black point marina trying to trailer the boat. Parking the boat behind your house in a private dock is much easier, and if you have someone waiting for you like a spouse or kid or friend to take the line, it is not a complicated process. But I don't think he would have taken that boat out by himself in the first place, I believe he is trying to keep family or friends out of the situation. But time will tell.

But a 78 year old all alone, in a boat that's 42 feet, that you can barley look over the helm when driving from an enclosed cockpit. Just to run around deck side to try and anchor that boat is way to much for him. In a situation at 78 he can't properly handle that boat.

      From what reported, the ski boat wasn't a good boat to be used for skiing, said it was to large and took time returning to down skiers... idk. We would always stop as soon as skier fell and wouldn't ski in high traffic area's.

      That's not how it works with cars either. They have to be able to prove you were operating the vehicle while intoxicated. It is entirely possible that a large boat/vehicle did not realize there was an accident. I was side swiped by the flat bed trailer of an 18-wheeler on the highway and they didn't even slow down. My insurance company said that it actually happens more than you would think because many times they don't realize they hit anyone. He's not making a statement because his lawyer advised him not to. She is smart enough to know that anything he says "can and will be used against him" in a court of law. It really doesn't matter what you or I or anyone unrelated to the case thinks he should do. A statement is not going to bring Ella back and wouldn't do anything but implicate him in something that may not even be his fault.
