They still deny today that The Lion King was a Kimba the White Lion rip-off when even the animators who worked on it thought it was an adaptation. The only ones who deny this are the shills and anyone who never grew up watching Kimba. They even had the gall to copy the very same rock stage where Simba was presented to the animals 🤣
They'd probably tell you that if you don't like the current diversity, go back and watch some of the older Disney movies. I'd counter with there's been plenty of Disney movies with non-white representation at this point: if they don't like our majestic white-to-be Moana, they can always go back and watch Moana 1 over and over again
Yeah, that's why they now bowed down to Japan and licensed anime. Disney lost the animation industry to Japan. Both Disney and Hollywood kept copying ideas from Japanese media into their box office hits and now that they stopped Japan won. Americans can only dream of catching up to Japanese animation's success today.
There's a 100-year-old movie called Moana that follows a Polynesian family through its day and Moana gets married at the end. It's a documentary although some of the activities are staged for the production. Moana is a young man so it's also a classic Hollywood gender swap. The original was made by the director of Nanook Of The North (about Eskimos) and it's pretty good. Also boobs
While I totally believe Disney would and probably did steal the idea proving it is gonna be the same old same old. Their legal dept usually covers their tracks on this stuff pretty good. Let's hope their dei initiative will have hampered their detail. One can hope. Any pain Disney suffers is fine by me.
Disney is the gift that keeps on giving. Weren't they getting sued by a software company for using CGI software that they didn't buy. We never got a conclusion of what happened to that?
Remember they got away with ripping off that guy that wrote that game that was essentially Star Trek Discovey apart from all the bad bits they embellished it with. They will just buy off the judge like they always do.
Spiritual ancestors manifesting as animals is a Polynesian belief... in other words, Disney can simply claim it took inspiration directly from the religious beliefs, not the guy's script. Same with the turtle thing. That's a Polynesian belief too. Problem is, the guy's script is HEAVILY based on Polynesian beliefs and stories, and Disney can point to all those things and just claim coincidence. None of the things pointed out are SOLELY original to his script. They are all part of the religious myths, and Disney can point directly to that fact to dismiss claims of plagiarism. It'd be like claiming plagiarism because somebody made a Christian movie similar to one you made... because Jesus fed 5000 with 5 loaves and 2 fish, healed a blind man by putting mud on his eyes and telling him to wash in a pool, was betrayed by one of his disciples, and was nailed to a cross in both scripts. It's very different if lines of dialog are lifted almost verbatim from an ORIGINAL script... say, a non-Biblical conversation between Peter and John about how many fish they pulled up and how they should go about preserving them... if something like THAT appears in both hypothetical scripts, THEN you've got a strong plagiarism case. But generalities usually aren't compelling enough. He needs to have a smoking gun: say, a memo mentioning his script by name passing into Disney execs' hands. Just saying a story based heavily on Polynesian myth is really similar to another story also heavily based on Polynesian myth isn't going to fare well in copyright court.
Yes. My guess is that laches doctrine was incorrectly applied by the court in the first decision, and the judge has decided here to use the reuse of the characters from the first project to argue that because the copyright infringement is now ongoing, laches doesn't apply to at all to the first suit. This will be interesting because if it does survive summary judgement and proceeds to discovery, Disney might settle for hundreds of millions. 10bn is reasonable once you factor in streaming revenue, ride tickets, merchandise sales, box office, syndication release rights, etc.
@@richardmartin8998 I think that in a lot of these cases, they put a number like 10 billion on it knowing that, while it's not totally unreasonable, they probably wouldn't get it, but that would be happy with somewhere in the hundreds of millions; both sides would look like they have had a win... the lawyers certainly would have. I still think that the characters being used in the remake would work for a claim against Moana as well as Moana 2, unless something about it being live-action gets around the claim. I'd take the hundreds of millions, try to get a credit on the movie, and ask for a small percentage of the profits. But, I'm not a lawyer, I don't live in America, so I don't know if that would even be a possibility.
There is nothing original about the script or storyline. Girl boss couple with a hero redemption arc. Not one to defend Disney, but it’s been done a thousand times. The plaintiff will have hard time showing any kind of theft.
And the fact that both are based on POLYNESIAN MYTH makes it REALLY hard to claim Disney stole the ideas and imagery when this guy 'stole' all the ideas directly from the POLYNESIANS' original myths. And the notion of spirits returning as animals isn't even uniquely Polynesian. It's a common theme in shamanistic religions all over the world, as well as any religion which features reincarnation, such as Hinduism and Buddhism.
Unlikely because he drew _heavily_ from actual Polynesian myth for his story so it's very easy for Disney to claim they did the same, rather than copying his ideas.
A similar lawsuit was made against Frozen, but failed largely because the alleged plagiarized parts were too broad. (Sisters, ice powers, power of love, stuff like that). This is pretty broad too. How many stories involve defying parents to save your home while allying with (or against) various spirits?
Yeah, to claim plagiarism you've got to have some REALLY specific material, OR some internal memos mentioning your work by name. I mean, for crying out loud, look how many isekai manga there are! And there's no plagiarism cries going on there, despite almost all of them having the same plot line and story beats!
10 billion is 2,5% of what Moana earned? Are you joking or did that author take few pills too many? That would make total Moana earning 400 Billion. LMAO
Maybe it's including all sales to do with the brand itself? Toys, backpacks, lunchboxes, dvds, blu-rays, and other merch, you name it. That's the only way I can think of it coming anywhere close (I still don't believe it's that close). Superhero toy sales dwarf the MCU's profits. That's why sony let marvel use spiderman in the movies as long as they got some of the toy sales
At this point I hate the company so much and want to see them go down so much I hope they have to pay the 10 billion REGARDLESS of whether the claimant has any merit or not.
If this is true, then Disney must have factored in getting sued in their profit margin. They must have thought it was worth the risk as they couldn't not make Moana 2
Apparently he tried, but the case was kicked out because (iirc) there had been too much time between the movie coming out and him filing the suit. The second movie's release seems to have renewed the timer.

For some reason this just made me think of the scene in the movie full metal jacket where all the soldiers conscripted for deployment in Vietnam start marching to the mickey mouse march
Is that the reason why Disney is running out of ideas for the original movies that they have released is because they can't come up with anything new? Or is it the fact they take from others idea's.
I'm sure there was some sort of Live Action Polynesian "Ocean quest" Movie I saw many years before Moana - I distinctly remember wondering if they were related or not.
