- The Supreme Court says federal agents can remove razor wire that the Texas National Guard placed along the Rio Grande to try and deter illegal border crossings. But in the border city of Eagle Pass, the state is still keeping federal Border Patrol agents away from one of those crossing points. CBS News' Omar Villafranca reports.

I know what it says about border security and states having the right to step in when the federal government fails or refuses to act. The feds have broken a constitutional pack with the states, giving the states the authority to secure the border. @@jeansherwood2428

Exactly. The Feds take it down, they can put it back up. The ruling , I assume, said that if they want to cut the wire , they can given the fact they are primarily responsible for border control. It assumes that the Feds have our best interest at heart.
The Supreme Court returned it to the 5th district court. They did not agree to anything.

The courts ruled it is legal for the BP to remove the wire if and when it interferes with them patrolling the border. They didn't make it illegal for Texas to put it up. The governor is not defying anything. The feds CAN remove wire, but the state is under no obligation to make it easier to do so, and they can replace whatever the feds remove.
If the Supreme court has ordered removal, and they refuse and reinstall, it’s absolutely defying.

Literally impossible to be defying federal law by securing the border. Also they said that border patrol could cut the wire, not that texas had to make the wire go away, nor that texas had to cease adding more razor wire. Our federal agencies are not doing their job, happy to see a state stepping up for the rest of the country.

Texas has the obligation and responsibility to uphold current congressional laws which means protecting its citizens and securing the border. @highcouncil1302 using the Supremecy clause to violate federal law is interesting. Refusing to secure the border and allowing an invasion violates plenty of laws.

Any federal government that chooses that option has effectively ceded their authority in that realm. If they aren't going to do it, then the states can step in and take over, which is exactly what Texas is doing at the moment.
