I can’t believe the landlords are continuing to use this woman who claims to be an attorney and property manager. If she was a lawyer she would understand the difference between a legal notice ir service of documents and “the tenants knew this was coming “ in order to get a writ if eviction. She wants the judge to ignore the legal process because this has dragged out too long. It’s her fault the case keeps being dismissed but she just doesn’t get it.
In the prior hearing, it was disclosed the lawyer is related to the plaintiff/landlord.

When the tenants attorney pointed out a company name where the document said “Landlord” this woman just explained she owned the property management company and was also representing them as their attorney. I missed the part about her being related. She should be paying THEM, at this point. I’m surprised Judge Simpson hasn’t questioned her credentials.

When the defense lawyer says "my client stands mute" is telling the Judge not to ask the defendant any questions about their guilt ... a good defense attorney will do this for their clients who talk too much and are more likely to say something that will piss off the Judge. lol.
That’s totally wrong! It means the defendant is invoking their right to remain silent in regards to their plea, which essentially means they are pleading not guilty, but can change their plea later if they choose to do so.

I have never seen Judge Simpson so mad. He's always been fair and measured even with the pro se sov cits. The defense obviously needs to check himself and not make claims that are indefensible.
It is simple, no cars back then, and then in December 15, 1791, the 10th Amendment was added to the constitution makes clear that any powers that are not specifically given to the federal government, nor withheld from the states, are reserved to those respective states, or to the people at large. Simple terms, gives the state power to make its laws.
Exactly. And the right to travel is the right to go from one state to another without paying entry fees or tarrifs on goods. Back then, a farmer trying to get goods across several states could wind up broke before going to market. It was impeding trade and travel by people who wanted to move to other states for work. It never has been about DL's, cars, licensing, insurance and so on. Sovcits can't wrap their heads around it.

Exactly I think you should be given help for the first child, but if you continue to have children while on assistance then it should be lowered. To the point if you continue to have multiple children and can't properly provide for them you lose them until you can on your own provide for them.

@@leslie974 I agree to an extent. There are many parents who work which are on assistance who are doing the best they can for their children. Should they lose their child/ren? The parent may not be a great provider but can be a great parent, should the child/ren pay the price by being placed into foster care, or with a relative because of public assistance? I think not. I do believe however, people should not keep having children if they cannot afford to do so. I also believe that the states should be giving people a hands up instead of hand outs. For example: If the parent did not graduate high school, require a GED in order to continue support. Then offer college or trade school. Require a money management course. Help with daycare. However, parents would be required to do these things to continue with benefits. This way the system is helping them become stable, dependable earners and parents.

The "state " already offers free school to these people, (when i was in nursing school in 2002 paying my own way 90% of my classmates were welfare to work girls that were going to school just enough to keep their checks, getting it paid for by the state and still getting studentloans taking rhe cash to play with every semester) theres no excuse in the US not to have a education and a job, if your struggling then keep your legs closed and dont have kids or get BC that was invented over 60 years ago if you cant control yourself, I am 52 with 1 child. As a minor, this person's record would normally be expunged, but this followed him beyond that, so he's done something beyond a "normal" child exploit crime. I also don't know if CSE includes SA in this state. I watch plenty of court cases, etc and I have a, sometimes problematic, imagination, I'm also aware of the law as it normally pertains to children, so yeah. It may just be I don't want to imagine what he did.

Seems a little broken when we have 13-17yo kids committing murder getting that expunged but he can't get this expunged from when he was placed on it at 13. If the Tenant had paid "her share" every month, I would have a different feeling about this, but she seems to have taken the position that not getting her monthly voucher means she doesn't have to pay at all - and that's just not how it works. Simpson all of Simpson's compassion is laudable, but he's allowing it to play to the plaintiffs detriment unfairly.*

Judge DiSanto answered that wrong. The answer is A - There is a difference between travelling and operating. B - In the Constitution the 10th Amendment allows for states to enact laws and all of them require a license to drive. Dude can still travel (as long as he doesn't violate probation) but he can't operate because he lost that privilege. You have to show you can be responsible if you are going to operate something that could easily kill someone. Black's Law is just a dictionary and the most recent editions clarify the distinction between travelling and driving. There is nothing in the Constitution about vehicles.

Traveling and driving are not the same..u can travel in many ways that do not include driving..you can walk,get a bike, hell even a horse. A million ways to travel but driving with no tags or insurance isnt one of them
While Judge Disanto is almost always correct in fact and law, she is not the best at explaining herself and making clear statements. The “travel” question would have been so easy to answer.
Yeah, I understand what she was getting at, but if her goal was to explain it to this guy on a level that he would understand, she didn’t get that across very well.
Police and prosecutors and judges all need to get on the same page on how to deal with sovcits. If you misspeak or explain something in a weird way, they will find ways to twist the words and take it as a validation or a win, and then you’ll have more of them spouting similar arguments.
The "right to travel" isn't specifically named in the US Constitution. It's covered under other rights.
Its a stupid argument anyway. Operation of a motor vehicle isn't the same as "traveling". By their rationale, Greyhound busses should not charge fare because if someone cant pay, the company is then interfering with ones right to travel. People have the right to travel, but they have to pay related expenses depending on the mode selected or else they need to take it on the heel and toe. Sov cits are so ridiculous.

Yeah I wasn’t happy with that at all, this is why a lot of landlords eventually stop taking section 8 ppl like her. I know it’s expensive and she’s already loosing money on this moocher but she really needs to invest in a lawyer and start a PROPER eviction. Judge Simpson shouldn’t be making the landlord bend sideways for a tenant that isn’t even trying and he wouldn’t be able to get that over on a real attorney because as it stands she has every right to ask for an eviction he just kept making her walk it back.

Someone who wants to make money is my guess. I am a landlord. I own an upper/lower duplex, a 2 story house converted into 2 units. I live in one and rent out the other. Its pretty dope. Rent $ paid off the mortgage and now covers all my utilities, taxes and upkeep often with $ left over at the end of the year. I have virtually 0$ in housing expense. Plenty of equity in the property. I have invested the money I would have been spending on housing over the years and earned dividends. I have more money now than I will ever need in the future. Smartest thing I've ever done, being a landlord even in the small way i am.
