  • A writ petition was filed by Social Activist ML Ravi in Madras High Court against the election of 4MPs and 8MLAs who allegedly contested 2019 and 2021 elections under the symbol of a political party different from their parties.
    The court disposed the petition observing that the Returning Officers perform a quasi judicial act of accepting the nomination of a candidate on the basis of the papers filed before him/her, and if there are any discrepancies in those documents, the election of such a candidate could be challenged only by way of an election petition and not a writ petition
    There are 5 aspects of the case namely returning officer, nomination of candidates, allocation of symbols, election petition and writ petition which are important for the exam point of view and these will be discussed in the upcoming part of the video.

    Administrative machinery for general elections as given in the Constitution and Representation of People Act 1951.
    At national level is the Election commission with its chief election commissioner and other election commissioners appointed by the president. They are responsible for superintendence, direction and control of elections in India.
    At State level is the Chief Electoral Officer appointed by the election commission. He supervises the conduct of election in the state.
    At District level is the District Election Officer appointed by the election commission. He appoints the presiding and polling officers of the polling station and gets accounts of election expenses.
    At constituency level, two offices are created, namely the observer and the returning officer. They are appointed by the election commission. The observer observes for any malpractices and directs the returning officer to stop counting of votes and declaration of result if any malpractice is found. The returning officer is responsible for overall conduct of election that includes getting nomination and scrutinizing them, publication of the list of candidates, counting of votes and taking decision in case of equality of votes.
    At polling station, two offices are created, namely the presiding officer and polling officer. They are appointed by the District Election officer. They are responsible for fair conduct of the poll in their station.
