- Judge Reed O'Connor from the Northern District Federal Court granted Texas Gun Rights summary judgment -- striking down the ATF's ban on forced reset triggers!
The decision effectively does the following:
- Vacates the ATF’s classification of FRTs as “machine guns”
- Stops the ATF from enforcing the expanded definition of “machine gun” against certain parties, including plaintiffs, their families, and NAGR & TXGR members
- Stops the ATF from pursuing criminal proceedings against the plaintiffs
- Orders the ATF to return all confiscated components
- Orders the ATF to mail a letter correcting their previous letter that warned suspected FRT holders that they possessed a “machine gun”
In a scathing rebuke, Judge O'Connor called out the ATF for continuously bypassing congress to try and make law:
“Each time an agency circumvents the legislative process it chips away at the most prudent reason for the separation of powers, that is, ensuring unelected and unaccountable individuals do not make the law. This reason alone compels the Court’s decision today.”
But this will NOT be the last battle with the ATF; we anticipate they will fight to have this overturned in the Fifth Circuit.

Its a temporary stay until there is another lower court ruling. This is NOT a win.
It's a vacating of the rule and enjoining against enforcement, not a stay of the ruling.

When do they go back on sale?
Not anytime soon. He still has the ongoing case in NY that basically stops him, and only him, from selling FRT triggers anywhere in the USA. It is now legal for anyone else in the USA to start designing, manufacturing, and selling FRTs. However just like before when they were legal, he was the only company selling them because he went after anyone making anything similar to protect his patent. Fast forward to 2024 and now the one and only citizen in the US that is allowed to make them (according to the patent) is the one and only citizen in the US not allowed to legally sell them.
@CncMAC I guess the super safety is one type force reset system that is legal to sell or make?
@@HvacGuy76 I'm not qualified to make that decision. But I do believe whole heartedly that with the mechanics of the super safety that it is indeed most definitely an FRT trigger.

That's how districts work, bruh.
Pray the ATF pushes this to the Supremes for it to reach the nation. But they won't do that because they don't want it to be nationwide.
@kauboy9816 my point is this is a lot of excitement that doesn't effect really anyone. Obviously that's how districts work but the ruling even in that jurisdiction doesn't even effect everyone there. Lol
