I think he is confused between state and government and their roles. The state has constitution where it is determined that what shall be the nature of governance in this state.
I believe there was no khilafat after Ali (ra) whatever succeeded was mulukiyat in the name of khilafat but this title was the only thing that unified muslim ummah and this title nullifying the boundaries and this title was what western world was scared of ! Britishers in order to defeat muslims used all their power and resources to end this title in muslim ummah ! They succeeded in this scheme by the help of Abdul Wahab and soud dynasty . Now these scholars trying to make muslim believe that there is no concept of al aradu lillah wal Hukum lillah in islam and muslims shouldn't rule non-Muslims , they shouldn't strive to impose Sharia and they should live under the non islamic governance which eventually is what westerners want muslims to do . My argument is if that's the case then why don't we see any non muslim ruler in the islamic domain in islamic history !
