It is called extra "lateral rights" to mine a vein from your claim followed underground without having the surface claimed over where you follow the vein underground. If this gold vein under the Mammoth Mine had surfaced on the Mammoth Mine's mining claims, then the WASP mine would not have legally mined under the Mammoth Mine. Cases like this usually ended up in civil court with case law definitions. As for the excuse of being dark and nobody knew where they where mining is completely wrong. Since the mid 1880's only the very small mom and pops family living mines were not surveyed with all the bigger mines having their mines continually surveyed with a company surveyor or the they employed the roaming surveyor that would travel around surveying prominent mines like the Wasp and Mammoth Mines. The Wasp Mine definitely knew they were mining under the mining claims of the Mammoth Mine with also knowing the Wasp Mine was legally mining under the Mammoth Mine because the deep gold vein they were mining did not surface on the Mammoth mining claims. If this gold vein had surfaced on the Mammoth mining claims a civil law suite would have had been won forcing the Wasp Mine to reimbursed the Mammoth mine for every ounce of gold mined under the Mammoth Mine's mining claims, with the Wasp Mine losing money by having to eat the cost of mining and smelting the gold mined that was illegally mined under the Mammoth Mine's mining claims. There never was a civil law suite filled because the Mammoth Mine knew the deep Wasp Mine gold vein was exposed on the Wasp mine's mining claims without surfacing on the Mammoth mining claims. The Mining Law of 1872 is defined in wording and administrated through and defined by case law with there already being case law on this particular situation. Unfortunately, the Abominious Reconciliation Act of 1994 wiped out half of the case laws defining the Mining Law of 1872 with the replacing of the assessment work with the "I a speculator that does not have to locate and prove with an actual surface discovery of the mineral or metal before a mining claim can be filled, with just paying a $100 ($165 today) yearly holding fee. So we went from actual prospecting with discovery to any speculator who does not prove anything just paying the yearly $165 Holding Fee. Go figure !
I think your information is ok but you have it backwards. It was not the Wasp that mined under the Mammoth . It was the Mammoth that mined UN nder the Wasp.
The crack about it being dark down there and they didn’t know where they were was a joke by Clay.
The Mammoth was started in 1883 but the surface gold at the Wasp was not discovered until 1986. Nobody knew or could have known in the 1800s where the vain surfaced.
