    You are slightly wrong concerning which licenses you need. A Master Use License is ONLY needed when you want to use the actual song itself, either a sample or the whole song, in another recording. This would be the case if you are a singer and you want to use the song with YOUR vocals on it and the original music in the background. If you just want to do a cover song then you do NOT need a Master Use License. You will first need a Mechanical License to record your own version of the song. If you want to go further and create a video then you will need a Synchronization License to synch your recording with the video. And a Performance License is for clubs and businesses that want to play popular songs or hire bands to play the songs of others (covers) and you would get one from ASCAP, BMI, or SESAC. The law encourages the creation of cover tunes so you can usually get a Mechanical License for under $100.00, say from the Harry Fox Agency or any number of places. Many youtubers believe that a Mechanical License gives them the right to take songs, music, tv clips, etc. for their videos but they are wrong and sometimes that Synch license is quite expensive, especially if the copyright owner discovers the video and sues for infringement. If the song is owned by one of the big five record labels you will not likely be able to afford a Master Use License for a popular song. These can run anywhere from $35,000.00 to hundreds of thousands of dollars for their use. For example, Judas Priest licensed one of their songs recently for a commercial at the rumored price of $50,000.00. Of all the licenses, the Master Use is the most expensive and hardest to acquire.

    Very nice video and well structured with all details. One genuine question that is not directly answered here : As a live perfomer, can I play beatles songs in public (small concerts) etc.. What should I do to avoid any problems in relation with these "live" perfomances ?

    Thanks for explaining this in depth as did not know there was more than one music licence..the type I needed is master licence for my own tracks

    Which license do I apply for if I want to do my very own version of a copyright song??? This means I want to personally play the instruments, arrange, change the structure a little bit, and I myself record my performance on MP3/MP4. I see so many people grab their guitars and cover songs to their hearts' content on UA-cam. I want to do the same but do it legally. Thanks.

    Hi, I have a question : I want to use “ Pachelbel's Canon in D “ - that will I play and record on my keyboard.
    Google said “ Pachelbel died in 1706, long before copyright existed in its modern form, and so the composition is most definitely in the public domain. This means that if you can get an orchestra together, you can perform Pachelbel's Canon in D major without having to get permission from Pachelbel's heirs, estate or agents.”
    So, do I consider google search as legitimate under the law that I can use that song?
    Where to ask You Tube owners if this is true? I suppose they do not have phone or email?

    Well still confused though. I'd like to run my online radio station just for fun out of passion for music a few hours a day not everyday.I would use mp3 music files extracted off UA-cam videos .No intention to use music player platforms such as iTunes etc. No idea ,who to pay royalties to or what license go for. Any idea?

      it depends on which territory you are, but since its a public performance online, id bet its SoundExchange the PRO that is entitled to collect royalties from you.

    Would a video game soundtrack need to be a Mechanical license AND a Performance license? Or just Mechanical

      That's a good question! I think only a mechanical license, but since I am a composer and not a lawyer please contact your local performance rights organisation to be sure.

    Hi, Great video and information. Just to make sure I understood: Royalty Free music, like what you do.....I pay you ONE TIME and I can use that music as I want, for any purpose....record it, perform it, .....Now, I assume there are other rights that you keep, like the rights to publish it right? Also, in noway "royalty free" means "exclusive" or "total rights"....assuming I am correct on this, if not please correct me,.....is there a type of licencing that rights the buyer "total and exclusive rights" and if so, what is the name of such licence.....say, I commission you to write me a piece of music...say a 3 min sheet music for christmas or mother's day...but I want to have all the exclusive rights to it....I want to be the only person who can publish it and sell publishing rights....is that possible? Thank you.

      Yes, you are correct in you assumptions. If you want the music exclusive for yourself, you need custom music with an exclusive license. You can only get this when you ask a composer to compose custom music for you. An exclusive license of course is more expensive than a non-exclusive license.

    Or a more feasible scenario....I give you a melody and a list of my favorite instruments, and ask that you help me make some arrangements in a specific style...say a Tango style accompaniment....even if for ever your name will be in the arrangement, can one buy ALL the rights from you, the composer/arranger? And last question...do you have a facebook page? much easier to communicate than through youtube. Thanks.

      I cannot answer this question. It depends on a lot of factors like how well known is the hit song and for what purpose do you want to use it. Please contact your local licensing organisation to get the numbers.

      ya it depends...unknown artists can get between $1000-$5000 per license...and well known artists/songs can get between $10,000 - $100,000 per license

      Pretty sure that if you only post it on youtube, you'll be fine. Can't post on streaming services though. Depending on how similar the cover is you might not make any money though.
