The prosecution in a trial for offence u/s 302 IPC Produced witness 'A'. A during his cross mamination by the defense admitted (i) that he signed his statement recorded u/s 161 Cr.P.C. and (ii) at his said statement was read over to him by Investigating Officer outside the court room before e entered the Witness Box. The defense pleaded that entire testimony of "A' be excluded from consideration. Decide.
I think his evidence would not be admissible and is liable to be refused fir consideration in its entirety
