      I mean have you seen Israel's opening. If any random person would see that first they'd certainly be convinced of that side of the argument, so I doubt this is going to have a significant impact on most people's opinions even if by itself it's a fairly convincing speech. To me attempting to look at the convincingness of the openings from a layman's perspective and from such I'd say Israel's was more convincing

Their opening argument was basically a procedural one, much of which makes little sense to people outside of international law sphere. The SA case is more compelling and straightforwardly presented.

    Honestly, I think the biggest give away was when secretary Blinken stated that there was a "gap" between Israel's stated goals of destroying Hamas and what they're actually doing. At that point I had no doubt. It was the most subtle way for him to say they're doing a genocide without getting in trouble.

    Although they presented the case excellently, I wouldn’t be so optimistic about South Africa’s chances of getting the ruling - were it not for Israel’s strategy of … umm … calling the plaintiffs Hamas and telling the court they have no authority. Somehow I don’t think that will go down well with even the most studiously impartial judge.

      It's mostly because everyone knows, this will not matter in the grand scheme of things, because let's be real, if South Africa has any serious evidence to base their claim of a genocide, then it's still going to take years until that case has officially been proven or rejected.
      About the only reason this could matter, is if the court says there is suspicion which could allow them to say, they want the military operation to be ceased immediately!
      However let's be honest, this is something really difficult to prove, because intent is not something you can really accuse Israel at all.

      @@dimitriosdrossidis9633I think the common knowledge that “intent is difficult to prove” is actually flipped on its head here because Israel’s been so proudly vocal in its intent at every level of its society. The hard part is, do we consider 300,000 unalived in 3 months to be geocide or liable to become geocide, when the scale isn’t at the same level as prior incontrovertible geocides. And are geopolitics gonna pressure the court to destroy its credibility just to let Israel off the hook (at least until it does so much damage that geocide is the only possible conclusion).

If the case wasn't so strong and Israel's intent not so blatant at every level taht even the worst mainstream propaganda can't spin this to look even questioningly good, I can guarantee you they'd be broadcasting this 24/7 along with commentary on how anybody opposed to Israel is anti-semitic and a terrorist sympathiser.
      That not a single mainstream network or newspaper even mentioned this was going on let alone any of the details from it beyond glancing over Israel's defence day as if they were just responding to a suggestion of genocide being what they're doing is yet another indictment in how for all our claims of being democratic and champions of free speech the reality is that our entire media ecosystem is little better than the worst propaganda examples of 1940's Germany/Soviet Union.

      If I could rewrite Israel's argument, I'd have phrased it more holistically. "The U.N. and League of Nations before it have never protected Israel from anything, so now we're doing it ourselves. If you complain about our methods, too bad, you had your chance at protecting us." Insincere, but it could fly.
      Literally pulling the Shoah card as if it were a dead relative at middle school is... inelegant to the point that I'm disappointed Israel didn't put more work into their defense.

      To be fair, if someone us putting on a caricature to proceed with something serious, it can be hard to take it seriously, especially when it has to do with a genocide that WILL and HAS set a president for more atrocitys to happen.

    A ruling would be more than a political statement. The nations that are signatories to the ICC/ICJ and the Geneva Convention have actually signed a formal treaty. If Israel is ruled against then every signatory nation is now obligated on an individual level to take part in sanctions/condemnation etc. Now the US doesn't care but a whole lot of other nations will be forced to make a call between supporting Israel and being in breach of their treaty obligations. Again some nations won't care but other nations will take it seriously, other countries have all sorts of relationships and interests all over the globe and many of them can't be seen to be breaching treaties. It may force some hands that would otherwise be supporting Israel or staying silent. Say for example Australia, it's been quiet or supportive of Israel for now but Aus is currently playing diplomatic chess in the Pacific with China and the Pacific nations and would be REEEAAAL uncomfortable being put on the spot as being in breach of international treaties. Other countries would have similar issues in their part of the globe. Other countries like France are pretty enthusiastic about being seen to be upright in international law because they see themselves as pillars of the system and are perpetually competing to stay relevant/ahead of the UK/US. A lot of different motivations.
    A ruling against wouldn't be a strict end event but it's a lot more than just a mark of shame.

      For many of the nations that would follow these sanctions I find it hard to believe that many of them would impact Israel. Some countries may not care, for example, the US, but the ones that would follow with sanctions tend not to have a lot of trade with Israel in the first place. For example, Australia sanctioning Israel wouldn't really do much other than send a message. Materially it doesn't really do anything imo.

That was completely and utterly unfothamable a year ago. You may or may not be surprised in regards to Israels links across the globe and what a pressure might be applied. People who live in free-travel democracies don't like being told their passport is no longer valid.

      It would put pressure on the US if other liberal Anglo nations started officially recognizing the ethnic cleansing of Gaza. It's harder to say "no jack, that's mean" in response to criticism of Israel when other liberal secular nations (again, especially Anglo ones) are going "yeah this is fucked".
      And then there's other countries like India and China, who themselves might not directly trade with Israel but who deal with countries that do or that would be more offended at the lack of follow through, to the point of outing diplomatic and economic pressure towards that effect. After all, both China and India trade with Iran and Iran is definitely gonna raise a stink if they pussy out. Not to mention that it makes the leaders of opposing countries look weak or submissive towards US' interests, which is not a popular position to have in those states.
      Overall, it could change nothing or it could change something, which isn't a useful prediction. But it can help at least in the long term framing of the conflict and how people reacted to it, which is a fucked up thing to say but ultimately the most concrete thing I can say.

    I can say that as of about 10 years ago, the military had to start introducing VERY strict social media rules enforceable under the USMJ (military laws). I literally had my drill instructor heavily investigated and punished for recording and posting our workouts to his private instagram. (Granted, he also broke new rules by using workouts as a form of punishment, but that happened pretty often without the same scrutiny.)
    They will straight up Article-15 your ass for harmless posting. God forbid, if you ever did anything bad for the US optically, you would find a court martial real fast.

    Good video, to be clear the proceeding here is asking for an INTERIM intervention.
    That is it's asking the court to momentarily give a remedy WHILE the real cases gets heard. That's why the lawyers were talking about the court not needing to come to a conclusion, etc.
    These were the arguments in favour of the court telling Israel to stop while they decide the issue. It's not clear to me that Vaush understood that.
    ALSO, the main issue from what I gather is the question of INTENT which Vaush seem to gloss over. It's this that will be the most difficult to prove not the atrocities that are well documented.

    This is the ICJ, the International Court of Justice, which has no enforcement mechanism for its rulings, so the worst this specific case could do to Israel is just make them look even worse in the court of public opinion. If this was the ICC, the International Criminal Court, it could be different, as I believe they are actually capable of enforcing their rulings in some way, though I admit my understanding is fairly limited and I'm not sure what their enforcement mechanism looks like.

    AFAIK this court hearing is only to decide if it's possible genocide is happening, not that it is. So it's a much easier case for SA to win, but at the same time it'll only show that Israel *might* be genociding and will need more investigating to prove if it *is*.

    Idk how the Palestinian-Israeli conflict can be resolved equitably now. I think even a 2-state solution is extremely unlikely. Too much water under the bridge. Perhaps Israel annexes "everything" with extraordinarily generous reparations paid to all Palestinians? I can't see Israel allowing the resident Palestinians to remain in the newly-annexed Israeli areas after that...

      The two state solution still makes the most sense. The reason it hasn't been enacted yet though is the same reason it would not be sustainable and that's how dysfunctional the UN security council is due to the veto powers. It's the easiest path to forcing Israel to be a slightly less unhinged country and to finally give Palestinians the chance to self govern and have a semblance of a future.

    Fwiw, having watch the whole preceedings myself, south africa put on a very good case, israel's defense was mostly weak.
    About a third to half of israel's defense was just israel saying 'hamas did some bad stuff' which doesnt offer any defense at all to the charges. With only very few execption would a self defense claim justify an act of genocide even in theory.
    The rest of their defense tried to handle the merits of the case, which at least is a real defense, but they were largely or completely unconvincing.
    Folks who understand the relevant irony here: israel is committed to the anti genocide articles and laws, with good reason.
    Israel is clearly committing genocide.
    If the laws mean anything at all, israel will be found guilty, the anti genocide laws will be upheld, and the jews will thereafter have a good international basis to not themselves be genocided.
    If israel wins, the anti genocide laws mean nothing whatsoever, and the jews end up losing their protection internationally.
    Jews everywhere ought hope israel 🇮🇱 🙏 ❤ loses, is found guilty of genocide, and is punished appropriately.

      I disagree with this view of the court hearing. Firstly, I think what you paraphrase under "hamas did some bad stuff" (way to go btw) was used to establish the reason for a war of self-defense (which is considered legal under international law - a country is allowed to defend itself when it's attacked afaik). This is crucial because SA made it seem like Israel just decided to bomb Gaza out of the blue, which is in fact not the case. And much of the civilian casualties on the Palestinian side come as a result of that. For genocide there has to be proof of intent. And there's where I found SA's case actually unconvincing - they did cite some inflammatory comments, yes, but as far as I saw it failed to show that these accurately reflect official israeli policy and military doctrine. But this is just my view of the hearings, ofc you're welcome to have your own.

      The case isn't bout if iarael can defend itself, it is bout if genocide is a valid form of self defense.

      Just coming at this from a legal perspective, I don't think that aspect of israel's defense was helpful for their case.
      I agree tho that proof of intent is at least partially required. It is possible to 'oops all genocide' a war. But here intent is important. Thats bout the merits, the species offered by sa and I matter in that regard.
      At most the 'hamas did bad stuff' just shows a rationale for self defense. Again, not in question tho.

      @@eliashe1797 So as far as I understood, the case is not about "if genocide is a valid form of self defense". It is about if a genocide is happening in this war of self defense. I would disagree tho, that the aspect of Israel's self defense was hurtful to their case. After all this is the legal basis for their military operation in Gaza with the stated goal to destroy Hamas. While there are undeniably a lot of civilian casualities and needless suffering the question is, if this is done with the explicit intent to commit a genocide or if this is the sad but to be expected collateral damage that is caused by a number of factors such as Gaza being densly populated and Hamas using civilian infrastructure for military purposes. In my opinion this seems to be a far more plausible explanation, which is why I think it was brought up. I also have to add that from my legal understanding of genocide (albeit limited) the question of intent is not optional but crucial in determining wether a genocide is actually happening. There is a reason after all, why there are very few instances of genocide that have been offically classified as such (on of them being the Shoa, Rwanda being another one I think). So I disagree with your statement that intent is only partially required. It's extremely pivotal and I did not find South Africas arguments to that end very convincing.

    I applaud South Africa for initiating this case. When you look at their history, it’s also worth noting the multiracial make up of their legal team. Under their apartheid system, people would never have been able to imagine that (1) the country would be presenting arguments against similar systems at the ICJ and (2) that their legal team would contain both men and women, and most importantly - people of different racial backgrounds. Outside of the specifics of this case, I just thought it was worth noting, particularly after they quoted MLK on the arc of the moral universe bending towards justice.
