Know Your Rights When Asked About Immigration Status

  • You have the right to remain silent. You do not have to answer questions about where you were born, whether you’re a U.S. citizen, or how you entered the country. (Separate rules apply at international borders and airports, and for individuals on certain nonimmigrant visas, including tourists and business travelers.)
    If you’re not a U.S. citizen and an immigration agent requests your immigration papers, you must show them. If you’re over 18, carry your immigration documents with you at all times. If you don’t have immigration papers, say you want to remain silent.
    Do not lie about your citizenship status or provide fake documents.
    If You're Stopped In Your Car
    Stop the car in a safe place as quickly as possible. Turn off the car, turn on the internal light, open the window part way, and place your hands on the wheel.
    Upon request, show police your driver’s license, registration, and proof of insurance.
    If an officer or immigration agent asks to search your car, you can refuse. But if police believe your car contains evidence of a crime, they can search it without your consent.
    Both drivers and passengers have the right to remain silent. If you’re a passenger, you can ask if you’re free to leave. If yes, silently leave.
    If You Feel Your Rights Have Been Violated
    Write down everything you remember, including officers’ badges and patrol car numbers, which agency the officers were from, and any other details. Get contact information for witnesses. If you’re injured, seek medical attention immediately and take photographs of your injuries.
    File a written complaint with the agency’s internal affairs division or civilian complaint board. In most cases, you can file a complaint anonymously if you wish.

    I entered the U.S. with a permanent visa as a teenager and was required to have my alien card in my possession at ALL times, including the 4 years I HONORABLY served in the Marine Corps. Another rule I had to comply with was to register every January with the I.N.S. as a resident alien, even when I was in the Marine Corps. I never objected to such laws because I greatly appreciate the many opportunities that are available in this great nation, And I Proudly say God Bless America and ALL her law-abiding residents.

      I appreciate your service Sean, and your sharing of your opinion. I lived and worked overseas myself and followed all the rules of my host country.
      However, as a born citizen of these United States, I consider the principles upon which this country was founded - that all people are endowed not by government, but by their creator with inalienable rights - to be the highest authority we should look to when creating and carrying out our laws. By that principle, and the principles of the religion in which I was raised, laws are made to serve people and not the other way around.
      It's pretty simple: we need laborers to fill positions Americans will not take. Some foreigners need shelter from wars and poverty. This circumstance has been ongoing since I was a child and this country, when it was more sensible, made the most of it and created a symbiotic relationship between the needs of the American economy and the needs of those fleeing oppression. This perfectly reasonable compromise is now being abandoned in favor of rigidity and cruelty when it would be just as easy - actually FAR easier - to simply increase the number of immigrants we legally allow to enter each year.
      But what's simpler, easier, less costly to taxpayers, and just plain good morals does not suit the interests of the current administration. Cracking down on poor minorities serves their purposes of funneling American anger in another direction while they shred medicare and medicaid. Social Security will be next. They want to give these things to investors to make money off of, but what happens in the next crash? You know exactly what. The money disappears and Regular Americans go without.
      My father served also. He was part of the occupying force in Germany, and if he were here today he would tell you to always question your politicians, whether they're Democrat or Republican. Especially today, when it costs so much to run a campaign and all national politicians today come into office owing their allegiance not to you, the citizen, but to their rich donors.
      I will also say, "God bless you," but I will add the reminder that God Himself has said to all of us, "Do not mistreat or oppress a foreigner."

      Thanks for your service, I followed the same path , happy to answer and follow regulations, I found it very difficult to understand why ppl promote such hard headed behavior.
      When asked plz provide documentation to prove who you are without further hassles ( this is just an advice , not a legal opinion)

      It's simple, it violates constitutional rights. Police officers can't detain anybody for not answering questions, unless there is evidence of a crime. Border patrol agents have the right to demand legal status identification, in fact everybody has to present papers at the border.

      Actually, they were founded by Roger Baldwin on the idea of bringing communism to America. He said they would do it while "being draped in the flag" (fake patriotism so people would think that they were fighting for America while all the time trying to destroy it and bring communism in to replace it.) Study their history and how they have tried to destroy many things that this country once stood upon. It is sad how many people believe them to be champions for Americans, when the fact is they are the opposite.

    Unless there is EVIDENCE of a crime you can be arrested, it's that simple. Do you people realize this violates the rights of American citizens too.
    And it's not like that's the end of it, but there is a civil process that needs to be followed, and protects you too. The officer can present reasonable evidence to a judge and get permission to take action. You can't just harass people because they speak another language or something.

      Jess Cast No it's cuz they don't have anything to hide so when they get pulled over they follow officers orders and show I.D unlike other people that have had previous charges and/or warrants choose to stay quiet and not show i.d so they wont get caught for something they did or are going to do

    These are all good advise for anyone. However, only citizens and persons who are legally in the country actually have 'rights.' What she says about the local and state police only allowed to ask for certain things, etc., are laws and policies not 'rights.' Illegal aliens by the fact of been in the country illegally, are already under a 'reasonable articulable suspicion' which is what local, state or federal law enforcement requires in order to detain, ask anything they want about the 'reasonable articulable suspicion' and you are then required to produce documents and answer questions. Of course, there are some sticky points, but it would take too long to go into it here.

      W C If immigration authorities don’t have a warrant or suspect a crime has taken place, a citizen as well as an immigrant cannot be detained. Immigrants do have the right to remain silent except ask for a lawyer however, they are able to ask for a list of legal services.

      Stefany Gomez - You are specifically talking about 'Immigration Authorities,' in that case, you are correct. However, I am talking about local, state and federal law enforcement, who can then refer the suspect to ICE. Miranda warning, commonly referred to as Miranda Rights, are not rights, they are warnings. Also, a LEO can chose not to give Miranda warning, that only means that what the suspect says cannot be used against him/her. However, that LEO can use knowledge gained from the suspect to find other incriminating evidence, and that is admissible in court.

    ... this is why there are endless "resisting arrest" videos. Misinformation re: "knowing your rights" causes additional charges, injury & worse. Searching you for weapons (& possibly handcuffing) is mandatory for officer safety.

    Glad you care so much for the criminals who shouldn't be here. Me and my daughters took selfdefense classes and I carry now after hearing the tape of laken Riley fighting for her life she fought so hard because she wanted to live so badly and one of the criminals who have entered by the millions in the past 3 years wouldn't allow her too. Protecting criminals and useing victims money to protect them is sickening!!!!
