Pitbulls are banned breeds in my province. But a youtuber gets a dog and calls it a mixed boxer, mastiff. One look at the dog it's a pittie. So he will be up against more legal trouble should his dog get into trouble. Big risk to take.

i may not like the plaintiffs attitude, but its clear the defendant wasnt cut out to walk that dog. the owners bear most of the responsibility, given that theyve clearly raised a dangerous animal, but as the person walking the dog she should have kept full control; never taken it off the leash, never let it overpower her, and ensured to keep others as risk free as she can. clearly she isnt cut out for dogwalking. is the defendant trying to fleece her for money? absolutely. however, i think she should pay him a high amount even if he wasnt fleecing and wasnt annoying in attitude, because she needs to learn the dangers of what she did. and if the only way she can learn that is through monetary means, thats what has to happen.

Law lesson for everyone: this dog was a pitbull mix and therefore uninsurable or if insured would only be covered by the insurance if on the property of the owner and because of the owners negligence. There is no doubt that the owner told the plaintiff to take a flying leap because he was not the negligent one, so his only option was to go after the negligent one (the walker) which CA law would deem negligent and compensate. That’s why he was being mum and not giving a lot of detail like JJ was hoping for. I personally think this is great. I feel like pitbull breeds should be banned in the US like all other civilized countries and the more negligent owners that get sued, jailed and held somewhat liable for their viscous dogs attacks, the less people will continue to own these breeds and they will eventually fade into oblivion where they belong. Show pays out the judgment of whoever she rules in favor of. That's part of the incentive to bring your case to these Court show in the first place. So that doesn't really matter.
If she has no control over the dog she should not have taken up the responsibility of walking it.

i may not like the plaintiffs attitude, but its clear the defendant wasnt cut out to walk that dog. the owners bear most of the responsibility, given that theyve clearly raised a dangerous animal, but as the person walking the dog she should have kept full control; never taken it off the leash, never let it overpower her, and ensured to keep others as risk free as she can. clearly she isnt cut out for dogwalking.
is the defendant trying to fleece her for money? absolutely. however, i think she should pay him a high amount even if he wasnt fleecing and wasnt annoying in attitude, because she needs to learn the dangers of what she did. and if the only way she can learn that is through monetary means, thats what has to happen.
But she didn't take it off leash. The dog knocked the door open and ran away when she came to walk it. That behavior is 100% on the owners.
The plaintiff got what he wanted but also give the defendant a heads up to sue back the owner of the for twice the amount because she has been beaten multiple times. you can tell by how terrifies she with the dog event with the leash on her hand and yet dare not to use it.
Law lesson for everyone: this dog was a pitbull mix and therefore uninsurable or if insured would only be covered by the insurance if on the property of the owner and because of the owners negligence.
There is no doubt that the owner told the plaintiff to take a flying leap because he was not the negligent one, so his only option was to go after the negligent one (the walker) which CA law would deem negligent and compensate.
That’s why he was being mum and not giving a lot of detail like JJ was hoping for. I personally think this is great. I feel like pitbull breeds should be banned in the US like all other civilized countries and the more negligent owners that get sued, jailed and held somewhat liable for their viscous dogs attacks, the less people will continue to own these breeds and they will eventually fade into oblivion where they belong.
Though it was not stated I believe that was the point of the plaintiff as well when he said it’s ‘not about money’ but about justice and more light shown on this breed and the issues they are causing across the nation.

She didn't intend to walk the dog off the lead- The dog slipped out when she opened the gate to collect it, and she had spent the last hour running around after it trying to get a lead on it. Dog bit her too. She should have been more careful opening the gate, but this guy is a jerk going after her and not the dog owner.

People who own aggressive unpredictable dogs like that shouldn't really allow strangers to take responsibility to walk them anyway. I have a scar on my arm from a friend's dog (yellow lab) that bit me because she was stressed out because people kept coming to her home to pick out a pup from her first litter. I picked one out and as I was leaving she bit me. Yes, it hurt. The owners freaked out worried I was gonna sue. I told them I wasn't and I never did. I understood she was stressed. Life happens. U don't have to sue over every little thing. Bites heal. His was a damn scratch. The dog I think just wanted to play with his weaner dog and them freaken out made the dog react. 2 yr old dogs are still immature. The dog needed training but I don't feel he was a danger just needed training. This man wanted money. He didn't deserve $5,000. I've had dogs run to me. A couple of times I've had a Pit bull run up to me and roll on their backs for me to pet them. Dogs know. Completely unknown pit bulls that I didn't know. I would sue a person if they hurt me wayyyyy before suing over a dog.
This is why insurance premiums in the US are through the roof. This was clearly a shitty situation for everyone. The dog got away from the dog walker and she was clearly doing everything she could to get him back, the owners were not present, and the plaintiff got hurt (but had no medical bills). These shows are 'arbitration shows' with both parties agreeing to be bound by the decision (read that somewhere). What happens if someone doesn't abide by their agreement & pay the other party? How do they get their $$ ? If this young woman doesn't have $5k immediately, how long does she have to pay? Or maybe the question is really, how long does he need to be patient? Can he garnish her wages or levy her income tax refund?? Anyone know??
