- The plaintiff purchased a house from the defendant. Included in the sale was a washer and dryer, but during the walkthrough, the plaintiff noticed they were gone. The defendant told the plaintiff she would give him money to make up for the missing appliances, but she never did, so the plaintiff is suing. The defendant insists she left behind the washer and dryer, and she had nothing to do with the appliances’ disappearance. The defendant is countersuing for lost wages.

The defendant started off lying about the age of the appliances... She definitely took or sold them.
she most likely traded the appliances and the trees as payment or partial payment for services she hired for the property .

You can tell from her demeanor that she absolutely has that man's trees cut and she likely either took the appliances or sold them to the maintenance guy, she's such a con she's never give them away. Oak trees are absolutely worth thousands and once they were under contract she had no right to them.
She looks completely nonchalant for someone who sold a house that included trees and washer/dryer and suddenly they're not there.
"Weather" messed up the trees, and her maintenance man took the machines...
I wonder if that should have been disclosed before purchase. I dislike that so much!
I am beyond grateful that buying my first home went as smooth as possible. I got the kitchen appliances with the purchase and they were here when I bought it. They wanted to leave their tenants in the home but my real estate agent said absolutely not thats not her problem so they got the tenants out. Been in my home for almost a year snd still doing great. I see alot of people on here thats had problems. I count myself lucky.

What a con woman. She made every red cent she could have of that property when she sold it.
The defendant is a crook.She knew she had a contract on the house and was closing. She told people to come and take what they wanted before she closed on the house. She knows damn well she gave them to her maintenance man and let her niece's boyfriend cut down the trees because they were worth a lot of money. She's damn lucky they didn't walk away from the deal after all she did. He could've closed on the house and came back 3 days later and got his money back. There's a 3 day waiting period before any funds are transferred on a home sale and if he had title insurance, which most banks require, he could file a claim against them for the trees and the washer and dryer. The old woman's a con artist and a crook.
This is why you keep your mouth shut and you don’t offer anything, if you had nothing to do with the issue. JM would’ve probably gave the guy 50 bucks and called it a day.

Similar happened to my daughter beautiful stainless steel side by side refrigerator day of your n day before sale..she goes has it removed n replaced with new Smaller top freezer silver front refrigerator. Owner was told give him the money at closing for the side by side stainless steel refrigerator in original sale of house. My daughter took pictures n had proof.

Wow, I have a Kenmore dryer that I've had for over 30 years and it's still going. I just bought a spec home, moving from California to Georgia and I'm leaving my old dryer because I don't want to pay to move it. I'm going to try for a Speed Queen...hear they are good for 25 years.

Kenmore is a Sears brand. I doubt they even make them anymore. Sears is basically dead.
Judge should have knocked that $600 down a bit to clarify he should have taken her offer
A family member of mine recently bought a brand new washer/dryer and it costed right at $1200 for the set.
I think if you put the serial number into the website you can find out the manufacturer date
Yeah, but the objects with the serial number are "missing", how the hell is the plaintiff supposed to get the serial number after he found them missing?
Frankly the defendant comes across as very deceptive, she could have very easily consulted her records to give the exact date she purchased them and therefore establish exact age.
JM should have asked to see the police report the woman claims to have filed, I highly suspect the sheriff know nothing about this supposed theft.

The look on her face says a lot, she made money on those trees and paid the handyman with washes and dryer. Sneaky old lady, why else would she offer him 6 hundred bucks for missing appliances if she made made money that was undisclosed!
I guarantee her “nephew” asked if he could take some trees before the sale and he made thousands.

Negotiating the cost of the washer and dryer shouldnt have taken no more than a day. I would not have signed closing docs until that was hashed out. Filing a small claims case sounds like way more work and stress than just having your realtors negotiate the washer and dryer cost.

Well aside from the fact the washer, dryer was listed in the house sale contract, and the defendant admitted they were missing and that it was her responsiblity by the fact she offered money to the plaintiff as compensation.

You must have missed the bit where the washer & dryer were listed in the house contract.
It very common that appliances which get transferred as part house sales have no value listed as its time consuming and a rounding error to the value to the whole property, hence all the professionals involved assume house sellers wouldn't be as petty and small mined as the Defendant seems to be.

Judge stating the plaintiff miscalculations of the age of the appliances was off made her look stupid seeing as how she said the case was just filed then when speaking with the plaintiff @3:50 she said took a while to file he said about a year. So the defendant was right that at the time it was over 6 years old give a take a little so it would be now almost 8 years old. Just saying.
To the people saying she damn well knew what happened to the washer dryer. That doesn’t make any sense she could’ve just as easily listed the house for sale without them. No one buys a house contingent on the fact that there’s washer and dryer and if it was so important, he should’ve taken the $600

Exactly....same thing happened to me when I bought my house. It really wasn't that big of a deal to me. I was disappointed that the seller didn't leave the washer and dryer, but I just purchased a used washer and dryer until I could get a new one!

Why wasn't the money taken out of her escrow account?
Cause you can only do that with both parties agreement to allow it to happen quickly and without additional cost caused by expensive property ligation/dispute.
If the buyer's side withholds a portion of the agree settlement amount (no matter how small) unilaterally the seller can allege the buyer was the party to breech of the sale contract, and in this part of civil law its the burden of the breeching party to prove its a justifed breech. Unless the buyer had solid evidence of the woman taking the washer/dryer and taking the trees for timber, it likely he would be ruled he was the one breeching settlement. Hence why you think the plaintiff lawyer told him suck up the stuff about the trees and the minor cost of the missing washer dryer. Pulling out of a house sale and then renegotiating the contract plus finding a short term rental would cost many thousands of dollar in fees for the various parties involved.
The plaintiff is doing exactly what most people would if faced with same situation.
People don't realize how ignorant it is to say something like "I have a friend who's a lawyer so I just asked him first..." You are the "friend" everyone could do without. When you ask someone who is a lawyer for legal advice, you're asking them to work for free. Same with asking a doctor for medical advice if you run into them in public or otherwise off the clock. If they ask "How are you?" they're being polite, not offering a free appointment. It goes for any profession - expecting your hairdresser friend to do yours for free or a discount and so on. My husband and I owned a tattoo and body piercing studio for years and it was unbelievable how many people- upon seeing us in public - would stop us and ask professional advice (including one girl who came up as we were dining in a restaurant, pulled up her shirt and wanted us to look at her navel piercing). We always carried business cards so we could politely extricate ourselves by giving a card and saying something like "Here is where you can find us, hours and phone number are there too. We want to make sure you get all the time you need and our undivided attention." Of course one never wants to be rude to anyone who has or may bring business your way. But come on, people! It's like they're the same people who as kids thought teachers just lived at school and had no sort of personal life at all, didn't eat or go to the bathroom etc . Whether your doc, lawyer, or even body piercer lol you can be sure we appreciate a kind greeting and will return the same in public. But please, since in most professions "time is money" don't presume on us to give you free...anything. That is all. Rant over.
If they're your Real friend or a family member, you should accommodate them. Not random ppl tho. That's just me and several ppl feel this way n others feel the way u do. Dude is a jerk. He is suing for everything that should have been discussed during closing. Suing for trees being cut down before closing is ridiculous.
It appears that the case could have been avoided altogether. In my view, it seems likely that the handyman took the washer and dryer. The focal point isn't the plaintiff's belief that the defendant provided the washer and dryer to the handyman as compensation for work done. Instead, she denies this and contends that he simply took them. According to the contract, the washer and dryer are supposed to remain with the home. Therefore, the defendant did breach the contract. Despite the defendant's offer of a $600.00 settlement, the plaintiff chose not to accept it. This further emphasizes the unnecessary nature of the case. It appears to have been a waste of airtime.

Guy was a realtor's nightmare client. Appliance issues are a common problem so busy realtors have good connections for reconditioned appliances. Also, if he wanted incorrect legal advice, he should have hired a lawyer rather than calling his friend. It shows how cheap he is. Defendant is just as crazy.
I paid for a move in ready home. If I pay for something in the listing then it needs to be there. End of story.
