If they flew off the moped like that it is because the driver is incompetent for jamming the front brake instead of tapping both the front and the rear brakes gently like you're supposed to. Mopeds don't have ABS and the laws of physics state that every action has an equal and opposite reaction. If you jam the front brakes alone while in motion the momentum will continue to carry your body forward (since mopeds don't have seat belts), and this is how they ended up thrown on the pavement. Anyone who has ever been on a bicycle before already knows this. This is the most ridiculous lawsuit and they won't get anything since they both weren't even wearing their helmets

Throw this case out. NY state law requires the use of motorcycle helmets for both drivers and passengers in Class A and B mopeds. If I was the judge, this case would be dismissed. There is no suit here. They were breaking the law, plain and simple. You know why this law exists? Because of things like this happening. That's why they created the law in the first place.
