    informative video sir, thanks a lot. actually our property was taken by private financial bank under SARAFESI act on 2006. but still possession is in our control, . We reached DRT .. faced so many consequences. .

    Just for information. There is no distinction between symbolic n actual possession. On the same day 1.by pasting notice on property and 2.giving advt. in newspaper and 3.issuing regd. post to borrowers, possession can be taken (both symbolic n actual). After that property could be auctioned.

    Sir what if borrower doesn't reply to the mandatory notice of 60 days? Can bank proceed with sale?
    And what if borrower also doesn't reply to the letter of bank for sale price below the reserve price?
    What happens when borrower doesn't reply only?

      @@credolegalforum3123 bank gave loan to one partnership firm. There was some dispute between the partners, a consent arbitral award came to be passed where in Partner 'A and B' was supposed to repay loan, but consent arbitral award is not registered. The. Bank sent notice and various letters to firm regarding sale. But firm doesn't reply anything to bank. No bidder for auction. So in such a eventuality can bank can proceed to sell the asset with private treaty below the reserve price?

    Sir.. an account become npa and within a week bank has sent demand notice under 13 2. Is this correct?

      They have right to send the demand notice any time after declaring NPA.

    Happy New year sir ,
    We have taken one flat in bidding and we paid 25% to bank. After paying 25%amount only they gave documents to our hand.Once we verified the documents,in building plan it is showing as open terrace.Before bidding bank told it is approved flat. Due to unapproved flat we not interested to take it,and we asked the bank refund the 25% amount .But they are refusing to refund the payment. Please advise what to do sir.
