Advice for those in Pro Se (Pro Per) in Family Court

  • QUESTION: What advice would you give someone who is interested in going pro se (self-representing in family court), or is forced into going pro se due to financial abuse?
    Many of us are unable to afford legal representation and end up (or begin) in pro se. So many people tell me how brave I am but reality is, I didn't have a choice.
    My very first set of declarations were done from a laptop computer propped in the window sill of a women shelter while I was trying to tap into neighboring Wi-Fi. What tips do I have? LOTS!

    Thank you for this advice! Thankfully the Medical Legal team connected with my doctors clinic stepped up to be a "limited scope" attorney in my ongoing custody case. The lawyer I've worked with has been an absolute blessing! I don't know where my case would be without her help!

    After seven years, I'm still trying to hide from my ex. I had to move six times in four years, and have had to deal with about five crooked lawyers

      Your strategy is not to be underestimated. As burdensome as it is, it is effective in the face of family court corruption. After 6 months somewhere and the establishment of a homestate under the UCCJEA, Termination of Parental Rights could be the final solution. A Child's Advocacy Center might help.

    Love to listen to your presentations.
    I’ve finally fired my attorney given cost and not getting anywhere. I’ve had my youngest removed from state 15 months ago and we have joint custody. This was against court orders, against JPA, against IL law, including against parenting relocation statute and child abduction statute ( class 4 felony) . I’m hitting the books to educate myself on the law. Like your suggestions to consult with others to fill the deficiencies.
    I Sat before 6 different judges, this is after a ruling that there was no just cause for respondent to leave the state. But no one has forced him to return… how can anyone ask what a kid wants to do when they are so brainwashed by Indoctrinated parent… such that kids won’t even call text or communicate w me now. Even 2 psychologist identified alienation prior to divorce 7 years ago. But I think what’s important is education on the law as that is something the sheriff and maybe states attorneys office can do something about.
    Kids are really stuck just like with Stockholm syndrome.
    Why does the court system care what it’s called… alienation, narcissism, the pattern is the pattern.
    Hoping for justice someday. In the end, we all sit in judgement before our creator.

    I am ten years out and I am finally feeling equipped and strong enough to go pro se. I am not in active trauma anymore and that is a horrible state to do litigation in. I went through two attorneys who didn’t protect me from post separation abuse nor my children from abuse. The only good result I got is when I went in alone pro se and asked a judge for an emergency restriction of parenting time which she granted immediately. I secured an attorney bc I was scared of my X and our attorneys settled it out of court and brushed it under the rug.

    Hi Tina thanks for being available to be found. I have so many questions. My narcissist filed for divorce in 2016, he put 50/50 on the paperwork. So I ignored it believing to argue it was just arguing the financial and asset issues which we were poor so I wasn’t opposed to anything and honestly I had no interest in seeing him so I was fine with the dissolution and 50/50 custody. Well it turns out he had been filing motions and declarations and lots of stuff while all the paperwork was being “served” to an address he knew I no longer resided. The judgement was final 2018 and although it says 50/50 the specific days are written that I only get Saturdays 9a-4pm. However he didn’t ever enforce it until March of this year 2022. We had 50/50 if not me having my son with me more than him. He’s trying to love yo Las Vegas so I went in to try to get a preventive abduction thing and that’s when I found out about the order. I feel cheated of a fair custody fight and I feel nervous I won’t be able to explain to the court how he did this. And I wonder if I should even try or just focus on the relocation being harmful to my son.

    What do you mean responses to the accusations? Meaning responses you may give after being accused of it in court ?

    I would like to ask the judge, how would you like it if you had to be a surgeon to save your child's life? Would that be fair holding you to a surgeons standards? It's so corrupt to the Constitutional laws. Guess that is why family court is considered the lower courts. Would you recommend setting your case up for appeal?

    What makes me look like the problem. My ex has taken me back to court because he moved but wasn't upfront with the court. I have now filed several contempt, but I don't want to be the problem.

      Be “the problem” in my experience, the court speaks to “the squeaky wheel” they don’t have time to address the whisper in the wind which may or may not be “in the child’s best interest “
      I will also just add, law, and court is one thing , fair and best for the child, is another , unfortunately, civil court was never ever meant to be a means to determine family issues and definitely not best interests of children, it deals with the task the best it can, but who does the court deal with really??? Attorneys, and who has the most attorney representation ? Those w the most money .
      Get in often, and get in first in every chance you can .

    Thank you for what you do, Tina. Like all the Greats, from MLK to Jesus, those who hate have found your channel and been compelled to attack you. Just remember it is because they recognize your strength and truth. When a wounded healer inhabits Truth and Strength, they will be targeted, which is really sad. These commentators have little power compared to the tyranical powers in the legal system, so I'm sure it doesn't phase you.

    For anybody watching: this woman claims that she was horrified, terrified, traumatized and in fear for her life. But it's crucial to understand that literally EVERY woman who is going through a divorce or separation says this. In fact, women who make this claim get enormous amounts of free government benefits, free housing, free restraining orders, free legal help, etc, etc, etc. I'm not saying that this woman was lying, but I'm also not saying that she wasn't. She mentions that her ex-husband never physically assaulted her, and them she mentions living in a battered women's shelter. So that's an inconsistency in itself.
    In reality, every, single woman who wants something from her ex-partner, whether it's custody of children, financial assets, or anything else, pretends that she's in fear of her life. Meanwhile, the statistics on men beating and killing ex-partners, while disturbing, do not suggest that assaults and murders are common.
    It is wise to consider that EVERY woman claims to be terrified of her ex-husband or boyfriend.
    They have every incentive to.

      You truly have more issues than I can deal with here, but to clarify for you:
      1. I have never taken government assistance.
      2. I forgave $100,000 in child support arrears to secure peace and safety for myself and my children. Literally excused his entire balance to be free of him.
      3. The narrative of women you are trying to paint is as old as the Salem witch trials. Yawn…
      4. My ex-husband has assaulted several women since me, and his brother was just sentenced to 280 years in prison for molesting children as young as 10 months old. Not sure this is the family you want to go to bat for but by all means…

Those kinds of statements make your story look unrealistic. Do you realize women make up half the population and that your projecting your limited and immatured perspective on it? Grow up and try again. All family court cases should be in the child's best interest. Children deserve more protection. 58,000 children are sex trafficked by their own custodial parent in the US each year after a court orders that child to be out of the protective parent's custody and in the unsupervised custody of an abusive parent. A lot of men participate in the child exploitation industry through their porn consumption. Your probably one of them attacking a protective parent. Back up

    At 15:26, "This is one area where perjury is allowed." You're kidding, right? We're talking about Family Court here. It's not like it's REAL court. Perjury is everywhere. Everyone lies and the judge expects it. The courts tolerate perjury which, in my opinion, destroys any credibility they have. You wonder why courts often ignore women who say they're in danger? It's because LOTS of women come to court and lie about being in danger. So, if you want to blame someone for ignoring you, blame other women. By the way, I'm a nine-foot tall Chinese woman named Barack Obama. With my right hand raised, I swear to God, your Honor, I'm telling the truth.

      She obviously meant plagiarism and it was obvious she was joking somewhat. But essentially looking at the language other women use to describe their cases. Many people in this position just don’t have the professional language available to describe their cases and situation.

      Rude. Other people's bad behavior shouldn't justify a prejudice applied to half the population. Your comment is highly manipulative. The solution is to raise the bar for judges and court which is supposed to be beyond prejudice and here you are justifying it away. That's not a strategy for evolution but oppression.
