Can I use a jean that is a size larger due to weight loose or is it better to use a oversized jean ?

You can totally use those jeans! Anything you feel comfortable in will work perfect! 💟

it's not on an angle when you consider each side by itself :) it's a right angle from the outside seam. if the outside seam runs straight down the side, cutting at a right angle should make it straight

I would definitely sew a hem to them. If you want the true stone-wash hem look, get pants that are at least as wide at the leg as on the cut-line, so you can transpose the hem up and re-use it.
