The DOJ prevents sentencing due to a "guiding" memo crafted by Republicans under Nixon when they feared he'd be indicted. Thus, "you cannot indict a sitting president." Given that the section 3 of the 14th amendment isn't going to be followed the an insurrectionist cannot become an officer of the government, Trump will be sitting by Jan 20. So, even if indicted, his sentence, for all practical purposes would be shelved. Merchan is acknowledging this publicly. We'll see what the actual sentencing is. Could be fines and probation, just fines, community service, or nothing at all. If there is a probation or community service sentencing, then he and and his probation officer will meet monthly.

Reminds me of a scifi novel I read long ago. In the not too distant future the US 2nd Amendment allowed the sale of guns to anyone who wanted them by simply plugging a few coins into a vending machine as if they were buying a coke or candy bar. I do appreciate the difficulty of the position that the judge was in, but I believe that there were sentencing options that would have resulted in no jail time or impediment to the president-elect taking office. They would not have been what some wanted, but would have been a punishment to fully acknowledge that a crime had committed, that he was found guilty, and that he is not above being punished for criminal action as a felon.
At the same time, it plays hard into the two-tiered system of justice we have in this nation. The rich and influential view themselves as above the law, and this just ratifies that belief.
The sentencing is on Jan 10th. But he won't be sentenced to incarceration. That DOJ memo strikes again and stymies justice for all that it is to protect.

If the judge really is trying to show that justice can't be intimidated, then he has completely failed to hit that goal in the most miserable and pathetic manner possible.
The DOJ prevents sentencing due to a "guiding" memo crafted by Republicans under Nixon when they feared he'd be indicted. Thus, "you cannot indict a sitting president." Given that the section 3 of the 14th amendment isn't going to be followed the an insurrectionist cannot become an officer of the government, Trump will be sitting by Jan 20. So, even if indicted, his sentence, for all practical purposes would be shelved. Merchan is acknowledging this publicly. We'll see what the actual sentencing is. Could be fines and probation, just fines, community service, or nothing at all. If there is a probation or community service sentencing, then he and and his probation officer will meet monthly.

Reminds me of a scifi novel I read long ago. In the not too distant future the US 2nd Amendment allowed the sale of guns to anyone who wanted them by simply plugging a few coins into a vending machine as if they were buying a coke or candy bar.
