When you want to add seating to your restaurant and decide to use the public sidewalk, you accept what happens on a public sidewalk into your business.
It should not be too difficult to identify the assaulting employee. Danville, Calif Municipal Code, Section 5-9.4 requires a vending permit for sidewalk eateries. Part of the permit process requires the business to list all employees and individual personal info on ALL employees before the permit can be issued. Calls to the City of Danville may alert them to this outrageous display of ignorance and lack of respect from this business for citizens who pay taxes for that very sidewalk.
I sent the following email to the parent company: “I witnessed one of your servers physically assault a photographer who was peacefully recording on the public sidewalk at the Danville location. This photographer was exercising his 1st Amendment right to record in public and was “shooed” away by your manager, then assaulted and battered with a serving tray, by another staff member. I will never visit this location again. Your staff should understand that Civil Code Section 52.1, the Tom Bane Civil Rights Act, authorizes suit against anyone who by threats, intimidation, or coercion interferes with the exercise or enjoyment of rights secured by the state or federal Constitutions or laws without regard to whether the victim is a member of a protected class. Your parent company may be liable for this as well. This young photographer broke no laws, while your staff broke many. This behavior is abhorrent and should not be representative of your company. It seems like the person assaulting him with a tray was a customer, waiting in line to be seated, not a waiter. You can see him arriving at the restaurant, in the company with two older ladies, perhaps his moms, in the background in the beginning of the video 0:14.
@@Asa...SThey allowed it to happen. The company should have a better educated staff. When they tell their customers it’s ok, it’s legal, their responsibility is mitigated. In this case the manager is ruling up the patrons with his chatter.
A restaurant owner pushes you down the street saying get the F out of here , then tells his customers how he wants to beat the shit out of someone standing on a public sidewalk. If I was that customer I would tell him where to put his food and leave. Then an employee comes out and assaults you as his boss who wants to beat you up just watches. Looks like this business needs some more Yelp comments.
The Danville Police Department has been notified of this video with the coordinates and have been asked to have a talk with the big guy who works there who is ordering the young man to leave. Follow up on this to the police department is needed make your calls people
14:15 Go to the police and make them find out who that woman was based on the credit card they used. And have that employee placed under arrest for assault and battery plus aggravated harassment. Or find a lawyer that would like to make a couple of thousand dollars & sue that establishment.
