Hey Marcus, I don't want to bother you but I was just wondering what would happen if the vendor of a proepoerty lied to the disponee of an estate about the existence of an individual with propritary interest who was in actual ocupation of the land. So for example: V bought a house with monies contributed by C . C later moves in with V and goes on holiday for a month one year later. When C returns from holiday they discover that V had sold the house to D. When C questions D, the later said V had told him that nobody else lived in the house.

I just have one question, what is the difference between the doctrine of notice and the notice in this video for actual occupation? As in Kingsnorth v Tizard it mentions 'reasonable inspection' etc but we've been taught this with regard to the doctrine of notice, rather than registration. Thanks in advance!
hi Marcus, great lecture, I've got an essay question on "if 100% land registration will eradicate the complicating baggage of the historically complex land law in England" do you think that it would? I'm unsure because wouldn't that remove the social interest? Any help would be appriciated
Haha every time his last “bye......” amuses me a bit. I have a question for you Marcus and i hope you have time to answer or someone who is versed in this that can shed light. In USA, it seemed that they can directly title a property in the name of a trust “Marcus, trustee for XXX trust”, and i read some article saying there is not such a thing in UK. In UK, only legal estate can be registered, meaning the registered owners are always legal owners (or common law owners) and beneficiary owner like those under trust cannot be registered, exposing beneficiary owners at risks despite you have the that law (1981 case law). An article said a declaration of trust can be registered instead as a protection for beneficiary owners. Await your replied and comments.

would you say a person in jail awaiting trial who obviously has the intention to return to the house is in actual occupation? also does a person under 18 with equitable interest automatically become a legal owner when they turn 18/are of full age?

I have a question Sir, if a registered land is being transferred to a new buyer, wherein the current owner has granted a woman the right to pass on the grounds of the property to use as a short cut for the local train station, when the new buyer owns the property, is this new owner bound by the person's right to pass on the property as a short cut?

this was the issue in Chhokar v Chhokar 1984 but be aware this was a case that was pre Land Registration Act 2002

While beneficial owners themselves are not registered, the interests of beneficiaries can be (and often are).
