And it would be nice if we did not have to take people to hospitals out side of our jurisdiction, it's one thing if it is a emergency specialist facility and another if pop who stumped his toe might ve broke but not life threatening refuses local er because he doesn't like them but wants to go two counties over because some areas have laws states patient can go where he wants even if it takes the only ems ambulance out of a area is just stupid mismanagement of resources and bad use of a law.

To the men in the EMS VEHICLE, Although the speed in which you were traveling was extreme to say the least (I am not trying to justify that) you were both professional and very respectful. I applaud you both for that. NNH, Huge fan and subscriber commenting on your professionalism in every video you post. I believe you made an extremely valid point and applaud your diligence in keeping all public officals accountable. Please, keep up the phenomenal work.

I have been watching NNH for a few years and like what he does. That's not the issue here. By David speeding right along with this EMS truck at the same rate of speed (Excessive to say the least) for several miles, now increases the chances of a tragic accident even more. 2 X's as likely now. Good intentions gone wrong. IMHO.

Sevehn Syth - okay since you want to micro-manage this... lets say I agree they broke no "laws" they sure broke "policy" then right, or do you disagree there are policies outlining speeds and procedures emergency vehicles are to use inside and outside of emergencies? BUT if we look at texas laws, we can see that they DID break laws, because they are only "exempt" under certain conditions, such as responding to an emergency call, the law however is not carte blanche for any scenario, they in fact do need to follow laws when returning back to the station, thats the part most folks don't seem to understand, emergency response vehicles are not exempt under all scenarios... they do in fact have to exercise due care when traveling in either scenario, and in this case, speeding excessively passing vehicles while not in an emergency is NOT covered by texas law... I know, you thought this was going to be an easy win for you, turns out you lost...
      www.statutes.legis.state.tx.us/Docs/TN/htm/TN.546.htm
read the whole thing, let it soak in, in order to be under color of law, they must operate under the exempt conditions such as lights and/or sirens for an emergency... absent that they are violating the permissible uses which means they are in fact violating the law... "exempt status" does not mean exempt from laws, it means exempt when the permissible uses are met, sometimes its for minor things like being able to park in a no parking spot while out on a call, sometimes its for being in front of a fire hydrant for the same reason, but police can't whizz around absent the emergency conditions, and the warning devices present and deployed to alert drivers... failure to do so turns them into any other vehicle on the road not under exempt conditions... same reason they should be buckling up outside those scenarios too, but we see so many drive around without them all the time declaring "just in case" right...
thanks for learning something today, hopefully you did... in case you didn't I'll add a little more direct citation for you below from the above link in case you hate reading and dislike being challenged or think you interpreted something to mean something it does not... its quite clear and I don't think anyone can argue the below... excessive speeding is hardly "appropriate regard for the safety of all persons" they are speeding past, its just guys so used to getting away with speeding they want to get back to the station and play some cards... (nor is it safe for them, and they are included in "all persons")
Sec. 546.005. DUTY OF CARE. This chapter does not relieve the operator of an authorized emergency vehicle from:
      (1) the duty to operate the vehicle with appropriate regard for the safety of all persons; or (2) the consequences of reckless disregard for the safety of others.

Sevehn Syth - I think you missed the critical thinking question... is an ambulance with no purpose doing 80+ in a 60 safer than an ambulance doing 60 in a 60... thats what the question and point is, they are unnecessarily taking risks, aka reckless driving, with no purpose other than to get back to the station to sit around...
its not a matter of do they specifically mention emergency vs non-emergency, the law doesn't need to in order to compel them to follow it, as its worded, there are instances where permitted use is extended further than normal, but absent those circumstances the reigns are pulled back and applicable road laws apply...
this is not a "subject to local laws" scenario, its clearly spelled out in state laws, local laws can't supersede state laws, they can place additional restrictions where state laws do not block it, but they can't remove state laws and replace it with local laws... thats the problem you seem to be struggling with as you've cited NO "local laws" in any county that would ever permit the state laws to be bypassed, you know why, because they can't which is why you simply won't find any local laws in texas to permit speeding for a non-emergency return back to the station to sit around and shoot the shit...
P.S. bonus round, whats the leading killer of ambulance drivers... excessive speed... they can defy laws with lights and sirens, but they can't beat physics, physics always wins... same reason I crack down on officers without seat belts and their paranoia they will be harmed to a second delay taking a belt off, I sure won't cut any slack to ambulance drivers for speed or seat belts... do you know how much it costs tax payers on average when one of them dies to stupidity like this, roughly a million dollars a head when you add up all the expenses of paying off spouses, medical and funeral expenses, and replacing that employees estimated time left with a whole new set of salaries and benefits for the next guy... so don't think this is of genuine concern for his safety, its for my wallet and taxes... thats the brutal truth...

    • @grumpyoldman3597
      @grumpyoldman3597 6 років тому +1

Sevehn Syth - you're approaching the question and legalities from a biased standpoint based on trade magazines and what your peers tell you is fact, every professional suffers from that tunnel vision, including attorneys... when we step back and I pointed out the question should not be whether an emergency vehicle travel at 80 with lights on or off was wrong and the real question should be is 80 or 60 safer, you seem to have spun into the typical deflect and pivot response I see from anyone who didn't think it through as is simply hashing up common talking points among peers... thats why I pointed it out...
I get it, you have 24 years of experience, you also have 24 years of bias from peers, which is why you should acknowledge that yes a vehicle traveling at 60 is safer than a vehicle traveling at 80+ whether it has lights on or not... its also why I pointed out the leading killer of ambulance drivers being speed, now that is a general point comprised of many parts including speed from emergency responses, speed from slowing down to intersections or not, speed from coming back after a run without any emergency lights at all, yes, accidents do happen related to speed even after the fact, which is why its the leading killer of ambulance drivers... thats why its high for officers, its why even firefighters are now being made to wear seat belts, especially in some engines that came without them prior to changes and thoughts on the subject years ago, showing that extra second to unlatch made little to no difference in outcome... hence why I assume you pointed out your example of outcome not being impacted greatly in certain response times...
the law is pretty black and white, there does not need in texas to be a local rule, because the state laws supersede any such local ordinance that would permit speeding back after a run, which is why you will NEVER find a city with such an ordinance outlining that its okay or lawful to speed back just to go sit around... the laws sometimes seem vague and subjective, what I cited was not, it quite clearly drew a line in the sand over exempt status not being carte blanche and does in fact apply to emergency responders after the fact...
the only reason you don't see this pressed more often is because its rare for an officer to pull over a speeding ambulance, and you would be even more hard pressed to find a prosecutor willing to take THAT case even if its deserved... its one of those "swept under the rug" incidents handled internally, where a department might send a message over to the chief of the other and say hey tell your guys to slow down we're getting complaints and we can only do so much before we HAVE to make an example"... thats the cold hard reality of this, which is why I am such an advocate for cameras, because you simply can't sweep them all under the rugs and protect each other, the walls of protection are coming down every day and soon government employees will have to be just as accountable as the citizens, or the citizens will revolt and punish them either monetarily or demand swift and harsh correction to those who do violate...
but I get it, the myth for generations has been exempt means exempt from all, thats never been true, its just rarely tested and prosecuted... the good ole boys club...

    • @grumpyoldman3597
      @grumpyoldman3597 6 років тому +1

Sevehn Syth - you basically are proving my point, but you seem to keep arguing it... your own city attorney confirmed it, there "may" but not carte blanche... like I said, there is no justification to excessive speeding, which at those speeds is reckless driving, just to get back to the station to sit around and play cards or to punch out...
give me the name/number of who you spoke with in the office so I can call to see just how different a response I will get calling from a law firm and ask for his position in writing on this... I suspect like many times we will see just how different the internal and external communications are on matters like this, which is also my point...
like I said... you'd be hard pressed to find an officer willing to pull you over, and even harder pressed to find a prosecutor willing to convict you... the city attorney is paid to find excuses and subjective interpretations, civil attorneys are paid to enforce actual law... law is law, the city attorney is paid to protect the city, not punish it... bias...
P.S. just to extend this a little, how can we have videos of officers pulled over in marked vehicles for speeding in other counties if there "may" be valid reasons for speeding, yet every time we get a video like that, its never a good reason, because if it were a good reason, it would be lights and sirens or they would have to exercise all that care in following laws for non-emergencies... ;)

So a 20 year old speeding, was worth you speeding behind him, now you want to educate the Utube viewers in quatitative methods conveying shallow stats relative to pickup truck/EMS vehicles? You are an enabeller, next time write a citation, or take him to jail for reckless driving, then answere stacked 911 calls on your MDT ( mobile data terminal) , but your utilizing city government time & property for personal gain, derelecting your official duty as a peace officer/public servant, now you want the public ,at large, to understand your oxymoronic absurdities? Do you realize you're building a case against yourself, at the same time advertising your IQ to your colleagues, viewers, these kids, plus you set yourself & the city up, for a federal law suit, by using offical city property to slander, deliberately create physical & mental duress on these youngsters, by putting this on social media? Additionally, the traffickers are all going to utilize bogus vehicles like this , to toy with you, while they traffic their commodities via your jurisdiction, maybe you heard of it ? It's called "COUNTER-INTELLIGENCE".

Why do you make these pointless videos. And why do you feel the need to harass public servants. I am a public servant and most of my friends are too, and we all know the dangers of speeding because we have seen it first hand. Being a paramedic you have to drive well above the speed limit quite regularly, it just becomes second nature. And in small towns like La Porte and Deer Park that late at night, you are not putting a very big risk on the public. Trust me I'm from Deer Park, and 146 at that time of night has extremely low traffic

    They had 2 simple options:
    1)do the speed limit
    2)use the emergency lights
Using lights would still be an abuse of the emergency lights but the citizens would have been a little safer.
Only decent part was that they provided names , but I got the impression they weren’t worried about any repercussions for their dangerous actions.

I'm in rural EMS. The journalist probably doesn't know all the facts. The hospitals we transport to are in a different county and we are the only on duty crew. So we actually do speed to get back in the county to wait for more calls.
That and we just enjoy speeding too. If we driving well above the speed limit a cop won't pull us over but will actually contact our boss the next day

They flat out do not care. I am also a driver for a rescue squad and this is a violation of the qualified privilege the all emergency personnel have and can be ticketed for it but you see the thin blue line is extended to the thin red line. While there have been a few instances of police holding fire and emergency personnel accountable it is frowned on. These guys WILL be in trouble with their Chief and will probably be suspended. If more people do as you do David there might be change. You are making a difference!! Check this out I on way to work one morning and this Maryland State Trooper went around me at a red light and went into the gas station with his emergency lights on then turned them off. I was going to that gas station anyway and thought there was a silent alarm. Turns out he was just going to get his car washed. The look on his face when I asked if that was the proper use of his qualified privilege? All I got was a blank stare!!!!

A couple weeks I had an aid car come up behind me as I was doing 30 mph in a 30 mph zone. I estimate they were doing 50 mph. They were returning to the station after a run to the hospital.
So, I went to the station and called them out.
I hate that these "Public Servants" drive so aggressively. They are a hazard to us and themselves.

Deputies and police officers here in Escambia County Florida/Pensacola seem to think traffic laws don’t apply to them either. That’s a huge pet peeve of mine. Got a ticket for honking my horn at speeding deputy Matthew Housam on his way to work a few months back. That same deputy was just involved in an accident with injuries last week. He was running with lights and siren this time but didn’t even make an attempt to slow down at the intersection to give other drivers a chance to react according to witnesses.

What are you talkin bout bro. In Texas we add 20 to the speed limit sign. Standard Texas procedure is to drive 20 over until you end up behind someone who isnt. You then proceed to ride ass until they are

You can tell this isn't in CA...everyone would be doing 80...and nobody would use a blinker to change lanes.

And what's the dept policy on travel speeds when returning from calls?

Dang David, find I hate to see you get these guys raked over the coals. The response from them we see so often is to go after the person trying to hold them accountable put you in jail. Considering they didn't do that, and they were polite and courteous, these might be the best to cops in the state of Texas.

Just like they have a citizen arrest law, they should make citizen speeding tickets where citizens can issue a speeding ticket to a cop... and while they're at it, throw in parking tickets as well.

Hi David, if you broadcast your own speed does that not give the police evidence to prosecute you as well? You did it in a good cause but I doubt the court will excuse that.

    Very cordial encounter.
Just managed to watch the Washington video before it went to UA-cam gaol. Lol.
The thug wanted to speak but didn’t want to listen. He’d have been curled up crying on the floor if he’d have had that attitude with some of the more vociferous auditors. Lol.

See we post in areas at times out from our main stations specially when high call volumes areas to reduce response time. You rather have a medic asap even when it's a ten to fifteen minute response. Some ems dept post units to reduce that time and if a on coming crew needs vehicle I can see it happening but if they where just hauling but to get off that is wrong.
