The second game is no doubt a ripoff. The first game basically was more of a copyright swap out if anything. And considering how Nintendo HATES fan games, making a serial numbers filed off version of a fan game should have been a nice way to get something out of all that work.
That first kickstarter feels like the developer had no clear direction for that project. It seemed like he wanted to do more with the crossover idea instead of just changing the assets and calling it the day.
Kickstarter really needs to abandon that Project We Love program. Aside from the fact that the platform should be neutral and not biasing projects with the endorsement, it's ended up being attached to so many scummy projects that have ripped people off. They really have terrible judgement.
The rainbow-colored "2" symbol is the logo for one of the biggest TV-channels here in Norway (TV2), by the way. Really weird to see it being used as an actual number.
Dalas is a UA-camr that a lot of people dislike in the spanish speaking side of the internet. And, he is trying to make a sequel to that game (Fur Fun 2). (i think there is an update on the game, but I don’t remember where)

Dallas did not send copyright claim to Jim Sterling for 2 reasons, likely: 1) Jim has legal representatives and at this point little patience with BS copyright claims. 2) Dallas normally runs away from trouble instead of facing responsibilities, that or he sends his legion of followers to harass critics and "enemies".
The reality is that 95% of the time the ideas were already rejected by private investors because they aren't logistically and/or financially viable or they are outright scams. Still, Solar Freakin' Roadways right lol. It's a shame though as there are talented engineers, designers, developers out there that present a fully realised project with lots of supporting data but fail to get backing because it is considered to be boring by the easily led masses.
Mighty No 9 eh? Still waiting for the portable versions that, as far as I'm aware, were never officially canceled 😣 I think it was even advertised as cross-buy with the Vita version right on the PS4 physical release box

Unsure if you have heard of the game but "Limbo of the Lost" is an old adventure game entirely made of stolen assets, music, etc. It came out in the late 1990s or early 2000s and had entire forums attempting to track down all of its stolen assets.
Could've been Sterling's experience with Digital Homicide that left him out of the copyright strikes ? Can't recall the timeline off the top of my head...

Didn't stop the two from teaming up and having a Gal Gun Angel in their multiversional mix-up too in Mighty Gunvolt. I didn't enjoy it all that much though. Playing Gunvolt without his trademark Electrosphere feels off.
Mario Crossover was one of those games where I'd play Link just to see how funny it would be, but by the 2nd world it had already worn out its novelty.
Wonder what happened to that "Enchanted Portals" game. Last I heard some Chinese company funded the project and then it just kinda dropped off the radar, iirc. Call it a ripoff or not, I wouldn't mind me some more Cuphead-like goodness if it's done well.

Fun thing about the house thing with Super Retro Squad, it's actually real, sort of. One of the earlier updates us backers got was about how they had bought a house where the dev team would work and live in. The question there was whether the money from the KS was used in the purchase of that house or not (and what's the difference anyways because it's still them buying a house after running a kickstarter).
it makes plenty difference actually, if he bought it for himself, yeah that'd be a bit fucked BUT, if it WAS where the devs would work and live in, then it's contributing towards the work environment, where in person things would be easier to update and change
It's been 9 years since I wasted $15 on Super Retro Squad!? At least it was only $15. And honestly, I kinda felt bad for them, dude was clearly not cut out to take on a project that big, but I feel worse for people who put up big money for the project. But fortunately, it's the only project I think I've ever gotten burned on.
You’re lucky. I was also burned on a Kickstarter for a board game, and that and Super Retro Squad both were my first ones. Didn’t return to the site for years after those didn’t deliver.
I thought about making a game one day. I started it, just to see if I could figure it out. Wasn't complicated, it was a Mario Bros ripoff but using GB Studio so it'd be a Game Boy game. The difference is, it was more of a "for fun" kinda thing, and not something I intended to sell. If I ever finish it, I'd probably post it on reddit or discord or something, and be like "here, if anyone wants to give it a try, be my guest."
I don't know why crowd funding in its current form is legal. I mean Jay and Kickstarter essentially commited fraud. It honestly does look like he was bewildered by the concept of creating original characters. But its hard to see that video and imagine giving him money. Also Mighty Number Nine deserves all its hate.
As someone who lives in California, I can say for a fact that $50,000 did not buy them a house. You might be able to buy a toolshed in the California desert for 50k, but that's as close as you'll get for that kinda dough. You can buy a crappy house for ten times that much, but 50k does nothing for houses in California. And the Kickstarter said Sacramento, which is our capitol. No 50k desert shacks there.
The first one is pretty obvious maybe, but I don't think the second one really is truly a "rip-off" because to say it would be would be like saying Banjo is a rip-off of Mario, or that basically any major great game is when we bring up a character design slightly looking similar to another. The game itself doesn't look very great, but to act it being a unique "rip-off" as a bad thing just because of 'creative' similarities is like saying so many other spiritual successor games are. Genshin Impact drama all over again basically. I am aware of the asset part by the way, but I'm mainly talking about the original content part having 'similar' styles here and there.
Sabre Rider and the Star Sheriffs is another big rip off. Project starter claimed they owned the rights to the original cartoon IP to make a game off of for modern and retro platforms and the project is currently 4 years pass its estimated delivery date, with the project lead going completely silent on all platforms since then with no updates. More Minor, but projects that promised rewards that failed to deliver: -Regalia - Of Men And Monarchs = promised a physical DRM-Free version to backers; distributed Steam installation disc instead. -The Bards Tale 4 = promised a physical DRM-Free version to backers; distributed Steam installation disc instead. -Tower 57 = promised a physical DRM-Free version to backers; claimed after the game was released that they could not afford to manufacture the physical versions -Rad Rodgers = similar to the above three, but significantly more dickish. Promised a big box classic PC edition with DRM-free physical copy of the game. They did release the big box edition, but instead of the game disc, they included a soundtrack instead with a small note inside saying that because backers were already getting a digital copy, they decided to include a music CD instead, never giving any prior notice of this to backers on the project page and completely missing the point of why backers would have selected this tier for a physical copy (this was still well before the day where indie games were getting frequent physical releases and Kickstarter projects was one of the only source for them). Backers rightfully started a stink about this after getting the boxes, they promised that they will produce physical copies now for them, resulting in months of silence, people kept asking about this, finally said they would have something to announce on them "soon", no updates months after that, the game ends up being purchased out by THQNordic I believe, all messages to them about the project says they are not responsible to fulfill rewards and no updates from the original Kickstarter people who I am sure are not even around anymore.

That Super Retro Squad or whatever the hell it's called now story reminded me way too much of an indie RPG campaign that I backed back in 2011. The developer keeps starting over and announcing that he's got a new engine or a new idea or the game's going to be SO MUCH BETTER now - and get this, he now says he's planning TEN GAMES even though the ONE game he ran the campaign for still hasn't been released.

The big difference between that first game and DNF is that DNF was constantly getting revised or flat out remade because George Broussard was constantly striving to incorporate things from new games into DNF to make it DNF relevant in whatever gaming landscape was at the time. That at least makes a little sense because he wanted to make a current feeling game. On the other hand the Kickstarter game was a retro game, it didn’t need to incorporate as much because the nature of the game meant there was no need for the bells and whistles current games need.
Its still likely an issue of extreme feature creep, though, an issue that plagues many projects. Its why the predevelopment phase is so important but its one that many people (especially amateurs) don't give enough time to.
I mean, I assume you're gonna mention this but Cuphead is just mining the visual style of 30s animations. Doing that for your game isn't necessarily ripping off Cuphead any more than using ukiyo-e style visuals would be ripping off Okami and the like.
They had a unique version of that style, like it or not. They put a lot of effort into it, and when someone copies it so blatantly, your defense only makes you look like a bought review or comment. Seriously, 2 characters using finger or hand guns to fire at a cartoon stylized boss who has the same general face design as the lady from the theater section stage... it's not just being of a similar art style at that point.
Didn't Jay Pavlina start working on Super Mario Bros Crossover 4.0 back in late 2018/early 2019? It wasn't based on the Flash version, it was rebuilt from the ground up for Unity Web as Jay needed a platforming engine for Glitch Strikers. It was a barebones preview build and I don't know what happened to it. Jay and Exploding Rabbit's Twitter are inactive since April 2019. Jay Pavlina is such an enigma. I think he even wanted to make Hyper Manni Crossover which would have been a reskinned version of SMB Crossover, but never went far and the Exploding Rabbit Discord server is pretty much gone
i had no idea Mario Crossover was even getting updates by 2013, much less that the maker of it would be Changing the Situations & not adapting to them "he didn't sue Jim Sterling for some reason" Lawyers, & the fact that Jim will make seven more videos calling your bullshit, so yeah you're not cen soring them & that is pretty well known
I'm surprised it took you this long to mention Super Retro Squad on here. All Jay had to do was reskin Super Mario Crossover and make new levels. I mean, yea.. sure.. probably porting code over to Unity would be a thing, but still. And heck, reskinning SMBC was already a thing at the time. So was making levels since he added the Lost Levels, and later those from another game I can't recall right now. Instead, he bought a house, flew his team down there to live with him (except one guy), and then decided to change course for whatever reason. That is to say, instead of going with the original plan.. he suddenly decided he wanted more instead. Terrible idea, unless it was planned before the project even launched.. which it wasn't. And after the project essentially failed, he threw his team under the bus instead of owning up to it.. a post that I believe was removed after he got called out for doing so. I loved SMBC and made a few skins.. a couple of which actually got added. Backed Super Retro Squad too, but still. Never asked for a refund, which a lot of people said was also a thing. I figured instead of going through that, he could keep my backing as a sort of 'thank you' for SMBC or whatever.
I remember when Jay announced they were upgrading to a 16-bit visual style mid-development. I knew at that point they weren't gonna be able to finish the game as planned. To this day, it's still baffling to me that he seemed to think the leap from 8-bit to 16-bit pixel art was something you could just do on the fly and not have to worry about the ramifications. I was also really disappointed in that eventual Glitch Strikers promo video he put out. It was always obvious that the Retro Squad characters were heavily inspired by their Super Mario Crossover counterparts, but I had naively assumed that he would just be using the original games as starting-off points for original characters with unique playstyles and mechanics that would feel new, but still distinctly retro. As an example, Freedom Planet is a very obvious homage to Classic Sonic, but is still very unique. Even directly aping the original Crossover games would be okay if it didn't look so uninspired.
The asset issue in these games is interesting, my kids play Rec Room and Roblox (poor them), I am stunned these games get a by with their blanket IP rip offs
Mighty No. 9 gets more hate than it deserves? No, it deserves every ounce of hate it gets, it seriously underdelivered what was promised, it has some bugs that should never have gotten past QA (if there was any at all) and said bugs were rarely ever fixed, it's the Aliens: Colonial Marines of side-scrollers.

Genshin Impact drama all over again basically.
I am aware of the asset part by the way, but I'm mainly talking about the original content part having 'similar' styles here and there.
Sabre Rider and the Star Sheriffs is another big rip off. Project starter claimed they owned the rights to the original cartoon IP to make a game off of for modern and retro platforms and the project is currently 4 years pass its estimated delivery date, with the project lead going completely silent on all platforms since then with no updates.
More Minor, but projects that promised rewards that failed to deliver:
-Regalia - Of Men And Monarchs = promised a physical DRM-Free version to backers; distributed Steam installation disc instead.
-The Bards Tale 4 = promised a physical DRM-Free version to backers; distributed Steam installation disc instead.
-Tower 57 = promised a physical DRM-Free version to backers; claimed after the game was released that they could not afford to manufacture the physical versions
-Rad Rodgers = similar to the above three, but significantly more dickish. Promised a big box classic PC edition with DRM-free physical copy of the game. They did release the big box edition, but instead of the game disc, they included a soundtrack instead with a small note inside saying that because backers were already getting a digital copy, they decided to include a music CD instead, never giving any prior notice of this to backers on the project page and completely missing the point of why backers would have selected this tier for a physical copy (this was still well before the day where indie games were getting frequent physical releases and Kickstarter projects was one of the only source for them). Backers rightfully started a stink about this after getting the boxes, they promised that they will produce physical copies now for them, resulting in months of silence, people kept asking about this, finally said they would have something to announce on them "soon", no updates months after that, the game ends up being purchased out by THQNordic I believe, all messages to them about the project says they are not responsible to fulfill rewards and no updates from the original Kickstarter people who I am sure are not even around anymore.

That Super Retro Squad or whatever the hell it's called now story reminded me way too much of an indie RPG campaign that I backed back in 2011. The developer keeps starting over and announcing that he's got a new engine or a new idea or the game's going to be SO MUCH BETTER now - and get this, he now says he's planning TEN GAMES even though the ONE game he ran the campaign for still hasn't been released.

The big difference between that first game and DNF is that DNF was constantly getting revised or flat out remade because George Broussard was constantly striving to incorporate things from new games into DNF to make it DNF relevant in whatever gaming landscape was at the time. That at least makes a little sense because he wanted to make a current feeling game. On the other hand the Kickstarter game was a retro game, it didn’t need to incorporate as much because the nature of the game meant there was no need for the bells and whistles current games need.
Its still likely an issue of extreme feature creep, though, an issue that plagues many projects. Its why the predevelopment phase is so important but its one that many people (especially amateurs) don't give enough time to.

I mean, I assume you're gonna mention this but Cuphead is just mining the visual style of 30s animations. Doing that for your game isn't necessarily ripping off Cuphead any more than using ukiyo-e style visuals would be ripping off Okami and the like.
They had a unique version of that style, like it or not. They put a lot of effort into it, and when someone copies it so blatantly, your defense only makes you look like a bought review or comment. Seriously, 2 characters using finger or hand guns to fire at a cartoon stylized boss who has the same general face design as the lady from the theater section stage... it's not just being of a similar art style at that point.

Didn't Jay Pavlina start working on Super Mario Bros Crossover 4.0 back in late 2018/early 2019? It wasn't based on the Flash version, it was rebuilt from the ground up for Unity Web as Jay needed a platforming engine for Glitch Strikers. It was a barebones preview build and I don't know what happened to it. Jay and Exploding Rabbit's Twitter are inactive since April 2019.
Jay Pavlina is such an enigma. I think he even wanted to make Hyper Manni Crossover which would have been a reskinned version of SMB Crossover, but never went far and the Exploding Rabbit Discord server is pretty much gone
i had no idea Mario Crossover was even getting updates by 2013, much less that the maker of it would be Changing the Situations & not adapting to them

I'm surprised it took you this long to mention Super Retro Squad on here.
All Jay had to do was reskin Super Mario Crossover and make new levels. I mean, yea.. sure.. probably porting code over to Unity would be a thing, but still. And heck, reskinning SMBC was already a thing at the time. So was making levels since he added the Lost Levels, and later those from another game I can't recall right now.
Instead, he bought a house, flew his team down there to live with him (except one guy), and then decided to change course for whatever reason. That is to say, instead of going with the original plan.. he suddenly decided he wanted more instead. Terrible idea, unless it was planned before the project even launched.. which it wasn't. And after the project essentially failed, he threw his team under the bus instead of owning up to it.. a post that I believe was removed after he got called out for doing so.
I loved SMBC and made a few skins.. a couple of which actually got added. Backed Super Retro Squad too, but still. Never asked for a refund, which a lot of people said was also a thing. I figured instead of going through that, he could keep my backing as a sort of 'thank you' for SMBC or whatever.
I remember when Jay announced they were upgrading to a 16-bit visual style mid-development. I knew at that point they weren't gonna be able to finish the game as planned. To this day, it's still baffling to me that he seemed to think the leap from 8-bit to 16-bit pixel art was something you could just do on the fly and not have to worry about the ramifications.
I was also really disappointed in that eventual Glitch Strikers promo video he put out. It was always obvious that the Retro Squad characters were heavily inspired by their Super Mario Crossover counterparts, but I had naively assumed that he would just be using the original games as starting-off points for original characters with unique playstyles and mechanics that would feel new, but still distinctly retro. As an example, Freedom Planet is a very obvious homage to Classic Sonic, but is still very unique. Even directly aping the original Crossover games would be okay if it didn't look so uninspired.

The asset issue in these games is interesting, my kids play Rec Room and Roblox (poor them), I am stunned these games get a by with their blanket IP rip offs
Mighty No. 9 gets more hate than it deserves? No, it deserves every ounce of hate it gets, it seriously underdelivered what was promised, it has some bugs that should never have gotten past QA (if there was any at all) and said bugs were rarely ever fixed, it's the Aliens: Colonial Marines of side-scrollers.
