Lead-Based Paint Issues are no joke!
Because nothing rectifies the risk of lead based paint quite as well as thousands of dollars in fines made payable to the EPA over mistakes on a disclosure
Nothing in real estate scares me except lead-paint issues...
I have never understood why this disclosure wants a check mark and not initials. Anyone can put a check mark. Initials seems to me to be more of a CYA..
I totally agree... However, the EPA Auditors have the latitude to make those independent decisions. Some accept initials and others I've seen them issue Notice of Violations... Gotta love government. Thank you, Glenda for commenting!
I have a situation where there r 3 rental properties, that have not been tested for lead paint, is there anyway to have the lead test paint test done with the renters on the premises? The lady who is overseeing the properties right now has dementia, her son lives in another country and has been trying to help out, via e-mail, I have been asked to step in as the property manager, my fear is, the lady with dementia does not have or can’t find the lease agreement, I know I need to be in compliance with lead pain disclosure, What should I do at this point? Thank you
Well, there are a lot of moving parts to this. Does your state have it's own lead-based paint rules & regs? If yes, you will need to follow theres too. If not, the federal rules must be followed. So (1) why does the properties need to be tested. There are no federal rules requiring testing. (2) If the owner has dementia, she can't legally enter into a management contract with you so I would ask her son if there is an attorney in fact for her. They would be the one that can sign the management contract. (3) I would do no work as a manager until someone other than the lady overseeing the property can legally sign the management contract.
