I am surprised to hear the argument that ‘Constitution does not disallow a person from remaining a Chief Minister even when he has been charged and taken into custody’. This argument is being said in all news channels.
I don’t think our makers of our constitution even thought such a situation would arise, in the first place. When constitution was framed it was common for people holding constitution to resign voluntarily. When I was studying in 1970s and 1980s, it was quite common to read in newspapers about ministers resigning voluntarily moment cases were filed against them. They would come back to power only after charges were cleared.
But now we are in a time when questions asked are ‘Where does it say, in constitution, you can’t run Chief Minister’s office from behind bars?’. Or , ‘Nothing has been proved in courts yet’.
I don’t think our constitution makers thought our leaders will be, one day, so morally bankrupt.
Our Constitution makers didn't think that one day an organisation like ED would come to existence which would have unlimited powers to arrest anyone but have a conviction rate of less than 0.5%. If they were present today, they would have told to fund such political agency (ED) from BJP's electoral bond money obtained by extortion instead of being funded from taxpayer money
Constitution does not anticipate future. If so they would have written that India/Bharat should not be secular but a Hindu state but liberal. Even the princes or kings or Jamindar of India did join India without any knowledge of India to be secular.Government cheated them(specially congress) these rulers and amalgamated into Indian union by Patel. Otherwise they would not have agreed to join except one State. CM in jail means the state is in jail. So they cannot have freedom like others.

Just came across this video. Barkha, do you really need to interview Ashutosh. We all know what he will say. Making a party, running a govt and that too successfully while being with all the other pigs in the dirtiest mud you can think of was only possible via Kejriwal. Comparing Modi with Kejriwal is pointless and baseless. There is no evidence to suggest that Mr. Modi has ever been shattered or irritated by a defeat. He remains calm and composed under any kind of pressure, making him one of the most level-headed politicians I have ever witnessed. This is undoubtedly one of the reasons why he consistently emerges victorious.
Furthermore, I find it perplexing that Mr. Ashutosh speaks so highly of Mr. Kejriwal's intelligence. Kejriwal himself has not achieved much on his own. He used Anna Hazare as a means to achieve his own hidden agenda of attaining power.
Lastly, as an IRS officer, the way Kejriwal has governed Delhi speaks volumes about his incompetence in administration. It is evident that he lacks the necessary skills to effectively run the government.

Absolutely right, we are no one to decide whether someone is chor or not, but if someone is being put in the jail by court, no one say that democracy is in khatra..When the court decides against govt, it's good, but if against the opposition then all of a sudden democracy starts crippling.
In a way, the opposition is putting pressure on the courts, to just give verdicts in their favour.

When I said Chor, I was not putting a verdict on this case, but just giving a logic, that if some one is sent to jail, it's not right to cry that democracy doesn't prevail..
There are people in different parties, who have been acquitted on cases & all of them took legal fight in a legal way, may be Modi, Advani, or even Rahul in National herald case.
Just think if Lalu when investigated would have cried foul about democracy & case would hv been withdrawn, his wrong doings would hv never come to light.

I myself was a person who had lot of faith in AAP, but every passing time, now I am sure they are also a regular political party & nothing different, with lot of hypocrisy coming to light, from dragging his own kids to swear to , Seeshmahal from 1 BHK Gyan, and a new low of not resigning even when sent in custody by the court. Resign, come clean & then again become a CM or even a PM, but not like this.

Legal system is such that more than 70% prisoners are undertrials. And in liquor scam, trial never even started. Journalist of Ashutosh's caliber will do good to the society if he remains independent and give the right perspective. I don't mind if he is a BJP/ Modi critic but he must do so with facts and without distortion. People will take him seriously then. At least people like me who is neither black nor white but somewhere in the grey area.

Ashutosh is right about something like boycott of elections is a way, there is very less point in going to polls in these type of biased circumstances. They need highest guts, best coordination and all out efforts to get out of this crisis

Good to see Ashutosh accepting lot of things. Only 1 thing what he didn't say , he has worked closely with AK so he can claim to know him, but he has not worked as closely with Modi, so he may be wrong this time as well..
