If you don't give the company in question the opportunity to come back and fix the mistake, and you just go on and fix this yourself then you have to pay them
Great content as always. It is easy for a lay person to say yeah the contractor should not be paid, as we are just looking in on your life per-say. But I do think it is right that they the contractor you have employed in carrying out this job to your high specifications, should feel your pain of having to redo their, what appears to be a blatant disregard for your high standards. I guess it consequences isn’t it. The consequence for failing to follow or work to your high standards, which I'm sure they will be fully aware. As I guess the contract you may have written with them will highlight what is expected of them and their workmanship. I hope find a resolve, keep on posting.

Daniel your business comes first no matter what no one should tell you your to busy that it's the reason your not informed. It' takes years to build and it takes seconds to destroy to be informed it's part of the same business that in the first place kept you busy if your informed the problem would have be solved right there without customer knowing something was wrong
I work in steel construction, if one of our subcontractors knowingly do substandard work and it cause issues for us with our end user the contractor bears the costs, mistakes are understandable and we work with our sub contractors when those happen but poor workmanship is not tolerated and if the subcontractos value the business we send their way they have a responsibilty to ensure the work they do is up to standard.

As a sub contractor they should be responsible and Asheville shouldn’t have to pick up the cost. However that said if it’s a long term subcontractor then I think it’s good to sit down talk through together and decide how it’s best to overcome.

I used to work for a company called Higgs and Hill and we were forced to use their plant hire subsidiary called Gazeway at higher costs than other plant hire companies.
You should pay the man for days work. Talk with your staff about project management and then pay the fix. The guy worked for a week before the cliënt saw it. Instead of your staff calling him out on day 1. This is where you budget margin on the subcontractor and use this for this situationeel exactly. Thank the man and don't call him again.
It is the sub-contractors fault, their know your standards and have not abided by them. It will be a lesson for them to ensure that their standards are better than expected.They should be counter charged for the repair work and if they want to continue working for Ashville, they would have to put extra management in, to control their quality of work with further work documented with before, during and after pictures until they have gained back any trust. In hindsight it would make me worry about any work that they have done at this site and any other previous works.
Ref the poor standard work: I'd day they get paid for their time (minimum wage) but not the work itself. Is it the fault of the lower-end labourer that the job was naff if he/she was just following the governors instructions? I'd say not. I'd say to change the contractor, and ask them to pay compensation to you or the client. Equally lessons for you here too; monitoring and quality control process needs to be better :-)
I think Danial is amazing and deserves all the success he has but the working hours input he expects from his staff would not be allowed here in Sweden where we have a very strong Trade Union organisation and culture. All working hours are regulted and agreed upon by both the blue color, white color and even the many branch organisations own unions. It is written into law in Sweden that the representatives from BOTH sides have as an ultimate goal to come to a joint agreement. Work condition and working hours are als covered in the Work Safety Laws. Note the word LAWS. How often does one here of large disruptive strikes and conflicts in Sweden?
Pay then based on the contract you have with the sub. If they haven’t delivered what you asked them for then they don’t need to be paid. Secondly, cut them off. No more work for them and make sure your other subs know you’re prepared to take those steps in the future. It’s maybe ok for a sun to make one mistake/misinterpretation but if they someone thing they wouldn’t have had you been stood there watching they’re just mugging you off.
You should NOT pay the sub-contractor. They didn't do the job you hired them to do. You wanted a proper job, they gave a bodge job. If they did the work pay them, but they did not, so don't. EDIT: I'd even take THEM to a small claims court to recoup the money YOU had to spend to rectify it.
