This is what charitable organizations are like when you look beneath the surface. A similar case was exposed in Japan about a year ago, and people have started to be suspicious of NPOs and those who solicit donations.
happy to hear this from Japan, but sir, this is the simple case of all charities worldwide. i defy you to find me a single global charity that handles money in the millions that does not have an entire board of executives living ln luxury.
So I've actually been to Kenya. You know those charities that people donate clothes too? Yeah these charities RESELL those clothes and I've seen it. I also have distant relatives who still live there that tell me the same thing. Oxfam and the like are good business and those donations tend to go in the pocket of the CEOs. If you're going to donate to a charity; be vary wary of what they do with the money and do some research.
It's why I don't donate to charities anymore. I used to donate a fair amount of money before, but found out it was basically just being pocketed under the name of administration fees.
I'm actually curious how organisations like Red Cross are able to function while they are complete scams. Worst part is that they operate on government support!
The worst part is that I honestly liked the completionist's videos. Especially the one where they bought all wii u and 3ds games. At first I didn't think he was evil because he had all the money. Its not like he spent it on himself. He was just an idiot and never actually donated, not malicious. But then, he started threatening legal action against the people that exposed his idiocy and my opinion of him quickly changed.

That's why charities always donate the "proceeds". That's code for "after all the employees get PAID" and believe me, they get paid. Not for profit is even more lucrative than the government employment for grifters. Of course the ultimate grift is government contracts, that's basically the taxpayer funded open check.

19:45 this understanding is incorrect. You own the code you write, mods are added on to existing game code - they don't ever contain the game code, they hook into it. You don't own the underlying copyright, however the original copyright holder does not own your code either.
This is wrong. Under current copyright law, mods count as sequels and the copyright holder owns the rights to create sequels. Your code belongs to them, even if they don’t go after you for it.

As an example, DBM is copyright, and Blizzard has terms that all add-on creators agree to. So long as DBM follows those terms, then the add-on is not copyright infringement, and similarly, Blizzard cannot make a native version called "Blizzard Boss Mods" that uses the exact same functionality and presentation out DBM without the DBM creator's permission. In addition, another add-on creator is violating DBM's copyright if they release a copy of DBM without permission.

If they re write the entire code then it's that individuals IP, certain aspects of copyright law could still crop up even in the last scenario.... 20:00 you are spot on in your interpretation of copyright law. Ifthe modded code has the original code embedded then by law it's still the IP of the original designer. If you completely rewrite the code but use the same style of gameplay as the original it can still fall under copyright infringement laws as Copycatting, if the original IP holder has registered it as their own (Which all companies do these days in their TOS)..... I used to do a lot of modding on the Nexus forums using GECK and SKSE and I always thought the mods I made were mine, nope they all still to this day belong to Bethesda, even when I used a 3rd party application like Maya for certain textures, it all still belonged to Bethesda, then they started monetising modders works, and not crediting them or giving them a cut, that's when I stopped....... Modders hardly ever get credit.... Microsoft and Minecraft was another one. I helped with one of the mods back in 2011 (The MT mod most servers still use to this day for logic circuits) once Microsoft took over from mojang they tried monetising certain mods... It was their IP at that point though so they had the right 🤷 I've gone on long enough now, happy new year to all...

Sounds like every charity to me IMO. Even every day ones that people recognize spend shockingly little money on anything charitable. If a charity puts 100% of their takings into operational costs then they legally keep their charitable status. So you stack your board and leadership group with relatives and buddies and pay out massive salaries (which fall under operational costs) and just sit back and rake in the money. This is why all really rich and influential people have "foundations" and charities.
I discovered this when I was researching animal rescues and no kill shelters. The amount of scam "charities" in this sector is like 80% easy. I'm not trying to discourage donating to these types of places, I donate to a few local organizations but it was a chore to find legit ones.
my buddy worked for one of these orgs and said 90% or more of the donations go to administration costs, salaries, etc. Basically everything BUT what people think they're donating to. he basically said dont bother donating to anything outside of a handful of orgs because the money is just pissed into the wind.
Operational costs being where most charity dollars go is normal. You want them to provide services and not just free money, otherwise you’re going to end up with people gaming the system for free money. I’m not understanding how any of you would do it differently.
The developer can own the code if he can prove that it wasn't part of his duties and the work was done outside of work hours. In my previous work 2 developers suggested they tailor an internal programme to support and integrate all the stuff we were using, they were told NO. Then in their free time dey developed a prototype that would make their work 8-10 times faster, they were rejected once more, so they started their own company, did the coding on the weekends and then sold their program that was a perfect fit for our company. The beautiful thing is they still work there and every time there's a problem with the software, they get additional "consulting fee" on top of the mountly subscription fee.

Jirared was put on the spotlight, and he used that to run into the same brick wall himself everyone else ran into. He could have just... not do that. He could have done ANYTHING else.

When that didn't work he ignored it and tried to pretend none of it ever happened; the only decent strategy he did, but too little too late. So instead of an honest genuine reaction to everything, we saw floundering and even more deceitful behaviour. It's no wonder people WANT to him fall at this point.
It is a shame, I did like the content that The Completionist put out most of the time, however there was always a feeling that he was a bit of a greedy a**hole, anyone who watched his channel when it was first formed will remember he started it with his best friend Greg, and things got so bad behind the scenes because Jirad wouldn't pay him basically anything for all his work that Greg eventually took him to court and made him take down ALL his videos containing Greg, it was at least 100 episodes.. It made me realise that perhaps Jirad wasn't as nice of a person as he makes himself out to be. There was a really early video when Jirad filmed a skit in his parents house, and lemme just say it was IMMEDIATELY obvious that Jirad came from a VERY rich family, he wouldn't EVER struggle for money.. From a lot of personal experience, those that have been raised rich are extremely greedy when it comes to money (and often they don't even realise it).
There was also a video of his, around the first major UA-cam algorithm change, where he complains about not making enough money and not getting enough views. I think he had the super beard bros channel up as well as a full staff of paid employees at the time. Like, idk man…seems like you’re doing well enough to where you can pay 6 full time dudes.
Pro tip: if you’re going to donate to a charity avoid anything with the word “Foundation” in it. Due to the way the word works legally it’s essentially a huge red flag that almost no money if any is actually going to go to charity.

Out of all this, I'm going to comment about how screwed up it is that corporations are allowed to inflate their "attorney's fees" to $220,000+ for a case that didn't even go to trial.. it was dismissed. Since they're allowed to artificially inflate the fees, they can force you to pay what would normally be considered a counter-suit without filing said lawsuit.
It doesn’t take long to rack up costs if you’re dealing with multiple motions, investigation, research, writing the motion, appearing in court, traveling, depositions, etc. Seems like a reasonable sum for 2 years of international litigation IMO.
You missed that the amount that was being held in the charity bank account, is the same amount they'll have to pay out for the frivolous lawsuit. Could explain why since the lawsuit was made in the name of the LLC, so LLC pays the price.

Throughout the entire history of people robbing banks, it has always been known that the robbers would hide their loot somewhere so that they could retrieve the money after all the dust settles and or they get out of jail. The problem is, only when you donate small amounts of money, they can use it for loans and such stuff. When you donate a larger amount, you can restrict that donation, so it HAS to go to some ACTUAL dementia research. This is the main reason for this entire ordeal.

It requires people to simply take basic personal accountability and only donate to a charity that publishes its financials and only donate to ones that have 90% or higher efficiency. No force is required. Also at least with charity they are subject to free market forces and accountability, while government programs get their money via theft and have no or virtually no transparency. The figures we do know show government programs have at best around 40% efficiency.

So I thought I'd just hop in and clarify something: He was "holding the money in a box" and not touching it, because charities only have to have keep financial records for THREE YEARS. This means once the three years of "holding" the cash is up, he can literally say the money is his and doesn't have to produce financial records to say otherwise because the charity no long has those records (conveniently). There's your scam.
This is exactly what I was thinking too. Collect, save, and pray nobody finds out about it. If successful, in 20 years time nobody would know or care at that point. I believe that years ago there was a documentary about a famous jewel thief that did the same thing. She got caught but didn’t disclose where she stashed everything. She did her time and cashed out when she was released.

This is such a shame. I was never into Jirard's solo content, but Super Beard Bros and Scary Game Squad on Jesse Cox's channel are two of my favourite shows to frequent. Thankfully, they're still going strong after separating from TOVG and ceasing work with Jirard since the drama, but this situation really put a damper, and a doorstop on everything for a while there. Their content is definitely better for it and both groups are uploading more consistently now. Can't believe this is still happening though. Dude needs to learn some hard lessons.
Just speculation, holding the money in account could be a "wait and see". If he planned on embezzling, holding onto it rather than spending would be smart. If after x # of years, no issues, spend it, otherwise donate and maintain reasonable doubt.

As far as I know it, you have 3 years after taxes are due to file them and still collect. You can file any time and still pay them though if you owe. However if you go past date due the chance of being audited increases.
@mikebierle1979 also in April of 2024 I did my federal and state taxes for the years of 2021 2022 and 2023. 2nd time I've done this, although last time I did 4 years in a row and they wouldn't pay out past 3 years.

Taking the money out and 'running' with it would in no way prevent him from being caught if they wanted to go after him, there are records of everything. The only way that works if it's so much money that you just leave the country and then sometimes not even then, and it was nowhere near enough for that. We're talking about under a million dollars here, his company before the controversy probably made that much every year. The 'they were stealing the money' narrative is absolutely ridiculous, "they were incredibly irresponsible with the money" fits MUCH better. To be clear, that's still a bad thing.
Why take the money though? 600K is not even that much money when you have a big channel with millions of subscribers. He probably made that much in 2 years - why risk it all? Now if it was 10 mil, that would be life changing money for him
I don't think it's even that. He doesn't strike me as the long-term con type. I've seen this kind of situation play out before, except it wasn't a charity but instead someone holding money for someone else for an extended period. They usually start small, but incrementally just snowball until the conclusion is unavoidable. Most likely what happened he originally intended to send it to charity and he did hold onto to it for the first month to half year because he didn't want to give it to some scam. But then the amount just keeps growing, and him or his family or friends just sees the money sitting there, so he thinks he can just dip a bit and fill it back up later. So he does it the first time and suffers no consequence. The others also sees this. They probably tell him some shit like they need money for the dentist and they promise to pay him back. Maybe he spent it on gambling. So he dips again, and again, and again. They pay him back sometimes and asks for more and tell him they paid him back last time to they're good for it the next time. Eventually, months go by and now it'll take several months more to fill the account back up. Now he's fucked and has entered the death spiral. Things become even more fucked when the rumors start bubbling about the charity being a scam, and then finally Karl's video a year ago is released. Now he's even more fucked since his income is very dependent on his reputation within the content creator space. He can't come clean because he's basically committed fraud. Anyone that he gave the money to probably thinks they can just throw him under the bus if things get too out of hand by saying he's the one that had access to the account so he's solely responsible. I'm not saying he's not responsible or accountable and he should absolutely face the consequences of his actions. But rather than anything malicious like wanting to scam people I think he's an amoral weak willed idiot that got way in over his head.

You get paid a salary or a set fee based on a contract. If it’s in college, they’re paying for the tools you’re using, the salary of the project heads, etc. Some institutions negotiate IP rights with their researchers, but that’s usually at best split ownership.

Regarding whether or not Rockstar would own the NoPixel mod code: only if specified in the ToS (which could still likely be argued in court considering how often ToS are found to not be legally binding). Holding onto the money would allow for a lot of things. Higher loans with low interest rates for his business. Having a large amount of capital in an account wouldn't hurt for other stuff either, wouldn't even have to use it, just show proof of it.
Writing code that interacts with other software doesn't generally make the software owner the copyright holder. They can still prevent you from distributing or selling the code as its binary form.
The only issues I had with the reporting of the charity fraud is that people would constantly lay all the blame on Jirard Khalil instead of the Family on the board that actually made or refused to make the decision to release the funds for years. Money was never shown to be stolen yet it would be implied constantly(regular administrative costs reported on taxes isn't theft, does it sound terrible sure, but it is normal). Jirard was never shown to have the capacity to release the funds but no-one denies that by 2021 or 2022 he knew he and his family had lied to the public and he chose to go support the lie even if he said he disagreed with it. He never at any point should've held all the blame but, Karl Jobst especially, would feed the community just enough of a pointed interpretation of the issue that the community ran away with the framing that was given, "Jirard is the face of this Org, the Org and Jirard lied, they've held onto donation money for 9 years. Jirard Khalil is a fraud" That view is so flawed I was shocked that "journalists" like Karl and Mutahar who seemed to have integrity would even let the conversation of the situation degrade to that. The Completionist erred in judgement and should've been transparent after discovering his family's Org had failed their mission statment and lied to both him and the public, but he wasn't. The Open Hands foundation has deservedly lost its credibility and possibly it's status as a charity. No money was proven to be stolen just mishandled until it's release after the reporting. Until the law shows public records of this being a worse shade of grey than it is people should be more accurate in their reporting or regurgitation.
Jobst has never been one to let the truth get in between him and money. He made like 60 sponsored videos engaging in more and more sensationalism against Billy Mitchel over what was essentially "This tournament in the 80's used a repaired and modified arcade cabinet, as was normal, and no one noticed or cared for 30 years".

As a developer, it depends on when he coded his mod code. If he was on the clock and developing his mods, it belongs to his employer (this is usually spelled out in the contracts you signed when you are hired). If he created the mod outside of work hours and NOT using any code or tools from his employers, it's his mod and his code. Some employers are greedy and will say anything you develop whether it's inside work hours or not is theirs. It really depends on his contracts.
Tell that to Taylor Swift. She didn’t just donate 400 Million she lost 23 Million under the rug in crypto. Her owed taxes more reflected a crypto loss. And by her very perplexing opinions and try at presidency this makes so much sense to consider as fact.
There is a very interesting psychological concept. Being able to afford something is better than buying something. It is also in center of consumerism. Most peoole need to be poor enough to be focused on the buy. If you can afford something and do not buy, there will be a similar trigger within a year, and eventually you will feel like you are comfortable owning what you own cause you could buy anything you fancy. In this case they probably felt success being able to donate the amount of money, but donation itself never materialized cause the longer they delayed the less important it became.
My family instilled in the following motto for charities- "Give as your left hand does not speak to your right hand." As in you give personal as you feel is right and just and NEVER EVER speak of it. It depends. A game company can't take someone's mod and use it as their own. The modder owners their creation, even if it uses in game assets. But some games specifically say in their TOS that they own any mod a user creates. With all that being said, the game company can shut down any mod at any time. As far as Rockstar is concerned their TOS makes it clear that no mods are allowed, but in practice they leave you alone as long as you're not making any waves. But they have sued modders in the past.

So I've actually been to Kenya. You know those charities that people donate clothes too? Yeah these charities RESELL those clothes and I've seen it. I also have distant relatives who still live there that tell me the same thing. Oxfam and the like are good business and those donations tend to go in the pocket of the CEOs.

I used to do a lot of modding on the Nexus forums using GECK and SKSE and I always thought the mods I made were mine, nope they all still to this day belong to Bethesda, even when I used a 3rd party application like Maya for certain textures, it all still belonged to Bethesda, then they started monetising modders works, and not crediting them or giving them a cut, that's when I stopped....... Modders hardly ever get credit.... Microsoft and Minecraft was another one. I helped with one of the mods back in 2011 (The MT mod most servers still use to this day for logic circuits) once Microsoft took over from mojang they tried monetising certain mods... It was their IP at that point though so they had the right 🤷

Sounds like every charity to me IMO. Even every day ones that people recognize spend shockingly little money on anything charitable. If a charity puts 100% of their takings into operational costs then they legally keep their charitable status. So you stack your board and leadership group with relatives and buddies and pay out massive salaries (which fall under operational costs) and just sit back and rake in the money. This is why all really rich and influential people have "foundations" and charities.
That and the tax benefits those who donate get from them

I discovered this when I was researching animal rescues and no kill shelters. The amount of scam "charities" in this sector is like 80% easy. I'm not trying to discourage donating to these types of places, I donate to a few local organizations but it was a chore to find legit ones.
my buddy worked for one of these orgs and said 90% or more of the donations go to administration costs, salaries, etc. Basically everything BUT what people think they're donating to. he basically said dont bother donating to anything outside of a handful of orgs because the money is just pissed into the wind.
Operational costs being where most charity dollars go is normal. You want them to provide services and not just free money, otherwise you’re going to end up with people gaming the system for free money.

The developer can own the code if he can prove that it wasn't part of his duties and the work was done outside of work hours. In my previous work 2 developers suggested they tailor an internal programme to support and integrate all the stuff we were using, they were told NO. Then in their free time dey developed a prototype that would make their work 8-10 times faster, they were rejected once more, so they started their own company, did the coding on the weekends and then sold their program that was a perfect fit for our company. The beautiful thing is they still work there and every time there's a problem with the software, they get additional "consulting fee" on top of the mountly subscription fee.

It is a shame, I did like the content that The Completionist put out most of the time, however there was always a feeling that he was a bit of a greedy a**hole, anyone who watched his channel when it was first formed will remember he started it with his best friend Greg, and things got so bad behind the scenes because Jirad wouldn't pay him basically anything for all his work that Greg eventually took him to court and made him take down ALL his videos containing Greg, it was at least 100 episodes.. It made me realise that perhaps Jirad wasn't as nice of a person as he makes himself out to be.
There was a really early video when Jirad filmed a skit in his parents house, and lemme just say it was IMMEDIATELY obvious that Jirad came from a VERY rich family, he wouldn't EVER struggle for money.. From a lot of personal experience, those that have been raised rich are extremely greedy when it comes to money (and often they don't even realise it).
There was also a video of his, around the first major UA-cam algorithm change, where he complains about not making enough money and not getting enough views.

Out of all this, I'm going to comment about how screwed up it is that corporations are allowed to inflate their "attorney's fees" to $220,000+ for a case that didn't even go to trial.. it was dismissed.
Since they're allowed to artificially inflate the fees, they can force you to pay what would normally be considered a counter-suit without filing said lawsuit.

No force is required. Also at least with charity they are subject to free market forces and accountability, while government programs get their money via theft and have no or virtually no transparency. The figures we do know show government programs have at best around 40% efficiency.

This is such a shame. I was never into Jirard's solo content, but Super Beard Bros and Scary Game Squad on Jesse Cox's channel are two of my favourite shows to frequent. Thankfully, they're still going strong after separating from TOVG and ceasing work with Jirard since the drama, but this situation really put a damper, and a doorstop on everything for a while there. As far as I know it, you have 3 years after taxes are due to file them and still collect. You can file any time and still pay them though if you owe. However if you go past date due the chance of being audited increases.
That is very very not correct, especially for business taxes. Some businesses have to pay their taxes quarterly.

Taking the money out and 'running' with it would in no way prevent him from being caught if they wanted to go after him, there are records of everything. The only way that works if it's so much money that you just leave the country and then sometimes not even then, and it was nowhere near enough for that.
We're talking about under a million dollars here, his company before the controversy probably made that much every year. The 'they were stealing the money' narrative is absolutely ridiculous, "they were incredibly irresponsible with the money" fits MUCH better. To be clear, that's still a bad thing.

I don't think it's even that. He doesn't strike me as the long-term con type. I've seen this kind of situation play out before, except it wasn't a charity but instead someone holding money for someone else for an extended period. They usually start small, but incrementally just snowball until the conclusion is unavoidable. Most likely what happened he originally intended to send it to charity and he did hold onto to it for the first month to half year because he didn't want to give it to some scam. But then the amount just keeps growing, and him or his family or friends just sees the money sitting there, so he thinks he can just dip a bit and fill it back up later. So he does it the first time and suffers no consequence. The others also sees this. They probably tell him some shit like they need money for the dentist and they promise to pay him back. Maybe he spent it on gambling. So he dips again, and again, and again. They pay him back sometimes and asks for more and tell him they paid him back last time to they're good for it the next time. Eventually, months go by and now it'll take several months more to fill the account back up. Now he's fucked and has entered the death spiral. Things become even more fucked when the rumors start bubbling about the charity being a scam, and then finally Karl's video a year ago is released. Now he's even more fucked since his income is very dependent on his reputation within the content creator space. He can't come clean because he's basically committed fraud. Anyone that he gave the money to probably thinks they can just throw him under the bus if things get too out of hand by saying he's the one that had access to the account so he's solely responsible. I'm not saying he's not responsible or accountable and he should absolutely face the consequences of his actions. But rather than anything malicious like wanting to scam people I think he's an amoral weak willed idiot that got way in over his head.

Thank you. Honestly reading a lot of the comments disgust me. I have seen and participated in many charities that actually succeeded in their goals and did a lot of good. What Jirard did was wrong but that doesn't mean all charities are like that.

Regarding whether or not Rockstar would own the NoPixel mod code: only if specified in the ToS (which could still likely be argued in court considering how often ToS are found to not be legally binding). Easy example for reference: DotA. Blizzard didn't own DotA when it was created in WCIII, that's why the devs were able to go make DotA2. This is also why when WCIII Reforged came out, Blizzard made certain to add a clause into the ToS stating that they own all rights to anything/everything created in the map editor and were free to use it as they see fit without needing to pay royalties to - or even give credit/mention to - the person(s) who created it.
Holding onto the money would allow for a lot of things. Higher loans with low interest rates for his business. Having a large amount of capital in an account wouldn't hurt for other stuff either, wouldn't even have to use it, just show proof of it.

The only issues I had with the reporting of the charity fraud is that people would constantly lay all the blame on Jirard Khalil instead of the Family on the board that actually made or refused to make the decision to release the funds for years. Money was never shown to be stolen yet it would be implied constantly(regular administrative costs reported on taxes isn't theft, does it sound terrible sure, but it is normal).
Jirard was never shown to have the capacity to release the funds but no-one denies that by 2021 or 2022 he knew he and his family had lied to the public and he chose to go support the lie even if he said he disagreed with it. He never at any point should've held all the blame but, Karl Jobst especially, would feed the community just enough of a pointed interpretation of the issue that the community ran away with the framing that was given, "Jirard is the face of this Org, the Org and Jirard lied, they've held onto donation money for 9 years. Jirard Khalil is a fraud" That view is so flawed I was shocked that "journalists" like Karl and Mutahar who seemed to have integrity would even let the conversation of the situation degrade to that.
The Completionist erred in judgement and should've been transparent after discovering his family's Org had failed their mission statment and lied to both him and the public, but he wasn't. The Open Hands foundation has deservedly lost its credibility and possibly it's status as a charity. No money was proven to be stolen just mishandled until it's release after the reporting.
Until the law shows public records of this being a worse shade of grey than it is people should be more accurate in their reporting or regurgitation.

He made like 60 sponsored videos engaging in more and more sensationalism against Billy Mitchel over what was essentially "This tournament in the 80's used a repaired and modified arcade cabinet, as was normal, and no one noticed or cared for 30 years".

As a developer, it depends on when he coded his mod code. If he was on the clock and developing his mods, it belongs to his employer (this is usually spelled out in the contracts you signed when you are hired). If he created the mod outside of work hours and NOT using any code or tools from his employers, it's his mod and his code. Some employers are greedy and will say anything you develop whether it's inside work hours or not is theirs. It really depends on his contracts.

There is a very interesting psychological concept. Being able to afford something is better than buying something.
It is also in center of consumerism. Most peoole need to be poor enough to be focused on the buy. If you can afford something and do not buy, there will be a similar trigger within a year, and eventually you will feel like you are comfortable owning what you own cause you could buy anything you fancy.
In this case they probably felt success being able to donate the amount of money, but donation itself never materialized cause the longer they delayed the less important it became.

It depends. A game company can't take someone's mod and use it as their own. The modder owners their creation, even if it uses in game assets. But some games specifically say in their TOS that they own any mod a user creates. With all that being said, the game company can shut down any mod at any time. As far as Rockstar is concerned their TOS makes it clear that no mods are allowed, but in practice they leave you alone as long as you're not making any waves. But they have sued modders in the past.

Unless something changed or I don’t understand how that charity works but it doesn’t seem right. There was also this family that requested a bike and a bit later they went and bought a bike. TFT gave them another bike knowing they already had one and said “keep it, we’ve got enough.” People I know personally that live in different states ran across the same scenario these last few weeks.
