All PIP assessments should be officially recorded and a written transcript should be given to the claimant to sign prior to being given to the decision maker.

absolutly the fact that they will not allow it shows they have something to hide i see no reason at all other than they are fudgeing it to get people of the books and save money.
the way people are being treated with severe health problems is a disgrace.
"so you have lost both your legs in car accident can you tell me what problems that causes you"

You can request for the interview to be recorded and they will give you the CD afterwards. My wife did this with her second interview after failing her first where the health worker (NOT a Doctor) blatently lied about things concerning her mobility!!! We discovered this when she appealled the decision. Her second interview was with a much more understanding lady than the first who was obviously carrying out her orders to get people off sickness benefits.

Similar thing happened to me.... ATOS assesor said she observed me walking normally for over 50 metres without an aid, yet I'm in a wheelchair... I lost my Motability car immediately, and it tooks ages to get a new one once my appeal was won.... It should be classed as misconduct in a public office for these assessors to lie so blatantly; perhaps they'd pack it in once a few of them landed in a prison cell!

The trouble is, their methods come from, and are the responsibility of the government. So getting a good result in court will be difficult if at all possible. Recently, the UN has told them that their policies and ways are probably illegal and have told them they should reverse the harm they have done. The DWP response has been to deny everything. These people are some of the most desperately evil in this country. The whole despicable system should be reversed. Too many people have lost their lives because of this lot.

they are a task force to lower the numbers of people on benefits
that's their Job and their mission and this government know full well what they are doing as they are employing them to do it.
and its why even though it has been proven in court that they have lied and altered reports, so far no legal action has been taken.

@Spookychris01... Yeah, but NOBODY who is disabled wants a Tory politician getting in! At least Labour, LibDems, Plaid, The Greens and SNP actually care about disabled people.
The things disabled people have had to put up with since 2010 at the hands of The Conservative party, has been nothing short of a national disgrace - an appalling, shamelessly deliberate set of policies to claw money from disabled people to pay for needless austerity so that the least able have to pay for the mistakes of the rich bankers who provide 80% of Tory party funding!

I got turned down twice for PIP when I was going through cancer, because a physiotherapist assessed me. So I just had to go on regular universal credit. In my 5th week of radiotherapy when I was very very poorly I got an email telling me I had to go down to the job centre for a meeting with a job coach or my benefits would be cut, even though at the time I had a job, they just weren't paying me sick pay anymore. I went down there with severe radiation burns, and being ill like that if I had caught a cold or infection from there it would have been very bad for me. I was sipping water constantly and the security guard tried to take my water from me. The job coach was appalled that I had got denied pip, and she said I should fight it, but the problem is, people applying for pip are very ill and fatigued and don't have the energy to fight most of the time, so it just keeps on happening. The whole system is a lash up.

I had applied for pip before and was lied about even lost at court as I had no support workers at the time. (I have borderline personality disorder) and various conditions that effect my whole life. The judge was manipulative and at the time only my friend could go with me. So I have recently reapplied and had another assessment, the assessor responded to me and my worker by coming out 15 minutes late and saying “it’s going to another 15mins now I have finally got rid of that last one”(the poor woman assessed before me) I asked for some water (I am diabetic type 1) there was a tiny bit in a jug and offered my worker some water and took the last drop for myself but asked the assessor for more water she was reluctant and annoyed I wanted water, I nearly passed out with heat (the heating was on full blast) my worker asked me if I was ok and the assessor moaned she had been cold that day. That day in my town there was a severe snow storm. I had bought recording equipment but it was so old that sadly it wasn’t going to work I was distraught when she found out I couldn’t record her face was pure relief and laughed. Yeah I know why as well! Why are we not allowed to record this it should be MADE LAW THAT ALL ASSESSMENTS ARE RECORDED IT PROTECTS THEM AND US! This has to stop!

  • @aaronjackdaw8695
    @aaronjackdaw8695 5 років тому +51

What was most difficult in my case was the assessor comes across as understanding and caring, then blatantly lies in the report. I wanted to record the assessment and ask for a copy at the end of the assessment but I was too anxious to ask for that! They took full advantage of my conditions and left me with nothing.
Now I have to pay council tax, rent, etc with no income what so ever. No wonder so many people commit suicide.
Want to know the irony in all of this? I've had therapy, CBT and personal psychological therapy... which did actually help and I am currently on meds and slowly making progress. I was literally starting to feel better enough to work and on the day I was hoping to integrate into society and get my livelihood back for myself, they sent the rejection letter stripping me of everything.
That already messed me up when they threw me off of DLA because of PIP years back which sent back my progress tenfold.
The gov don't help the vulnerable, they purge them.

Well I am happy to report it is not all hopeless doom and gloom. A battle has been won even if the war continues.... They haven't had their assessment yet but I know a claimant who's DLA was terminated and their PIP claim closed just because they refused point blank to attend an assessment location and the reasons given for non attendance were based on their human rights, loss of dignity, risk of further injury and a whole myriad of other relevant reasons their rep managed to discover were correct via online research and accepted by DWP but their award was never reinstated.. Insanity alert!!.. The DWP having initially told the claimant when they lost their FTT (First Tier Tribunal) appeal that their only option now was to make a fresh claim for PIP.. Well undeterred by this they proceeded with written permission to appeal to the UTT (Upper Tier Tribunal) and well over two years after it all began they were notified they had been granted permission to appeal to the secretary of state who has a month to respond.. or their staff minions do.. The UTT judge not only flayed into the DWP for contradicting itself but also the FTT who apparently had "erred in law".. Whether all these mistakes were purposeful or not we will never know but the claimant currently feels like half a dozen anvils have been taken off their shoulders.. However it all ends (and when the claimant resurfaces from their well deserved bender, begun a few days ago) time will tell..? Our advise to anyone enduring Government bullying is fight on legally.. never give into these bastards.. When the going gets tough the tough get going is right and proper.. Government appear to be testing claimants will to live and the core "determination" of the individual.. Rise above the bullshit.. cry, get angry, sleep a lot, stroke your pet ... whatever in private.... but never let them see you weak, down or upset.. Then come out of your corner properly wised up on how to proceed and fight back.. No emotion, it will not alter how they are one jot.. Best of luck to all genuine claimants...

Disgraceful what genuine claimants have to go through while MP'S claim for everything from homes to coffee.

ATOS and CAPITA are set to be paid more than 700 million for their five-year contracts against an original estimate of £512 million, furthermore almost 70% of claimants have their original decision overturned at appeal. (DWP) has spent more than £100m in just over two years on administering reviews and appeals against disability benefits and tens of millions of pounds a year are also spent by the Ministry of Justice on the appeals. So if people are interested in how their taxpaying money is spent they need to dig a bit deeper. It’s disgusting that we live in a society that allows those that are sick to be treated so badly. Nobody knows how long they will have their health, or when they themselves might need the help of this utterly corrupt system.

If everything is done fairly and correctly then they shouldnt have any worries about any recordings.....honestly its getting worse in this country to try and get anything done......this assessor although voiced over here almost talked to nev in the same self righteous teacher to pupil but very robotic way.
Where do they find these people....do they talk in the same manner with their friends down the pub?
Poor nev spending a year trying to put the DWP right and having to jump so many hoops. Its all wrong is this.. the guy had a lung removed and cant work. He has paid his taxes now fucking well leave him alone and just pay him his fucking money....

Made a new claim on pip. Waiting for results. I have Ankylosing spondylitis, osteoarthritis, asthma, knee pain, sciatica, numbness in feet and hands. suspected Meniere's disease due to middle ear Infection. This has been happening for years,
It isn't "mistakes" made by individual nurses.
This is clearly a top down problem and the only reason these private firms were brought in to do these assessments is to give one more degree of separation and deniability to the government.
I was on DLA and then PIP for nearly 5 years due to a mental breakdown and these assessments were awful.
Not only were they extremely stressful and detrimental to my recovery but financially they have a massive impact.
Government departments are very quick to talk to each other when they want to stop giving assistance but when you then go through the appeal and win it's down to you to notify and often reapply for things that never should have stopped in the first place.

My son was diagnosed with Asperger's 16 years ago and was approved for disability living allowance. He recently had a PIP assessment and was turned down even though his circumstances haven't changed. The assessment is supposed to be carried out by medical professionals but typically they have no understanding on mental health related disabilities. Even the questions asked are geared towards physical disability and even then 9 out of 10 are turned down first time then miraculously approved on appeal. The whole system is a farce.

I've had three heart attacks, I have an incurable lung disease,I suffer with unstable angina, during the pandemic I altogether wasn't allowed to leave my house for over two years, the government sent me food parcels I was first in line to get the so called vaccine. Since 2009 I'm admitted to hospital between two and five times a year, the effect on my mental health has been catastrophic. All of my illnesses and the effects they have on my ability to live an independent life have gotten worse, the conditions are chronic in nature and are controlled by drugs. At my last assessment by a so called medical professional I was refused, and the things included in the report where inaccurate and misleading, and the things that where relevant where deliberately left out. One of the disciptors where I would of scored maximum points, was taken out and the reason for that was vaguely explained with "on the best medical evidence". Within three months of being refused pip eighty people a month are dying in this country. The shocking thing is that I haven't seen it on the news,it seems no journalist deems it news worthy. This government has fought tooth and nail in the courts to conceal these facts which tells us that they are knowingly allowing sick and disabled people to die. What can we do it's literally terrifying

Grace Kahugu I'm not going to pretend it's going to be easy but i was in your exact position just over a year ago. Went for ESA assessment November 2016, got 0 points, had to claim Jobseekers even though I cannot leave my home on my own, applied for mandatory reconsideration, refused, finally got to the tribunal April 2017 & didn't even have to go into the hearing as the tribunal took 1 look at my medical evidence & awarded my support group, fully backdated almost 2 years & a recommendation not to be reassessed for 36 months. Do hang in there I know it's tough now but they hope people will give up before it gets to tribunal. 1 thing I will say is they try not to tell you this but once you've had your mandatory reconsideration decision, even if it's decided to uphold thier decision that you are not entitled, lodge your appeal & you will get an official letter from the tribunal service within a week or so saying that your appeal has been officially lodged. From the date on this letter you are then entitled to go from JSA back to ESA assessment rate untill your tribunal. DWP SHOULD do this automatically but don't always so contact them the day you get that notice & tell them you want to go back to ESA. You won't have to fill in new claim forms or anything. It's the same rate as JSA I'm afraid but without any obligations or pressure to seek work.
Best of luck with it all. 🤞🍀

I had my assessment a few weeks ago and got the results the other day. It says I can walk 200 metres and the person also said that I could walk 20 metres in 18 seconds with the use of an elbow crutch. Half the questions on the form I wasn't even asked about but yet answered by her. Certain questions were also wrong. So money money was stopped, I suffer from a back injury which I did in 2011 while at work and I haven't been able to work since then. Every day is a struggle for me if I lie on my left side I have to have help getting out of bed, I can't stand for more than a few minutes and wen I put vaccum on I have to keep stopping to rest my back. My back gets so bad I would be in tears with it as it would feel like I have been kicked by a horse. I don't go out anymore because the pain gets worse. I already know beforehand that my appeal will be rejected by the DWP and if it is then I will go to the tribunal about it.

It should be legal for anyone to record your personal assessment , over the years I've had to appeal my decisions pretty much every time, and I noticed that things hadn't been written as I'd said in the interview , which contradicted what I'd written myself in my first form. I also had a assessment where the nurse said she knew nothing of my condition, yet was able to assess me ?? The appeals have been granted every time , but it took more money for the government to go threw such cases. I don't understand why our own GPs that see us on a regular basis can't grant them information on our consent . 20 mins in an interview where some of us can't remember things, get confused and even stumble on words ( infact the words just don't come 🙄) , or stumble on stairs even flat ground, how can they judge us on 20mins ?? Some of us have random attacks of symptoms during a week brought on by nothing or something , no pattern. Yet if you walk in and out your arms up basically you've failed your interview ? (Sorry that's how it's felt in the past), my daughter has sever anxiety so she got her interview at home , but because she was more relaxed at home with me sitting with her, she wasn't bad enough to pass her interview?? Yet getting her. Outside is a huge step, and she always is accompanied by someone , and will still crumble and freak out when not expected . Even in the interview she couldn't count when asked her mind was blank ( she starts to shut down with stress). Yet her paper said she could count perfectly , and could converse perfectly ? She didn't understand most of what the nurse said, her dyslexia means to her everything has to be worded in simple terms or she gets overloaded. Yeah they need an overhaul of their system cause it's not working fairly for ppl !!

My story under a tori government
My autistic son has been on dla since age 4 now 17 had to transfer to pip
Filled in the forms with a true reflection of our son and looking at the marking form they use we should have been awarded it but of course refused it.
It's clear what we put down is not believed
Government targets come first while they pay big companies to do the assessments and the people with conditions suffer
We went all the way to the tribunal where my son had to sit in front of a judge a doctor and someone else and answer questions like
Do you have a playstation can you read and understand instructions for them
Son doesn't know what to say so says yes
    (No one reads the instructions)
Are you doing driving lessons yes
What the don't know is his dad is his instructor
What would he do if his guitar strings snap
His mum got them sorted he is not going to tell them this
Subjects at school oh your doing well
he does subjects that suits his needs with limited theory he won't say this
Of course we lost the case
This is a horrible thing to go through for anyone nevermind a autistic kid
Oh and we had money matters help us with this and guess what he works in the same building (alarm bells) and he went through the form and said he doesn't see why he has not got it and in no way did he prepare us for this if anything we where lead to believe it would be ok
On a final note if you are diagnosed autistic it's a life long condition not just for the short term (so our son is not healed)
His mum who is not in the best of health is in a state because she blames herself for not being successful with this
Sooner the Tories are out the better they have never been good for the lower class and never will

Tommy Neil I’m so sorry. I know a few people with autism and it can be hell. One friend seemed “normal” most of the time. But that only made their little moments stand out more.

Part of the problems with PIP and ATOS is who they employ to do the job, ATOS had a doctor working for them who was struck off and banned from practicing medicine in the UK, but because he lived in france and traveled over for work he got around that ban for a while until found out. They also have physiotherapists doing health assements for mental and physical problems. that means you have people making medical assesments on conditions they are NOT qualified or even trained to work with. These companies by law mys be required to send some one who is qualified in Cancer, Heart, Mental health problems to assess those conditions. You would not ask a St Johns ambulance person to perform surgery, so how can they do it to deal with benifits and life changing medical and health problems

the biggest problem here is the outside company conducting the test, they obviously have targets to meet as regards to dwp contracts its the same as people who need to sign on for benefits, i know of someone who was unemployed and signing on, there first time ever doing so in a 40 year working life, his advisor actually warned him one day that higher level managment had taken the advisors in and told them they needed to cut at least 4 people a week through sanctions etc, the advisor told my friend to make sure eveything was perfect on his job searches etc so they had no excuse to harras him while we know others that have been on benefits for years nothing wrong with them etc and got cars, private lets the works! the dwp is shocking the worst goverment dept!

Ned you are absolutely correct in doing this because they are not recording Dara accurately. They stated I was able to walk perfectly and was observed doing so for 200 yards, impossible and a lie. Within northern Ireland we have no government minister despite this being one of the largest government departments in the UK. DFC told me they never bothered to record key personal data. Capita did not record my data properly and refused an investigation. Sort of makes disabled people feel like second class citizens doesn't it. Yet recipients of RHI boiler scheme recipients are protected by human rights legislation. What us also amazing is that me and you are also funding a RHI enquiry which will cost millions. What an insult to the disabled of the UK.

This is a problem that needs addressing. My assessment report was also untrue to what I had said in the interview. It was like I was reading someone else's. Still waiting on a mandatory reconsideration months later. I wish I had taped it...I will next time.

How tf can it be illegal to record a conversation in your own house? She went into his home not knowing what kind of cameras might be there and still saw fit to be there of her own accord. That’s disgusting. You should have the right to protect yourself, and to do things like this man has, in his own house.

I was the same put throw the mill .after bowel surgery. And told a peck of lies,he was so hateful. And his arrogance unbelievable. He left me in tear when we got his report we couldn’t believe that a doctor would do this to a cancer patient is disgraceful.

They lied about my mums said she could bend over and touch her toes, she couldn’t even do that before she had cancer. The assessor also tried to physically force her thumbs to bend which was very painful as they are straight and don’t bend due to arthritis.

On mine i was asked about planning a journey , this is the question that gives them the right to halve your mobility money ( from high rate to standard) , what planning a journey has to do with your walking problems is bogus , the sneaky DWP invented this question to take money of most of the claimants . I had a so called lady doctor who was in fact a so called nurse that had been so called trained to do these tests . They are done to take money of most claimants and these fake doctors receive 30 pounds for each claimant they fail , i know because i know a DWP government doctor who secretly tells me what the snaeky government is forcing the DWP to do to save money . IT DOES NOT MATTER HOW ILL OR DISABLED YOU ARE ITS ALL ABOUT THIS GOVERNMENT SAVING BENEFIT MONEY. Fack the Tories look at this universal credit crap they are forcing on people. Fack em all the no good pieces of dog zhit.

I'm nearly 60 years old and have worked full time for nearly all of the 44 years since I left school. Over those years some patterns have emerged. There has been a fairly constant campaign to target those who abuse the welfare system and that's as it should be. Curiously, over the years, there has always been a large unclaimed surplus of benefits. This has often been several times the magnitude of the estimated fraud losses but I've yet to hear of the powers that be going to any lengths to correct that.
In my time I've occasionally had the misfortune to have to claim various benefits, such as unemployment benefit, rent rebate etc. I find it difficult to recall many of those instances when my claims weren't screwed up at some point or I was told point blank I wasn't entitled to a benefit when I knew I was. In the early 80's I used some of the time I had available to me through unemployment by helping out at a claimants union. That was an eye opener and taught me a few things. I find it impossible, having gone through those experiences, to believe there isn't a co-ordinated approach to deny benefits payments at any opportunity that exists to this day.
