      For those who may be inclined to judge the Atlanta PD officers in the Brooks shooting, here's some legal information:
      APD SHOOTING EXPLAINED
      Before reading below, remember that officers are afforded the same constitutional rights a citizens, so whether they’re charged for political reasons or not, the facts of the case remain the same until their day in court:
      In order to understand this situation, you’ve got to set feelings and emotions aside to understand objective reasonableness.
      So looking at this case, what do we know?
      A DUI investigation determined that he was too intoxicated to drive. The bodycam showed the officers being overly nice and polite to him the entire time all the way up until the handcuffs were about to go on, as they should’ve been.
      As soon as they tried to cuff him, an all out brawl took place. Not just resisting, but punching them in the face and throwing them around.
      He took one officer’s taser, threw him face first into the asphalt, stood up, and took off.
      _____________
      So let’s pause there and see where we’re at legally.
      Charges:
      DUI
      Obstruction X2 - Felony
      Battery on an officer X2
      Aggravated assault X2 - Felony
      Strong Armed Robbery - Felony
      And believe it or not....
      Possession of a firearm during the commission of a crime - Felony
      Per Georgia Law, a taser is classified as a “less-lethal” FIREARM as they do occasionally cause death.
      (OCGA 16-11-106)
      ________________
      These offenses are important because there is a case law called Tennessee v Garner
      What Tennessee v Garner states is:
      “When a non-violent felon is ordered to stop and submit to police, ignoring that order does not give rise to a reasonable good-faith belief that the use of deadly force is necessary, UNLESS it has been threatened.”
      So this goes back to the taser being classified as a firearm that can cause death or great bodily harm.
      ___________
      So,
      They fought
      He stole the taser
      He got up and ran
      The 2nd officer chased after him and tried to use his own taser against him, but he didn’t get a good connection.
      Brooks then turns, aims the taser at the officer, and fires. Statutorily, this is no different than firing a gun.
      (The taser that APD carries has 2 cartridges, so Brooks could have potentially shot the officer twice.)
      The officer dropped his taser from his left hand after it appears he was hit by a barb on the video, draws his sidearm, fires 3 shots, falls against a car in the parking lot and Brooks goes down.
      Brooks was not only a continuing threat to the officer since he could still fire the taser again, but he also showed and EXTREME desire to get away, with a weapon. So it is not unreasonable to have the fear that he would use that weapon to carjack a motorist sitting in the drive-thru line, take a hostage, or otherwise hurt another innocent party.
      What does Georgia Law say about deadly force?
      OCGA 17-4-20 (b):
      “1. Sheriffs and peace officers may use deadly force:
      1.) to apprehend a suspected felon only when the officer reasonably believes that the suspect possesses a deadly weapon. (He did)
      2.) to apprehend a suspected felon who possesses any object, device, or instrument which, when used offensively against a person, is likely to or actually does result in serious bodily injury. (He did)
      3.) to apprehend a suspected felon when the officer reasonably believes that the suspect poses an immediate threat of physical violence to the officer or others (He did)
      4.) to apprehend a suspected felon when there is probable cause to believe that the suspect has committed a crime involving the infliction or threatened infliction of serious physical harm (He did)
      The officer only needed one of those requirements, but he had all 4........
      Now the reason taser’s are considered “less-lethal” is because when used appropriately, you are “less likely” to kill someone vs using a gun. But Brooks hasn’t been through the training to know how to avoid certain vulnerable parts of the body, and he doesn’t understand how neuromuscular incapacitation (NMI) works, which makes it MORE likely for him to cause great bodily injury or death than if an officer used it.
      And just to support the fact that tasers can and do kill, there is an East Point Officer currently sitting in prison for improperly using a taser and killing a man a few years ago.
      (Eberhart v Georgia)
      “He could’ve shot him in the leg!”
      Right off the top, it is unconstitutional to do so. It is considered cruel and unusual punishment to employ a gun in that manner. Either an officer felt deadly force was necessary, or he should use a lesser response.
      We could just leave it at that, but that's too much of a cop out, so let's discuss WHY it has been deemed unconstitutional. For one thing, that's an extremely difficult shot to make. The target is quite narrow, and in continuous motion as the suspect runs away/charges the officer. Under the best of conditions trying to hit the leg is challenging...to be generous about it. But in a life or death encounter, the officer's fine motor skills will be eroded by the stress of the encounter making the shot, turning a leg shot into a very low probability feat.
      Assuming a round does hit the leg, then what? The only way a shot to the leg would immediately stop a threat is by shattering one of the bones, and stopping the threat is the ultimate goal. While it is very difficult to find a shot to the leg that will immediately stop a threat, it is actually comparatively easy to find shots to the leg which eventually prove fatal. Human legs have very large blood vessels which are essentially unprotected (femoral artery)
      Now remember, we’ve had days to sit back, watch videos, discuss, and analyze this entire thing. The officers had less than a minute from the time the fight started, and less than 5 seconds to interpret EVERYTHING you just read while running, getting shot at with a taser, and returning fire.

      He was DUI, failed a sobriety test, failed a breathalyzer, resisted arrest,
      gave an officer a cuncussion, punched an officer in the face, wrestled an officer to the ground, stole a deadly weapon (Georgia law, read it and learn, or stay finite)
      He turned and fired the deadly weapon at the officers head. The officer fired his gun in self defense, not the taser. Why not taser? Because Brooks stole the taser. Tasers sound exactly like a gun- because they're both deadly.
      And you owe me an apology, for your failure to educate yourself before speaking, while on American soil. Which is provided to you by Police Officers and Veterans who risk their lives to protect your small minded existence.
      Next time you call 911 and an officer comes to save your sorry 'hide, you stand at attention, salute them and thank them for having enough backbone for the both of you.

      @Rab Lewin the officer followed police procedures that are in writing for their department. If a suspect takes your taser, firearm, or baton you are authorized to use deadly force. If you don't like the law that's fine but he followed procedure to the tee. He'll be acquitted and sue in civil court.

Also he was passed out drunk car in drive. He wasn't parked. Then when he finally moved the car he ran over the curb. Thats when the cop decided to do a dui stop. A few minutes later he didn't know where he was at or that the police had asked him to move

      If that's the case why didn't the officer use the same amount of force??? He still had his taser so why did he put the taser in his left hand then pull out the gun with his right? And he did it PRIOR to the taser being pointed at him. He was pissed he had just lost a fight in front of a lot of people who were waiting to order a burger. Maybe we could understand force during scuffle but after the person run off you shot him in the back?

All before an investigation was complete which is against protocol , and sending a wink wink to DA.. She feared backlash from black community, for a man who resisted arrest, punched officers, stole their weapon and fired it at officers head. I would've shot him too. If taser hits officer, it incompacitates him, he takes his gun and kills two officers. Then needs to flee, so he hijacks a car with your wife and baby inside. A chase ensues, he plows through mayor's conference, killing her. He holds your wife and baby hostage because, he refuses to go back to jail. Standoff lasts for hours. He feels desperate and kills your child and wife. All because you thought racial injustice is the issue instead of a man who caused his own demise. But at least he's still here, right?

      It's because he changed hands with his Taser before Brooks ever fired the Taser. So, he had already decided he was going to shoot his pistol BEFOREHAND. I'M sure that's where the felony charges came from......he switched his Taser to his shooting hand.

    The officer should' be free. This is crazy. The D A is dirty. He attacked the cop and fired a Weapon at him . He needs to be free. And awarded damages for this.       @Akeel Taylor homegirl tasers the police officer. Homegirl then has access to that officer's service weapon. Meanwhile the police officer's partner whose Taser homegirl stole is still suffering a concussion from homegirl's physical assault. Homegirl stole the taser and ran with it. Homegirl did not drop the taser after resisting arrest and assaulting the police officer but instead carried it with him and attempted to shoot the police officer who was chasing him. Homegirl was a fault. Had homegirl had been raised by good parents homegirl would have taken responsibility for the DUI and accepted the arrest like a normal person but that did not happen.

      Killing unarmed person is a crime regardless of the circumstances. Police can only use deadly force when their and other life are in danger. In this case the suspect's committed not only a minor crime but was running away from the police and was shot in the back.

      JJ the situation should have been easily contained. First mistake was to allow the guy to park the car safely whilst being intoxicated.The office should have parked the car and taken the keys. He agreed to the test and was found to be intoxicated. Let him rest in the car , and attempted to get a friend or relative to drive him back home or alternatively given the guy a lift home. Charged him with drink driving !!! Many police forces across the planet deal with the situation in that fashion. They do not use deadly force.Please acknowledge that there is a problem with policing in the states!,

    Most of Americans are Shocked that they charged the police officer. I watched the full video. This cop was nothing but polite and easy going with Mr. Brooks until he had no choice. He should be acquitted and then sue the shit out of the city of Atlanta.

      Most legal analysts who have been interviewed regarding this case say he will be acquitted. They say the evidence speaks for itself - from a legal perspective that is. It's unfortunate that most people here are speaking from a highly charged, emotional perspective - what makes it worse is that they don't know the law and how it works. I don't even know the law, but that's the reason why I can't get so charged about it. In my "opinion" just from watching the video the cop did nothing wrong; legal opinions of many legal analysts say he acted in accordance with the law. The DA's choice to charge him with murder was purely a political move.
      Brooks was on probation after having spent 7 years in prison for beating his kids so badly they ended up in the hospital. When you are on probation you MUST be on your best behavior. Well, he got drunk and then drove drunk to the restaurant where he passed out at the drive through window while waiting for his food. Drinking and driving is illegal. One time, when my husband was young he was driving under the influence. They took him to jail where he spent the night in a cell for his own protection and the protection of others on the road. The laws were a little different then so I don't know what else happened to him - it was long before I met him. But my husband complied and all went well. He never made that stupid mistake again. Brooks knew that if they took him in for driving drunk they would have found out that he violated parole. That's why he went haywire and stole the cops taser. He didn't want to go back to prison.

      The problem is you can’t prove that they’re racist. There’s not enough data and information to prove that police brutality is a result of racism. This issue with George Floyd and Mr. Brooks is a matter of police brutality not racism. And even if it is racism the problem is you can’t prove it. Racism is an issue that is a matter of the heart, only God knows your true intent. Now unless there’s previous records of him saying racial slurs or saying crap about immigrants and black people then I would say it’s most likely racism. But at this point there’s no racism to prove.

      I used to work at a sobering center, aka drunk tank. The drunks that the officers would bring in would make claims like "I was close to my house" and then vomit and stumble to their mats.       It is not okay to flee and resist arrest, and it is not okay for a police officer to shoot a citizen who isn't threatening his life or the lives of innocent bystanders; these things don't have to be mutually exclusive and one (resisting arrest) does not automatically justify the other (shooting someone in the back). Mr. Brooks was in the wrong to try and flee, he was in the wrong to fight against the police officers; however, he DID NOT deserve to have lethal force used against him and he DID NOT deserve to die.

    I can whole heartedly say that George Floyd shouldn't have died. He should have been arrested for criminal activity and processed and let out after he went thru that process. Rayshard Brooks made a choice to endanger his life. He lost. Think about that folks. I have been pulled over and complied with the police in every way. I went thru the process and I'm alive and free today. That is the choice I made. If you make the choice to fight with a cop, one that is trying to keep the roads safe from people driving drunk killing innocent people, then you endanger your life and the cops. It is the wrong choice that Rayshard Brooks made. I"m behind George Floyd in the Minnesota case and I'm behind these Atlanta officers here. No Charges period.       Strangely disarming an arresting officer of his taser and trying to shoot him with it is okay? The other office is already hurt and down, how dose the officer know that his life is not in jeopardy if he get incapacitated by the taser? Yes it's a non lethal weapon but you don't know know the actions of the person who is willing to fight police if he is incapacitated.
      For over 40 minutes both officers engage this man with respect and dignity. Even empathetic and friendly at times. No malice or Ill intent was shown this man.
      Resisting arrest & removing the policeman's taser caused his death.
      On the other side of this, let's say the first cop let him park and left him alone... He wakes up 30 minutes later and drives away... Maybe causing a car wreck killing a black family of 5 on their way home. Maybe your family would be the victims. Then we would say the office failed to do his job? At what point are people responsible for their own actions? Actions of impaired driving, resisting arrest, assaulting a police officer, disarming a police officer, giving a concussion to a police officer, fleeing with police taser, shooting taser at police, witch if these actions do we as society say is acceptable? When is it reasonable to say stop resisting and comply? Is that not why we have courts? Had he complied, he would be here today.
      George Floyd's arrest and death had similar interaction where Floyed coperated with police until they tried to put him in the car. The difference is Floyd, handcuffed posed no threat to the officers and the tactic of kneeling on his neck was excessive and unwarranted. The office had his hand in his pocket, totally relaxed as he contributed to Floyd's death.
      BUT what if Floyd just got in the car without resisting? Think about that for a minute.... He got in the car, no resisting and the officer doesn't use the excessive force, he's still alive, he goes to court and gets off because maybe he didn't know the $20 bill was fake, and the state can't prove he did.
      We don't have looting, riots that burned down homes and places of business, innocent people getting killed by rioters. Just think how one man's actions can affect so many.

      Being drunk doesn't mean someone is easier to handle. He was inebriated enough to not be able to legally drive.
      He pointed the thing that looks like a gun at a person and training and Instinct comes in to shoot at the person that pointed a gun like object at them.
      You're asking officers to have RoboCop like reflexes to know with absolute certainty that what he was pointing at the time was just a taser instead of a gun and even if it was just a taser and they knew it a cop being tased risks a cop being incapacitated and an assailant who could then get the officer's firearm.
      I have never heard before this June hysteria people being so dumb as to imply that people who commit DUIs just be escorted home. It's a crime. you get arrested. You're effectively asking cops always be on guard to expect any black person be an imminent violent threat if they don't coddle them emotionally to extreme lengths. Combine that with your expectations of inhuman reflexes and processing of white cops and you just got 21st century White Man's Burden racism.
      You have all this after the fact assessment that is infantilizing of mr. Brooks. There is no tragedy here that isn't entirely his fault.
      Don't drink and drive but if you do expect to be arrested. Don't resist arrest but if you do don't let it rise to the level of assaulting cops and stealing their weapons. Don't assault cops with weapons. Don't assault cops at all. This isn't a difficult concept.
      All of the anger at this is entirely unjustified And the emotions of anyone other than his immediate family are completely unwarranted.

      Arthur Morgan Yes I agree this could have been avoided, if Brooks complied with his arrest. This man had a background of abusing his children and they got him on a DUI. They were simply telling him to turn around and comply with being arrested. Brooks resisted, then got loose and began to beat and punch both cops. After stealing the taser from the officer, he ran. The officer chased him and Brooks turned around and tried to fire the taser (considered a deadly weapon) at the officer. The officer reacted in a way he should have. This was justified in all ways. Brooks was the one who made this incident violent. Officers act based on the tone and mood of the civilian.

    I agree that Mr. Brosnan did not commit a crime and should not have been charged. But police need to be trained different than they are. His first instinct should not have been to further subdue the man. He knew that the only weapon that Mr. Brooks was in possession of was a taser. He also knew Mr. Brooks has been shot. His FIRST action should have been to give first aid to Mr Brooks.
    And, although Mr. Brosnan's conduct makes him a despicable human being, it does dot make him a criminal.

      W Towns it isn’t, a cop has the potential of going to the death chair, his step mom got fired from her job, his partner was told to testify against him without his agreement
      It isn’t a haha funny joke it’s literal bullshit, Rolfes partner didn’t do anything and yet he is charged with 3 felonies
