    Police do not have a right to have you lower your window all the way down but you do have to exit the vehicle whenever they ask. Google Terry V. Ohio.

      Irrespective of the breaches committed by the woman, breaking the driver'swindow and this endangering her to injury would be held unacceptable in a court unless the officer could provide a serious overriding reason for doing so, e.g. he had good reason to believe she was about to pull a gun on him or race away.

      Come on now, a traffic violation IS a crime... and an officer can order you out of your vehicle for any reason -- and I'm no fan of cops but the officer was right in this case.

    The woman escalated things as the officer kept his composure, as the officer stated he wanted the widow down for his safety, and in the case of the ticket every video i've seen shows officers reaching into the vehicle enough to hand the ticked to the driver. Her hand was on the console were the window controls are, so i see no problem with him braking the window BUT notice he pulled it out and away from the driver? She was requested to step out of the vehicle a number of times and by two officers. This is clearly a case of a person thinking laws don't pertain to them. Well let the hate begin

      I agree when an officer says step out of vehicle to comply, but there was no reason. Window was half down. He was just being a jerk. Should never have came to all that. Now if he had actually probable cause to have fear, different story. I side with driver on the one.

    I always carry a fire arm with me, if that ever happened, then I will use self defense. I will arrest the cop myself and pray to God he doesn't resist because then I will have to put him down

    No he had a right to use proper force for her not following commands and for progressing the situation to make it more dangerous. She only had to sign a citation but instead rolled up the window to his hand.

    People don't really care about rights lol :P Weird :) Let them do anything they want ? The law is to protect you from violent police like that. 1 year on and nothings changed!! well at least she never got shot.

    Bad cop because it was just to force his will on her. He said that he made her get out because she would not comply! She did not have to comply to role down the window! The signature is not necessary but it is a power trip for police officers!

    The police officer involved is completely in the wrong! The woman was completely within her rights to refuse to roll down the window further as they were able to communicate with each other clearly the simple statement of officer safety is a bogus claim! We all know Cops demand us to stay in our vehicles when pulled over however that is considered false detainment and therefore a violation as well I roll my Windows up grab my documents and exit my vehicle and lock my vehicle usually to prevent fishing expeditions such as I smelled marijuana. ... as if it isn't in plain sight it doesn't give them a right to violate your constitutional rights to privacy.

    the police would have a right to ask for her window down more but not demand if she says no she does not have to she didnt have to roll down the window anyways then he breaks her window what if tht glass was to cut her then what he better got her a new window and appoligized rude self whats wrong with cops

    YES LEARN YOUR RIGHTS. YOU DO NOT HAVE TO ROLL YOUR WINDOW DOWN JUST BECAUSE HE SAYS SO. ALL YOU SAY IS THIS IS FOR MY PROTECTION AND IF YOU GET DETANDED DONT SAY ANOTHER WORD UNTIL YOUR LAWYER GET THERE, IF THEY WILL EVEN CALL ONE FOR YOU. AND THEY WILL HAVE THIS BEAUTIFUL LITTLE TALK WHERE THE LAWYER MAKE THE OFFICER LOOK VERY STUPID FOR WHAT HE IS DOING WRONG.
