@@DB5-zx9gs The UN Charter doesn't give the UNGA authority to order member states to do anything. UNGA resolutions are political statements, with no legal authority. The claim that an occupier cannot defend itself has no basis in international law. If you look, in fact, you'll find quite the opposite -- a duty (not just a right) of occupiers to establish and maintain law and order in occupied territories (H.IV, Art. 43). This is really common sense. Can you imagine the powers that signed the Hague Regulations and the Geneva Conventions agreeing to terms that required their occupation armies to lay down and die if confronted by armed rebellion? Also, it's not really clear that the ICJ considered Gaza to be "under military occupation" prior to O7 in the full sense of the term. Their position was much more nuanced than that. They said that Israel needed to withdraw its "presence" from "occupied territories," but also acknowledged that Israel's "military presence" in Gaza had already been withdrawn in 2005. They said that Israel still had some degree of obligation in Gaza under the laws of occupation, commensurate with whatever degree of control they still had since their withdrawal, but didn't characterize that degree of remaining control or obligation. They also didn't say that this remaining degree of control was illegal, and certainly didn't say that it voided any rights of self-defense if Israel were to be invaded from there. Assuming that Israel had a right to fight back after O7, there would be no basis for claiming they couldn't continue the fight into Gazan territory and occupy it. These are normal aspects of war, including defensive war, that have never been illegal under international law.

I still think the interview with Professor Wilde is relevant. In particular his comments on O7 and the right of self defence. He says that on O7, Gaza was under military occupation and that as the aggressor, Israel cannot claim self defence, even if resistance to that occupation is violent (10:21 to 10:46 of the video link) . So, what then, would be the legal argument that upturns the finding that Israel must leave the OPT immediately?

The claim that an occupier cannot defend itself has no basis in international law. If you look, in fact, you'll find quite the opposite -- a duty (not just a right) of occupiers to establish and maintain law and order in occupied territories (H.IV, Art. 43). This is really common sense. Can you imagine the powers that signed the Hague Regulations and the Geneva Conventions agreeing to terms that required their occupation armies to lay down and die if confronted by armed rebellion? Also, it's not really clear that the ICJ considered Gaza to be "under military occupation" prior to O7 in the full sense of the term. Their position was much more nuanced than that. They said that Israel needed to withdraw its "presence" from "occupied territories," but also acknowledged that Israel's "military presence" in Gaza had already been withdrawn in 2005. They said that Israel still had some degree of obligation in Gaza under the laws of occupation, commensurate with whatever degree of control they still had since their withdrawal, but didn't characterize that degree of remaining control or obligation. (Was it a lot? Was it a little? What specific obligations remained? They didn't say.) They also didn't say that this remaining degree of control was illegal, and certainly didn't say that it voided any rights of self-defense if Israel were to be invaded from there. Assuming that Israel had a right to fight back after O7, there would be no basis for claiming they couldn't continue the fight into Gazan territory and occupy it. These are normal aspects of war, including defensive war, that have never been illegal under international law.

Agree. But at least give us an insight from both sides. Clearly one side is using distraction discourse and the other is trying hard to provide factual conversation. Unfortunately at this moment in time the general public tends to incline to simple phrases rather than complex thought structures. With that said we should never giveup on being critical and understand that the Palestinians struggle is real and no matter what type of populism we are fed humanity will always prevail.
