The most likely explanation for the AIS discrepancy is that they have a tender onboard called Romulus that is also broadcasting AIS. That would explain the 8M boat size data. it's a common situation. In fact I bet he's got two tenders: Romulus and Remus ;-)
Tenders and boats that small almost never broadcast AIS. Only time you'll see that is sailboats engaged in a regatta where is mandated by the SIs.

@@otm646 I know of a charter yacht that has a 35ft tender that they also use to take guests fishing on, and it has AIS on it. But you are correct, boats that size ALMOST never broadcast AIS, but I believe if they are used for certain things such as charters and transporting passengers then in certain places/countries they legally have to be equipped with AIS.
Now we need pictures of the tenders from that boat.
I also though that it must be a VIP tender that broadcast this, but it is probbably only for deception, but atleast they can blame it on a tender.
I wonder how the insurance companies feel about the owners of these super yachts turning off their AIS at will? If you are broadcasting your nearly 100 metre yacht as 8 and you have a collision in the middle of the night, you shouldn’t be surprised if your insurance company refuses your claim.

@@lgchris1 No they don't. There are numerous instances when the captain has to present insurance documents to certain authorities and you cant do that if you are not properly insured.

Selling your yacht for a fraction of the price does not automatically avoid tax. Most jurisdictions the tax is based on the real market value and not the price you set on it.

Just a note on statutes of limitation in the US: once any legal proceedings begin the timer stops and then it makes no difference how long the court case drags on. Often you will find that prosecutors will file a case just to stop the counter.

8 meters is the tender size. Bet they named the tender Romulus. Having the tender on the ship complies with regs requiring an AIS on board ship but identifying the tender and not the ship, since the tender is IN the ship. Tricky way to maintain anonymity legally.

VAVA II was in La Spezia Italy last Tuesday 12th July. Found it odd it didn't have it's AIS on. Infact it didn't show any vessel at that location. Got some odd looks from a member of the crew when I took a pic of it. 🤔
Ecclestone is in the process of being charged with tax fraud by HMRC. No coincidence that he and Briatore are juggling boats around.
As far as Bertarelli goes (check your captions), quite possibly the Bertarellis have a couple of tenders - Romulus and Remus and the former is using VaVa's AIS.

So if it is a violation of International law to not/falsely display AIS, why doesn't someone take action? Can't a nearby country's navy or coast guard investigate when suspiciouis shown? shown? If for no other reason than to establish that everything us "Ok" onboard

No. A statute of limitations only applies to a first trial. If there are complications from that, the clock stops at the time the process starts.
This is clear as day to any true Star Trek fan... Romulus is the home planet for Romulans and they are the creators or the original cloaking device. This simple manipulation of the AIS system is just their way of paying homage to the home worlds best in class cloaking tech...

If the other tender is named Remus i would say it pretty much seals the deal with the Star Trek homage for the Cloaking tech reference. It was also the first thing that popped up while watching this video.

There's a UA-cam vid, a drone flyover, posted in 2016, with 'Romulus Vava II' in the title, so that name has obviously popped up before. I remember marine trafficking Vava II a few years ago, and there was no mention of anything star trekish then, so maybe it's something they do from time to time? No idea why though.

It is sad how these people are spitting in the face of laws surrounding AIS, and putting other boats at risk, as well as themselves with no or false AIS showing.
AIS is one thing that announces the vessel.
Radar would show ANY vessel that what is at anchor is 100m long.
Absolutely no possibility of making a mistake if you are using radar which you HAVE to to sail anywhere on these yachts.
At Anchor - who cares.
I find these stories extremely interesting. Appreciate all your research. It's great to have a story about a Superyacht which was seized WAY prior to any sanctions and the invasion of Ukraine. It puts in perspective the number of years, amount of litigation, and seemingly endless nature of what goes along with seizure. Multiply that times number of sanctioned superyacht owners (or the vessels themselves) and it is more understandable why so many are arrested yet not seized. Still expensive and uncertain for all sides or parties, but perhaps there is the possibility of releasing them from arrest if the sanctions are lifted, without being committed to a dozen years of litigation. It is a lot to absorb.
Large tenders have AIS. Often when the yacht is in covered drydock for a refit and such, the tenders still are outside and have their AIS on. Vava II's owner probably is worried about his safety and that of his family. Kidnapping risks etc.

Physics explains everything...There is a possibility that Vava2 shrank from constant exposure to water, especially if the water was cold.

Statute of limitation usually applies from the last event on the case (eg. if police each year send a letter to the last known address that could extend it forever), could be different in Italy of course.
My guess regarding Flavio and Bernie is they hatched a plot for Bernie to buy the boat knowing full well Flavio will get compensation or that he is just buying his boat back via Bernie
Bernie only does things for money. This pair have done loads of deals together over the years. They even owned a Soccer team

The Vava ii/Romulus owner is playin' tricky tricky and hidin' from someone, or something. It's like the guy in the bar who calls out "I'm not here!" every time the phone rings 'cause he's hidin' from his wife haaahaha! The situation with the Force Blue is gettin' even messier and Signore Briatore is more than a little shady it would appear. What a world that superyacht world is, I thank goodness I can't pay the price of admission because I'd surely be the one who somehow takes the fall for all of the others heh, heh. Great video!

eSysman, or anyone who knows: has there ever been any legal consequences for a ship NOT to broadcast AIS? Seems to me that this law is quite a toothless tiger and not worth the paper written on because there is lots of non AIS broadcasting but nothing ever happens, right?
It's not as if they are like airplanes and move from country to country within minutes.
These things travel at 20mph, rarely more.
The AIS is only switched off at anchor - Like a plane parked in an airport.
Where is the issue ? Anybody looking for the ship can find it. As he said - It's hiding in full view. All it does is stop geeks from tracking his boats whereabouts while at anchor.
A common occurrence in St Barths is to turn off the AIS, but to continue broadcasting the tender name, length and location. Is Romulus the 8m tender parked next to (or within) MY Vava?
Our yacht had a different name for the towed (frequently) pursuit . Both were fitted with AIS …handy for night navigation or were we to lose the pursuit …it’s quite common for fairly large yachts . Thought you would have known this .
I'm guessing the very large Super yachts the eSysman works on do not tow their tenders! and if they did they would not be so unprofessional as to regularly loose them like you appeared to do. I would have thought you would have learned how to tie a knot, especially after the first few times it happened.!!
Yes tenders are fitted with AIS, but usually their naming scheme is T/T Vava II etc. and if it’s their tender broadcasting, why is the boat not broadcasting its AIS? For the last three years?
You failed to mention that Flavio Briatore was also banned from F1 in, I believe 2009 or thereabouts, after allegations of race fixing. I think it was know as the ‘crashgate’ scandal and involved driver Nelson Piquet Jr deliberately crashing his car (allegedly under instructions from Flavio Briatore) in the Singapore GP to aid his team mate's, (Fernando Alonso) points position. I seem to remember Ron Dennis having some involvement but I could be wrong on that point.

Vava II has a a bunch of tenders. There is one that is styled after the Vava II. I don’t think they are selling or changing the name. I’ve seen her on Maui and in Miami. My favorite designed yacht. I bet the AIS is running on that tender.

Very simple explained, i had the same situation with my vessel. My marifoon was broken and brought it to the shop. Didn't get it repaired bought a new unit and the old one found its way into the market and transmitting false data

I don't get why the authorities are not firmer with boats turning of AIS, this is first a security issue and also very shady. It would be easy to stop that trend, any captain turning it off lose his license for 5 years, and the boat gets a 10% of its value fine the first time, doubled the second time,...

I actually saw the VAVA II (And took some photo's) which was at the time owned by Ernesto Bertarelli and his UK Miss World wife Kirsty at the time back in 2016. Saw this docked in Cape Town at the V&A Waterfront. Sporting a nice pair of Harley Davidsons.
Note: The former F1 Renault owner Flavio Briatore you titled Ernesto Bertarelli, funny since Bernie Ecclestone is also under investigation for Tax evasion.

We were there at anchor in Portofino and saw them there as well and didn’t see them on AIS and thought that was weird

They have been doing that for years (The tenders are named Romulus and Remus, yacht itself is usually Lac Leman).
Actually I'm not sure now, but they definitely use these three names.
Something iv always wanted to know is when a person goes from country to country do they check in with their passports do they need visas do they do it beforehand or when they get there? Same with the crew?

What jurisdiction gets registration fees from these super_yachts and does it cover expenses accrued from ports where SYs choose to tie up? Reg fees would seem to be larger than broadcasting fees if there are any.
Here's a question, how do motor super yachts and sail super yachts costs of running compare. On the one hand you have high fuel costs but then on the other hand are sail crews more expensive given the skill levels required by a percentage of the crew?

Italy has a very strange take on the Statue of Limitations. Other countries you have to file charges within a certain time limit, but the case can go on forever. Italy you have to exhaust all appeals to the Supreme court before the Statue of Limitations expire. So a lot of rich people just fight the charges until the statue of limitations expire, including prime ministers, while people who can't afford lawyers for quite a few years end up with criminal records.

@@YachtReport my thought process was that they're intentionally keeping the AIS off on the yacht to keep from prying eyes, yet turning it on on the tender to tell people they want to know where they are, since the tender is predominantly inside (or nearby) the big boat. Just a thought.
