I was a police officer for over 15 years, and I know for sure that law enforcement is the only profession that a person can be 100% incompetent and still keep his job.

They've got video, I suspect from multiple angles from the gas station of her handing over the card to who she thought was the owner. There is probably video of the license plate on the vehicle, or credit card info from the driver's purchase at the pump. I suspect that it wouldn't take much investigation to actually ID who the card was given to... but they don't want that because they already screwed up and would rather stick with their story for arresting her. I can see why the judge ridiculed the police case... she asked for a lawyer... BY LAW and the constitution, THAT ENDS the questioning right then and there... way way way more so than the bullshit of a "I want to remain silent" which is almost always followed up with "Why?" in an attempt to keep you talking. Never talk to the police... in her situation, rather than thinking, "Oh that's me.. let me go clear that up, I obviously didn't do anything wrong." Don't talk to the police, talk to and through an attorney.
I disagree. He should have charged any officer and prosecutor with contempt of court and recommended to the appropriate jurisdiction for prosecution on charges of malicious prosecution. As a judge I would let it be known that anyone involved in the arrest and attempted prosecution of this woman will never be afforded any credibility in my court room.
That happened with me but I wasn’t arrested!! Someone left their cellphone in the store and when I asked who’s phone is it a lady claimed it and I handed it to her and then the real owner came back to get it and I told her what happened and she asked me to call it and the person answered. The person that stole it did bring it back because the owner told her she was tracking it from my phone and going to call the police!!! She really thanked me for telling the truth about it and helping her get it back.
There has to be criminal intent in order for her to be guilty. She is not a criminal.for trying to help someone. Most people are in their own world and they literally do not care about anyone else. Yet we have an honest woman who thought she was actually helping someone. So now the police want to ruin her life since they can't catch the other woman? Disturbing.
They got that call about the credit card and figured as soon as they saw a black person, they jumped right on her! One thing that the cops got dead wrong, once they read her rights she wasn't free to go! Another mess up, as soon as the detainee asks for counsel, the interrogation should have stopped right there and then! The D.P.D. needs vetting, and firing and these officers should do time in jail for not only violating department policies but lying and accusing an innocent person of a crime that person didn't commit!

Since this case involves assault and kidnapping of the person deprived of their rights the death penalty is on the table. This is were accountability has to be to rid us of bad cops.

I have picked up a bank card and handed it to someone who identified themselves as the owner. The only differences between her and I are bad luck for her, and the fact that I would never, ever, ever talk to a cop without a lawyer present (ever). It's just a lesson we all need to learn. Too many police and prosecutors don't care about justice, fairness, or even solving crime. They want to maintain the illusion that they're doing a good job, and arrests support that illusion. Guilt is meaningless.

The right thing would be to let the clerk know that there's a lost card still in the machine and let the clerk grab the card. She forgot to do that and instead give it to a criminal whom she didn't know but assumed it was the rightful owner.
Quite a lot of British tourists have gotten themselves shot in the US by calling the cops to report something and then acting 'strange' when the cops turned up. If you are in any kind of minority group anywhere you should just walk on by when something happens, I didn't see, I didn't know, nothing to do with me should be your motto. Basically you have to protect yourself from instant judgement calls and not get involved with any matter or touch anything like money that has fallen or help someone who has fallen off a bike or whatever. Like if you help someone who has fallen off a bike to some other observer you pushed the person off the bike and are mugging them, cops called, .. clipped with a 9.
She never viewed the card as lost because in her mind she returned it to who she thought was the rightful owner. So when they questioned her and said lost or stolen card the incident in question never rang a bell. So glad she’s doing better.
Plus it was a 5 minute interaction between the two. Most people don't remember an incident that lasted 5 minutes and was weeks ago. Any other time she probably would have given to the guy behind the counter but she thought that the lady who just left was the owner who said that she was the owner.
Depends on the state law. I'm a retired attorney (but not licensed in Michigan) and probably what she did fits the definition of accessory to theft. Many of the prosecutors especially for minor crimes are fresh out of law school. They do whatever the police tell them to do. From this video, you quickly see who is in charge; the POLICE. They clearly violated her constitutional rights which is very clear that when someone says they want an attorney all conversation stops. Period. The fact that the police spokesperson doesn't know this basic tenet of the law speaks volumes about Detroit!
This is another lesson on why you should NEVER, EVER talk to the police officer on your own or without an attorney present. Regardless of the circumstances, whether it's at the scene or if they come to your house at the station, and even if you have to sit there in cuffs locked up and wait for an opportunity to make a phone call (especially then, because half the time they use that to scare you into incriminating yourself). No police officer, under any circumstances, can EVER be trusted in conversation, they aren't making small talk, they aren't your friend and the don't give a shit about you. They are NEVER out to seek the truth or what's in your best interest, they see you as a criminal and their only goal is to make a case against you.

I agree, but the cops can ask you anything they want. You simply have the right to not respond. There is no explicit right not to be questioned. Your best play in such a scenario is to clearly and calmly say "I am exercising my right to remain silent until legal counsel is present", and then say NOTHING else. Not a word, under any circumstances. If pressed, repeat "I am exercising my right to remain silent until legal counsel is present". That is the only thing you say. The police should have stopped questioning, but they were under no obligation to. I think that's where a lot of people get confused. Then they get upset that they're still being questioned, and that leads them to try a different tactic and explain themselves. The cops know this and will keep asking in hopes that the person will break and start talking. You have to expect relentless badgering, condescension, intimidation, and you have to hold your ground and say nothing.

If they questioned her after the handcuffs went on, then you're right. But if she just walks into a police station of her own accord, they can ask as many questions as they like. They can't prolong detainment for questioning after she asserts her right to not answer, but I was under the impression she was not detained at that point. I could be wrong. It comes down to when she was actually arrested. The moment she was not free to leave, then they should have stopped the questions.
@@Arkryal Being under arrest or not is irrelevent in this situation. She was in a police station being questioned and accused of a crime. She asserted her Miranda rights on her own. At that point the questioning stops. Frequently people are questioned about crimes without being under arrest first and before the interview many times the cops/detective will read the person their Miranda rights before the questioning. In this case the idiot police department is trying to claim that they didnt violate her constitutional rights because of what you said, that she was not under arrest at the time so it doesnt count. They should not be in law enforcement with such a clear misunderstanding of how Miranda rights work. It does work that way in things like traffic stops where the cop can question you immediately after being pulled over without reading you your Miranda rights. But if there are detectives questioning you about a crime in ANY situation and you make it clear you will not answer questions without a lawyer present, if they dont shut up, anything that happens after may be thrown out and they may be found to have violated your rights.
Sandra’s integrity is beyond approach. She stepped up to do the right thing and the Judge confirmed it. With his confirmation of the moral character that she has the company that kicked her to the curb lost their best employee. It’s awesome that other companies saw her character, values and wanted her as a member of their company. That speaks volumes of her and those that reached out to hire her. Young Lady has something that was instilled in her as she was growing up. Never sell your integrity out, never change your Morals and your Values just to appease someone. When I’m upset I remember things wrong. And I hate being asked to repeat something that was so insignificant because I can’t, simple as that. It was an insignificant encounter and I can’t recall. You can see she asked the Clerk something and he probably told her it was the lady that just left or he didn’t know. I always ask what’s the name on the I’d or card, only because I use to work in a gas station. So it’s habit. The average person, is not going to have the same mindset. I can understand her thinking she might of gave it to the clerk, maybe she thought of a different instance. It was almost two weeks ago. I’ve gotten myself in situations because of my temper and forgetting details or misrepresentation of facts, it happens, and it’s not intentional. Lawyers are not free unless you're charged with a crime and are assigned one by the court. How can she foresee that what she thought was a simple mistake would lead to charges? How can she pay a $2-3K retainer for something she did not do? I have a good job and some savings, even I would think twice to spend on an attorney for something I know I am innocent of.
I saw this story about a month ago and I'm glad she was able to keep her house and find a job. Really happy for her, no one deserves that kind of injustice and kudos to the judge who had enough common sense in this charade of investigation

The trouble is "Qualified Immunity" is nearly always treated by the justice system as completely unqualified immunity; you usually have to murder someone in cold blood to be blamed for your actions as a police officer. Judges and DAs are to blame for the system not working properly; more police officers should have the immunity from prosecution removed. They just don't give sh*t in many cases.
Yet another example of why, if you didn't see it, it didn't happen. She didn't actually see who left the card. At best, I would have given the card to the cashier instead -- but after this, for sure, I wouldn't even touch it.

As an English lawyer & part time Crown prosecutor from England for over 20 years this case strengthens my belief that the standard law of enforcement & local DA’s legal knowledge is total garbage. This would not happen in advanced countries who have a higher standard of legal & evidential knowledge. Thank god for a competent judge. I remember being in a grocery store and was looking at one of the shelves, and when I turned around, a cop happened to be walking by, so I was kinda spooked, just as I would be if anyone suddenly walked by and startled me. Who knows, probably just gave me a funny look, but most people would have a more surprised look than a look of "I think you're doing something wrong". That's just the vibe I got from him. If you find a credit card, cell phone, wallet, etc. , hand it to the store clerk and tell them where and a what time you found it. If they return it or no t is gonna be their problem now, not yours.

They've got video, I suspect from multiple angles from the gas station of her handing over the card to who she thought was the owner. There is probably video of the license plate on the vehicle, or credit card info from the driver's purchase at the pump. I suspect that it wouldn't take much investigation to actually ID who the card was given to... but they don't want that because they already screwed up and would rather stick with their story for arresting her. I can see why the judge ridiculed the police case... she asked for a lawyer... BY LAW and the constitution, THAT ENDS the questioning right then and there... way way way more so than the bullshit of a "I want to remain silent" which is almost always followed up with "Why?" in an attempt to keep you talking. Never talk to the police... in her situation, rather than thinking, "Oh that's me.. let me go clear that up, I obviously didn't do anything wrong." Don't talk to the police, talk to and through an attorney.
I'm suspicious this was a "sting" that went wrong and they wont admit it.

That happened with me but I wasn’t arrested!! Someone left their cellphone in the store and when I asked who’s phone is it a lady claimed it and I handed it to her and then the real owner came back to get it and I told her what happened and she asked me to call it and the person answered. The person that stole it did bring it back because the owner told her she was tracking it from my phone and going to call the police!!! She really thanked me for telling the truth about it and helping her get it back.

I have picked up a bank card and handed it to someone who identified themselves as the owner. The only differences between her and I are bad luck for her, and the fact that I would never, ever, ever talk to a cop without a lawyer present (ever). It's just a lesson we all need to learn. Too many police and prosecutors don't care about justice, fairness, or even solving crime. They want to maintain the illusion that they're doing a good job, and arrests support that illusion. Guilt is meaningless.

The right thing would be to let the clerk know that there's a lost card still in the machine and let the clerk grab the card. She forgot to do that and instead give it to a criminal whom she didn't know but assumed it was the rightful owner.
Quite a lot of British tourists have gotten themselves shot in the US by calling the cops to report something and then acting 'strange' when the cops turned up. If you are in any kind of minority group anywhere you should just walk on by when something happens, I didn't see, I didn't know, nothing to do with me should be your motto.
Basically you have to protect yourself from instant judgement calls and not get involved with any matter or touch anything like money that has fallen or help someone who has fallen off a bike or whatever.
Like if you help someone who has fallen off a bike to some other observer you pushed the person off the bike and are mugging them, cops called, .. clipped with a 9.

She never viewed the card as lost because in her mind she returned it to who she thought was the rightful owner. So when they questioned her and said lost or stolen card the incident in question never rang a bell. So glad she’s doing better.
Plus it was a 5 minute interaction between the two. Most people don't remember an incident that lasted 5 minutes and was weeks ago. Any other time she probably would have given to the guy behind the counter but she thought that the lady who just left was the owner who said that she was the owner.

Depends on the state law. I'm a retired attorney (but not licensed in Michigan) and probably what she did fits the definition of accessory to theft. Many of the prosecutors especially for minor crimes are fresh out of law school. They do whatever the police tell them to do. From this video, you quickly see who is in charge; the POLICE. They clearly violated her constitutional rights which is very clear that when someone says they want an attorney all conversation stops. Period. The fact that the police spokesperson doesn't know this basic tenet of the law speaks volumes about Detroit!

This is another lesson on why you should NEVER, EVER talk to the police officer on your own or without an attorney present. Regardless of the circumstances, whether it's at the scene or if they come to your house at the station, and even if you have to sit there in cuffs locked up and wait for an opportunity to make a phone call (especially then, because half the time they use that to scare you into incriminating yourself). No police officer, under any circumstances, can EVER be trusted in conversation, they aren't making small talk, they aren't your friend and the don't give a shit about you. They are NEVER out to seek the truth or what's in your best interest, they see you as a criminal and their only goal is to make a case against you.

Your best play in such a scenario is to clearly and calmly say "I am exercising my right to remain silent until legal counsel is present", and then say NOTHING else. Not a word, under any circumstances. If pressed, repeat "I am exercising my right to remain silent until legal counsel is present". That is the only thing you say.
The police should have stopped questioning, but they were under no obligation to. I think that's where a lot of people get confused. Then they get upset that they're still being questioned, and that leads them to try a different tactic and explain themselves. The cops know this and will keep asking in hopes that the person will break and start talking. You have to expect relentless badgering, condescension, intimidation, and you have to hold your ground and say nothing.

If they questioned her after the handcuffs went on, then you're right. But if she just walks into a police station of her own accord, they can ask as many questions as they like. It comes down to when she was actually arrested. The moment she was not free to leave, then they should have stopped the questions.
@@Arkryal Being under arrest or not is irrelevent in this situation. She was in a police station being questioned and accused of a crime. She asserted her Miranda rights on her own. At that point the questioning stops. Frequently people are questioned about crimes without being under arrest first and before the interview many times the cops/detective will read the person their Miranda rights before the questioning. In this case the idiot police department is trying to claim that they didnt violate her constitutional rights because of what you said, that she was not under arrest at the time so it doesnt count. They should not be in law enforcement with such a clear misunderstanding of how Miranda rights work. It does work that way in things like traffic stops where the cop can question you immediately after being pulled over without reading you your Miranda rights. But if there are detectives questioning you about a crime in ANY situation and you make it clear you will not answer questions without a lawyer present, if they dont shut up, anything that happens after may be thrown out and they may be found to have violated your rights.

With his confirmation of the moral character that she has the company that kicked her to the curb lost their best employee. It’s awesome that other companies saw her character, values and wanted her as a member of their company. That speaks volumes of her and those that reached out to hire her. You can see she asked the Clerk something and he probably told her it was the lady that just left or he didn’t know. I always ask what’s the name on the I’d or card, only because I use to work in a gas station. So it’s habit. The average person, is not going to have the same mindset. I can understand her thinking she might of gave it to the clerk, maybe she thought of a different instance. It was almost two weeks ago. I’ve gotten myself in situations because of my temper and forgetting details or misrepresentation of facts, it happens, and it’s not intentional. The trouble is "Qualified Immunity" is nearly always treated by the justice system as completely unqualified immunity; you usually have to murder someone in cold blood to be blamed for your actions as a police officer. Judges and DAs are to blame for the system not working properly; more police officers should have the immunity from prosecution removed. They just don't give sh*t in many cases.
Yet another example of why, if you didn't see it, it didn't happen. She didn't actually see who left the card. At best, I would have given the card to the cashier instead -- but after this, for sure, I wouldn't even touch it.

The law is clear about intentionality in criminal indictment. If a person had no intention of stealing a credit card, the case will be tossed out by the judge!
You can't fix something if you say "you did nothing wrong". This is another reminder to never talk to police without an attorney. Especially if you are innocent do not talk to police, it can never help it can only hurt you. The police are not your friend.

@Queen NitaBo That's what threw her off is the woman saying immemdiately the card belonged to her when she TRIED to give it to the clerk. She should have told the lady even if it would have caused mess, I will give it to the clerk and if he wants to give it to you then you take it from his hands, not mine.
If you find a credit card, cell phone, wallet, etc. , hand it to the store clerk and tell them where and a what time you found it. If they return it or no t is gonna be their problem now, not yours.

How could they NOT know who she gave the card to? She walked out to that minivan and I can assure you there are cameras all over that station! Yep, DPD did a VERY poor investigation for this case. Also, it was said the other woman, the one she gave the card to used it after. I'm sure wherever she did had cameras all over the place too! Remember, Big Brother is ALWAYS watching!!!
Yeap. One thing I don't understand is, if Sandra is a security guard, why didn't she verify the identity of the person she handed the card to. All she needed to do was ask for Identification, and problem solved. In my opinion she kinda brought it upon herself.
Of course they are going to deny any wrongdoing. They will instantly lose a civil suit for illegal arrest and malicious prosecution if they admit to anything.

The officer's ego won't allow them to apologize even if it makes them look foolish trying to prosecute such a petty case . They will end up paying a settlement and they will still claim that they were right. This is what happens when you don't have common sense.
