    I'm up for correction here but if the ex-partner paid the lobola in whole or in part, I believe they're still married in customary law even if the lobola was returned or the said meeting occurred. Either party could apply to the court to have the marriage recognized/dissolved because the law does not give people the authority to divorce outside the avenue of the courts. Hopefully, this doesn't end badly for either party.

      Ukugcagca is the official Zulu marriage and they didn’t do it. That why she said they only had a family meeting. Lobola is equivalent to proposal

      True but when you have kids it's kind of get forfeited so you can't claim back your lobola when we are raising your kids, unregistered with home affairs customary marriages awekho complicated

      @@Zee1226_ While I understand that, that's not the case in the eyes of the law. The requirements of a valid customary marriage are set and in the above case were fulfilled. Remember our customary law has to cover most of the other indigenous cultures too, that's why it's so broad.

The marriage need not be celebrated as stated above. Obviously, deeper investigations into case law and other parts of the law need to be held but it remains that "entered into" is enough.

      She indicated that they called families when they separated, which means there was letters/minutes in writing that served as agreements, but I stand to be corrected

      ​@@BonClyfulIt's not about just money. It might make any other marriage thereafter null in void for both parties. Complete resolution is needed. People are unpredictable, either one of them can back track on that agreement out of spite. Learn the law
