      A lot of people are theorizing that his ego was a big part of the reason he lost. Not only did he sideline a great defense lawyer, most likely because she was a woman, but he also allegedly forced his lawyers to say what he wanted them to, aka to consistently bash Cohen and deny the encounter with Daniels ever existed.

      The average citizen can't afford all the appeals, judge shopping in far off counties, and time spent in court to delay and fight. It's definitely a two tiered system, one for the rich, and one for the poor.

    I remember when misspelling the word potato was grounds for voters not wanting to vote for someone. Even a guy yelling 'Yaaaaa!' in his speech was enough to tank someone's campaign. Sadly these days people will accept just about anything including a woman who has been arrested before many times and even racism isn't enough for some people to not vote for someone.

    I wasn't happy when I heard the verdict. I was profoundly sad. Not over the conviction. It makes me sad knowing none of this means anything. He can still run for president and vote, and won't get punished any more severely than probation. White collar crimes are only punished with a slap on the wrist while blue collar crimes destroy lives.

    Why can't he get given community service for a few hundred hours? Custodial would be ridiculous (secret service), a fine is meaningless (because they're capped), make the man who has NEVER done a full days work pick up trash on the highway.

      Yes. Vote for the other guy so the felon doesn't win. There are a few other methods that aren't as likely to succeed. BUT, if political opponents could be barred from running by giving them a felony charge, then using the DOJ against your political opponents would be an effective means to stop their campaign, and Trump could legitimately claim that they are trying to stop him from running...which means his cries are crocodile tears, since he absolutely can still run, even if they threw his sorry butt in prison, and he knows it. But his voters are mostly ignoramuses' so his appeals of political persecution will work on them and the corporate media outlets won't inform the public because they are oligarch simps that are okay with fascism.

    I dont understand why he cant go to jail or prison because of the secret service. Treat him like they treat every person who may be in danger because of who they are. Put him in solitary confinment with secret service standing outside the door. Why is that so hard? They do this all the time. No ones above the law right?

      As far as I'm aware, none of that's considered in what makes a first offense, but the judge will have some leeway to factor it all in. You don't need to convince me that man should be in prison for the rest of his pitiful life, but it's not reasonable to expect it from this trial.

    If a poor minority member were to get convicted of 34 felonies at once, they'd be given an extremely harsh sentence. Not giving him some sort of actual jail sentence would absolutely be a bias.

      @@kurtwicklund8901- The “pot calling the kettle black” might want to look at the difference between sentences for misdemeanors and what happens to those misdemeanors when elevated to felonies, particularly _why_ they were elevated to felonies.
      It sticks in my craw that DJT will never get comeuppance for the hundreds of thousands of excess COVID deaths caused by his inept response, and especially his fomentation of an anti-mask, anti-vax, and anti-science movement. Those hundreds of thousands were just in the US alone, and the effects of his anti-(everything good) movement are far from over.
      This case involves crimes which, very likely, helped him become president, therefore enabling the aforementioned, so we shouldn’t take kindly to its being swept under the rug as an overblown misdemeanor without prior jail time sentencing in NY.
      There is _nothing_ “prior” about DJT, and we should treat him accordingly.

    People, please. It's not about the lesser of 2 evils... it's about the lesser of who is actually truly evil. Biden isn't the best, but he's far better than the worst. It's such a shame that the democratic party seems so obsessed on making sure it self-destructs. We really need to start voting for people who are young enough to actually make change. Someone who is nearly 80, in a more broad form of a minority (65+)17%, CANNOT speak for the majority of the country, that is under 65. Which is 83% of the country. The 65 retirement age should be STRICTLY implemented for government positions.

      Ok, I agree with your main point about Biden, and about wanting younger people in office. That said, minorities of all kinds have a right to run for office. Voters can decide which candidate will better represent them. And lots of people work past 65, often out of financial necessity. If an organization can give good financial incentives to retire, great. But we shouldn’t force people to lose their income for arbitrary reasons. As long as they’re still capable of doing a job, they have a right to work.

      @catsmom129 ok but if you've held any position like congress, president, vp... they get this thing called a "civil service retirement system." Basically it's like getting $175k/y for sitting at one of their vacation homes drinking martinis on a Monday morning.
      And when we are talking about a minority like age in politics... no. Not at all. Not when it comes to making decisions based on the country. They've proven time and time again that they don't respect the younger generations. Just look at the 2016 election. The 2020 election. They have fucked up consistently for over 10 years now. It's time to force retirement on politicians. They can get a civilian job after, if they want to keep working. Because yes. They deserve to work if they want. Just not in politics.

      Great? This Stormy Daniels thing has been running for almost 8 years now! It took our justice system 8 years to hold this man accountable. He had already finished a Presidential term of office and probably committed hundreds of other crimes by the time this conviction came down. This case still does not keep this twice impeached convicted felon from the White House. In all likelihood he'll be back in the White House before he sees a conviction from the other 3 trials against him and we'll probably never hear from any of those after he does.
      It seems to me that our Justice system has failed almost as spectacularly as our Legislative bodies did to check Executive power.

      Did you do anything in these past few years? If not, it's just delaying the inevitable. People need to work on organizing. The oligarchs have a plan(Project 2025) and are ready to go should a Republican win, I haven't seen any evidence of anyone working towards that on the "left" in the past few years.       I would also understand people voting 3rd party and for the policies they actually agree with.
      Never the less, it ain't over till the fat lady has sung.
      I am mentally prepped to deal with hearing Trump won the elections.

      It being from the right would keep the left more alert and awake, but also would make the fight harder.
      The false trust in team blue is part of the problem. So a vote for Biden is also a vote for Harris, and the continuation of Clinton politics.
      Trump win would be a possible dictatorship and maybe a civil war. But his lose might also trigger a form of a civil uprising (war).
      A 3rd party win, how unlikely this might be, would be a break with the standard.
      Never-the-less; what is the plan?
      Biden wins in your ideal situation... then what? Life goes on as usual?
      Bidens new bill (antisemitic act, HR 6090 can be a problem for all types of protesters, not just the pro-Palestine protesters. Resistance could be labeled terrorism, all kinds of "resistance". Fascism from the left. IMHO.

      The NDA and hush money was to hide the affair he had 20 years ago. Affairs aren’t illegal. Here are the details you’re looking for.
      1. Alvin Bragg engaged in Selective Prosecution. There’s precedent on this. Trump is being charged with recording the payments as legal expenses instead of campaign expenses. Keep in mind that these payments were being made to his lawyer. (There were 34 payments so that’s how they arrived at 34 counts.) In 2022, the Federal Election Commission (FEC) determined that Hilary Clinton committed the SAME campaign finance violation when she funded the Steele Dossier (to get dirt on Trump) and she recorded the payments as legal expenses instead of campaign finance expenses. Her campaign was headquartered in NYC (same jurisdiction as Trump) and they did not prosecute her. They only fined her $8,000. → (That’s the precedent.) Additionally, when Alvin Bragg was running for office, he said over and over that he was the best candidate to go after Trump. He repeatedly denounced Trump’s policies. Once he got into office, he literally went out of his way to look for crimes that he could prosecute Trump for. His office floated around several ideas until they settled on this one. A very common phrase in Stalinist Russia was, “Show me the man and I’ll show you the crime.” This is exactly what he did. Also, let’s not forget there’s precedent.
      2. It violated his 6th amendment right to not tell him what he is being charged with. Not only is this in the constitution, but there’s also precedent for this as well. Falsifying business records is only the primary charge, there’s a part B to that, which they refused to reveal even after it was requested.
      3. Unanimity is required in all felony prosecutions. Falsifying business records is a misdemeanor but falsifying business record with the intent to conceal a second crime is a felony. The jury was not unanimous about the second crime because the judge said they didn’t have to be since the judge was going off of New York State law. However, this is a felony prosecution so constitutional law trumps New York State law and the jury has to be unanimous on the second crime as well. For example, if there are 6 jurors who believe a defendant killed a man but they think he shot him, and the other 6 jurors also believed the defendant killed a man but they think he stabbed him, that is not unanimous. The New York election statute says it’s illegal for two or more people to agree to work in concert to influence an election through unlawful means (i.e., by violating some other statute) and Judge Merchan told the jury that they did NOT have to be unanimous with respect to those unlawful means. The judge mentioned a few different theories: (a) It could be a tax law violation, (b) It could be a campaign finance violation, (c) It could be a violation of New York’s business records falsification statute, which in itself introduces a second element to the case, which would actually be a third element.
      4. Not only is it illegal for judges to make campaign donations, the fact that Judge Merchan made a $35 donation to the Biden campaign shows his partiality. That by itself isn’t catastrophic, but the fact that Judge Merchan’s daughter stands to make millions if Trump is convicted is enough that he should’ve recused himself. His daughter runs a progressive political agency that does fundraisers and the Biden-Harris campaign is her client.
      These are just to name a few.
      He’s technically not convicted until the judge delivers the conviction. That will most likely happen on July 11th unless something changes before then.

I am hoping that the few people sitting on the fence, but who are staunch old-school Republicans who are black-and-white thinkers will decide they can't vote for a convicted criminal into office.

    I forget the lady's name, but she had released a 3-or-so-hours-long video about voting in the 2024 election a while back, and one thing she said that really stuck out to me was essentially: don't think of it as voting for the lesser of two evils; think of it as voting for the person who is a weaker opponent to you legally. As in, vote for the one who will stand in your way the least. For me, that's absolutely Biden. Gaza is unforgivable, but so was Iraq and Afghanistan under Bush, Obama and Trump.

      That argument isn't strong at all. Blood is already on our hands, okay, we're already complicit in the deaths of millions, I agree, but voting Biden won't change that at all, he's looking the other way as Republicans are subpoenaing college and university presidents pressuring them to call in the booted thugs to bloody the heads of students, and he's giving Israel the green light and the means to bombing people to extinction, he hasn't changed position on that at all, and he and the Democrats are also failing to organize against or present any counter to Project 2025, which means if we the people don't start organizing, we're doomed to be ruled by fascists eventually, voting Biden may delay it a little longer, but he's doing nothing to stop it and voting him in will mean more blood on our already blood soaked hands. So it's completely understandable if people cannot bring themselves to vote for either of these two horrible options, but for the love of good, people need to start organizing or face the reality of the consequences to their actions/inactions.
      I'll vote Biden to give people the best chance they have, more time to start organizing. But if they don't organize, which I haven't seen much evidence of happening for the past few years, they're doomed.

    Hopefully this case isn’t appealed up to the supreme court, while it’s EXTREMELY rare for a state case to be appealed all the way to the supreme court, it also used to be rare that a supreme court would repeal a decision with a 50 year precedent, take up a case that a president has full immunity after it was already determined by a federal appeals court that it was a resounding no, a president doesn’t have full immunity, and a supreme court that doesn’t recuse themselves when their wife had involvement in Jan 6, as well as another who hung an American flag upside down after Jan 6.       He’s technically not convicted until the judge delivers the conviction. That will most likely happen on July 11th unless something changes before then.

    If voting between the lesser of two evils wis ‘just how it is’, seems pretty fucking clear we need a new system. Now, tell me, how will voting for the two major parties who stand to benefit from maintaining this system get us out of this conundrum? It IS still the lesser of two evils, but how do we fix that being our choice to begin with?

    Re: not allowing the jury to have/read the court transcript, another analyst said that the transcript includes *everything*, including things the jury may not have been privy to, such as asides/conversations between prosecutors/defense lawyers at the bench, which might be prejudicial. I do find it odd that the jury instructions wouldn’t be printed for them for reference.

    It is ridiculous the jury is not allowed the written instructions or transcript. If they know any information they may miss in the witness box will be supplied later, they are better able to watch the body language, tone of voice and demeanour. They can make notes of anything that strikes them.
    The problem will be the jury will not be able to remember all the evidence.
    I think it is rather bizarre the jury is not allowed to discuss the case with each other until the judge delivers his instructions.

      A juror is allowed to take notes. They also get a copy of the jury instructions during deliberations. Also, during deliberations, they can request to have any testimony they choose re-read to them. Further, in the deliberation room jurors are given a hard copy of all exhibits entered into evidence during the trial. These exhibits are agreed upon by both sides. Trial exhibits can include important parts of deposition testimony that witnesses usually testify to when on the stand. Have you ever been a juror or worked on a trial? I recommend sitting on at least one jury in your lifetime.

      @@Purplenpinkk Unfortunately I am ineligible to sit on a jury, because in Australia lawyers are ineligible to serve on juries. So I was surprised to hear there were 2 lawyers on Trump’s jury. Most lawyers here would love to serve on a jury.
      I have always thought it ridiculous that jurors cannot get the transcript, but have to rely on their own notes. I do not work in criminal law, but I have worked on dozens of trials, including many years ago some civil jury trials. I have a table when I am taking notes during a trial, and I am hopeless at it. I do not look at the witness because I cannot take notes and watch the witness’s demeanour at the same time.
      If you could see the way the jury box in the Supreme Court building in Sydney is set up, then you would realise how unrealistic it is to expect the jurors to take their own notes. The Court may have changed the set up for jurors since I did a jury trial. However from my memory the jury have just seats and nothing to lean their note pads on, so taking notes would be cumbersome and uncomfortable. Of course this is just my opinion.
      However, if jurors knew they did not have to take notes because they would get the transcript, they could concentrate on the witness’s body language and demeanour.

    Karen Frieman Agnifilo on the Maidas Touch network, who used to be the #2 prosecutor in the same DA office, explained that the court transcription includes objections, sidebars, and other parts of the official record of the procedings in the court that are not intended to be heard by the jury. They end up calling the actual person who was present and made the the original notes to perform the readback of testimony for the jury.

    I've been hearing the same nonsense about voting since I cast my first vote in the 80s. I have voted for both Democrats and third-party candidates based on my personal convictions, and I will continue to do so. I voted for Ralph Nader in 2000, and if I had the power to go back in time, I would do exactly the same thing again because I could not in good conscience vote for either Gore or Bush. I have watched voting for the lesser two evils steadily march the entire U.S. political system further to the right over the course of my lifetime, and it is exactly this rightward movement of the Overton Window that allows Trump to exist. Democrats should have rebelled when the Third Way neoliberals took over the party in the 90s but instead, they just kept marching in lockstep giving us terrible candidates like Hilary Clinton and Joe Biden. If the Democrats want my vote, they need a hell of a lot more than "not as bad as Trump."

    One thing I don’t think I’ve seen through all of this since that you kind of hinted at was: what was Trump’s motivation for covering this up? Saving his marriage? Public opinion for his first run for president? Losing donors?
    It seems like he’d have more support from his base over an affair with a p-- star (because small brain); over the loss he’d have for a felony conviction. Especially with all the wild stuff he’s done since, this feels relatively tame to cover up so heavily

    I've always been doubtful that Trump will see jail time. But then I started thinking that a fair judge would want Trump to serve a sentence equal in severity to whatever one of his underlings served. It really would be a travesty of justice if Trump didn't do time equal to what Cohen served.
