40 Y/O Gets Angry At Deputy After Receiving His 7th DWI Charge

Deputy’s report:
On 12/26/23 at approximately 1853 hrs, I responded to **** Rio Grande Blvd NW in reference to a single vehicle versus a fence crash. Upon arrival, I observed a gold Toyota Tacoma pickup truck, crashed through a cinder block fence, stuck. There was a male identified as John Samuel, who was standing outside the pickup truck that appeared to be disoriented. John stated the pickup belonged to him and admitted to being the sole occupant and driver of the pickup when asked. John had no complaints of injuries and refused to be assessed by medical personnel who were on scene. I separated John from the crash scene and had him walk over to the front of my emergency vehicle. John stated the homeowner came out of his residence and got "freaked out" about what happened. John said he called his friend to come help him after crashing. Just as John said this, I noticed he had a fresh abrasion on the top of his head. I had John be checked out by medical personnel for this abrasion.
While John was being looked at by medical personnel, I walked over to the homeowner who was still outside near the crashed pickup truck. According to the homeowner, he went outside to look for his wife and discovered a pickup truck had crashed through his fence. Next to the pickup truck was John standing outside his vehicle. The homeowner said John told him not to worry and he would fix his fence. The homeowner let John borrow his cell phone to supposedly call his insurance but instead called a friend to come to the scene. John then asked the homeowner for a sledge hammer but he did not have one. John's pickup truck was stuck in place as there was several cinder blocks from the fence underneath it. Inside the pickup truck, I observed a Crown Royal whiskey bottle underneath the driver's seat. I picked up the bottle from the floorboard and saw that it was missing the cap. The bottle was nearly empty but still contained a small amount of liquid inside the bottle. The floorboard where the bottle was lying on was wet from the whiskey spilling.
Once John signed a refusal form for treatment, I asked John what happened. John said he was driving home after leaving a dog park on the westside of Albuquerque. I asked John what he was doing at the dog park since he claimed he had his dogs with him and no dogs were on scene. John's demeanor changed after I began asking him questions into what he was doing prior to crashing. When asked about how the actual crash occurred and what led up to it, John could not explain what happened saying instead he could not answer those types of questions without his attorney being present. John displayed outward signs of impairment to include: strong odor of alcoholic beverages coming from his breath, blood shot watery eyes and disorientation. John denied drinking alcoholic beverages tonight but could not explain the odor of alcoholic beverages coming from his breath.
John refused to perform Standardized Field Sobriety Test's(SFST's). John said he could not perform tests because his leg hurt and could not stand straight up. John was ultimately placed under arrest for driving while under the influence of an intoxicating liquor and/or drug(DWI). John was read the New Mexico Implied Consent Advisory on scene to which he refused chemical testing. I read John the refusal section of the advisory and he refused again. John was transported to the Prisoner Transport Center(PTC) where he was seated next to an intoxilyzer 8000. The intoxilyzer was started and timed out due to no breath sample being introduced by John, not recanting his refusal.
A check of John's driving history revealed a revoked driving status with an arrest clause pursuant 66-8-122G. Additionally, John has 5 prior DWI convictions in New Mexico.

This should be a felony DUI with severe jail time/ prison time.
It should but he has another 7 DUI until anything might happen to him.
The vehicle will be auctioned and he will face ac lifetime of prohibition from driving. He's gotta harm another person not property to get jail time usually and even then it's iffy.
In AZ he'd be looking at about 3-5 years in prison for this.
@@laylawalker8897 I've known people with 17 in nm who still buy a car n drive it. Hell theres at least 15-20 cars a day I notice without plates in Albuquerque. I mean the chief himself nearly killed a guy this last week n wasn't even tested.

Like when he said he had been to the dog park to walk the dogs and was going home, yet the dogs were not with him.
Since they were at the crash scene I guess they were running along side the car.
I'm going to go back and watch the beginning again because it seems like he said something about the dog inside the crash but I can't remember right.
After 6 DUI's you're not entitled to the benefit of the doubt any longer.
Anything after your 2nd DUI, should see you charged and convicted of Aggravated DUI with a side of Attempted Manslaughter. This crap is absolutely ridiculous.

California only allows 1. The second is permanent revocation of your license.

@@ian5780I doubt that highly. 2nd is permanent revocation, for life? No way. It can say that in some statute, but that don't mean it's enforced. Statutes also state you can go to jail on first one, but I doubt that has been enforced many times. Says I can go to jail for 20 yrs or 250k fine for pirating movies or music too. Everyone has seen that law on screen watching a vhs or dvd.

I'm a recovering alcoholic with 14 years sober and I never even got a DUI. Can't understand not giving up drinking after one DUI let alone 6 previous DUIs like this guy.

New Mexico and Wisconsin treat DUIs like an absolute joke. Those are the only two states where I can be 100% positive I have seen body cam footage of people with 5 or more DUIs.

When people don't have any money they're pretty much untouchable. Fees and shame no longer cut it for these people. My car was totaled by a guy with 4 previous DUI's. He didn't have a license, didn't have insurance, and it was his gf's car. He worked construction under the table. He got two days in jail and I never saw a dime.

He’s got no insurance & no license. That his license hasn’t already been suspended for years after the 3rd DUI is a wonder. He can get around to work or wherever with public transportation, ride shares, family/friends rides or by bicycle or on foot.
Many winners like this just have enablers to register and insure their vehicles for them. (Mom, wife, sister, etc. It's usually never a male relative or friend, they know better.)

Drunk drivers can kill multiple people and get less than 10 years. Drunk driver killed my dad and almost killed me and my 3 friends when we were 10. I had to learn to walk again from the head trauma, our family never recovered, my sister comitted suicide, and my mom has been trying to kill herself ever since. He didnt do a day in jail. Had a suspended license and no insurance, was on probation, where is our justice?

In Canada, depending on the circumstances, a first time DUI can result in 10 years in prison (but that’s not common), 3rd DUI, driver’s license revoked permanently.

Alcoholism is such a sad, lonely disease. A lot of the time it feels completely hopeless, for the alcoholic and those closest to them. I pray that he chooses to seek some help- before it's too late. 💔

Your state keeps voting a certain way which has a pattern. Arizona won’t extradite 3 people to NY because of how bad the legal system is. They act this way because DUI'S are only considered a misdemeanor. They have to go through all the testing, go to jail and sobber up.... then the bail out and go home. Because there is no punishment and it's treated as nothing repeat offenders will continue to get angry at the process.
The man that unalived a Mom and her little girl that died in my arms was a repeat offender. And, he had unalived people before on DUI arrest 3 and only served 5 years for taking two lives only so he could do it again.

What happened to the dogs? I feel so sorry for dogs left in cars when their owners get arrested for dui. They usually get sent to a pound somewhere and the poor animals didn't do anything wrong except love their owners. My Dad told me when I was young that if you don’t have proper direction and a career path by 30, you’ll never have it. That stuck with me. He’s 40. Obviously his dad never told him that or he ignored the wisdom.

So, just curious, how many DUI's do you need before there's a judge that decides to prioritize public safety above an individual's rights? Is it compulsory for these drunk drivers to kill one or more innocent civilians before they get put away? It's obvious they won't stop on their own.
That guy should of been arrested immediately when he said no tests and I want my lawyer. That cop probably helped him get off or a lighter punishment

I got an uncle whos got 10 or 11 duis. He had lost his license for 10yrs, got it back and got not just one, but 2 more when he got it back. he never spent jail time for the duis either. The sad thing is even though he would blow .08, he wasnt really drunk bc his tolerance was just insane. Ive seen people have withdrawls from dope less scary than watching him go thru alchol withdrawls. Like I thought he was gonna die.
Yeah, I don't think most people know that alcohol withdrawal is worse than heroin withdrawal. A lot worse. Addicts withdrawing from narcotics may feel like they're going to die, but they don't. Alcoholics withdrawing from alcohol can and do actually die.
He knows the drill and automatically surreneders to be cuffed. LOL HE KNOWS he's going in for DUI before the cops play all their games. He doesn't want to talk to you without a lawyer. NO means NO! DAMN!
