McCulloch v. Maryland (1819)
After War of 1812 -> government needs money to recover (needs to regulate money better)-> chartered the Second Bank of the US
- First bank ended a few years ago and was not extended
Headquarter of second bank is created in 1816, headquartered in Philadelphia
- The branch of Baltimore is created in 1817 (in Maryland)
Maryland legislature decided to tax any bank that was charted outside of Maryland
- James McCulloch, the head of the Baltimore branch, refuses to pay the tax
Case gets appealed to supreme court (ultimately appealed up by McCulloch), 2 questions asked:

1. Is congress allowed to charter a national bank?
- Yes, through the Necessary and Commerce Clause (found in Article 1, section 8)
2. Can a state tax a national bank?
- No, Supreme Clause (Article 6, clause 2) states that US federal government law shall be the supreme law of the land, so states have no power to tax federal government entity
