      @@glasslinger If it was then there would be charges. And CITIZENS are not required to prove innocence the police have to prove guilt. Its called innocent until proven guilty. If they have had a full year to try and prove guilt and clearly have nothing that means the couple deserves their property back.

    Civil forfeiture should be illegal. It's basically you're guilty until proven innocent so we're going to take the fruits of your guilt. But they don't have to prove you're guilty of anything. YOU have to prove you're innocent.

      A nifty (for the party doing the seizing) fact about civil asset forfeiture is that they suspect the property to be guilty or proceeds of crime. So it winds up being something like "The state of Arizona VS Mercedes Sprinter Van. And property does not have due process or presumption of innocence.
      So instead of going after the person for a crime and having to prove their allegations they seize the property and accuse it of being the proceeds of crime or having been used in the commission of a crime and then you have to prove that your property is innocent.
      I suggest listening to the Institute for Justice or Steve Lehto for tons of interesting facts about what many consider to be legalized theft.

    In mesa 2014 this happened to me. My vehicle was taken, my kids were taken and my landlord threw all my stuff away. 4 months later the judge threw my case out of court because there was no evidence of an actual crime. The cops were trying to force me to tell on people and I refused. They said okay, we’re going to ruin your life. And they did.

      The judge relies on the sworn statements of the police investigators in deciding to issue a search warrant. If the police lie to the judge in order to get a warrant, the judge can't be held liable - the police are liable. All search warrants are issued in this manner.

      Thankfully, Arizona has such a law. Here in California, the law states 30 days, but for that limit to be enforced, the party/parties whose assets were seized must file a counterclaim, otherwise the asset forfeiture stands. Further, in California, the property itself is the court subject, not the owner. The owner does not have to be indicted, convicted, or even aware that their property was used for illegal purposes. Arizona law is more in keeping with the 5th Amendment than California law.

    I hope they succeed in their suit. Civil forfeiture is a license to steal, without charges, much less conviction. People never charged with any crime then have to go through an expensive and complicated process just to ask for their property to be returned. it's literally a license to law enforcement to steal.

    All the property with the exception of $600 dollars all have tracking abilities. I am guessing that is what they are looking at. With that being said the LE must also obey the law, and either arrest or give property back.

    Unfortunately, this is legal and a lot of states, even democratic states, allow it. Basically, you're guilty until proven innocent. It's basically legal theft, because all they have to do is say, "We **think** you're a criminal" and it's up to you to prove you're not. In some police precincts, they get to keep the stolen items...err...I mean, "proceeds", which obviously gives them an incentive to think a lot of rich people are doing illegal stuff.

    They are proving their innocence by filing this lawsuit. Do you think if they broke the law to acquire the property that was seized that they would be suing to get it back? Think about it.

    The money is a "suspect". Not the person and that's why they don't charge the people. You have to prove the money is "innocent" and money has no rights for due process. You can thank SCOTUS for not getting rid of this ridiculousness. BTW, I wonder if an ancillary reason not to charge people is that if you charge them, then the money becomes evidence in a criminal prosecution (instead of civil). When the people are cleared of charges then the money has to be returned.

    I wouldn't stop the lawsuit against Mercedes. My question is why did Mercedes take possession and not give them back to the owner or person on the lease. If the cars haven't been given back from Mercedes the question is why not.

    Something I don’t get at the end. Couldn’t the couples attorney have given the reason for the seizure? He must know what was in the warrant by now?
    This highlights how a good law against bad guys can easily be used against the good guys too.
