- The plaintiff brought her dog to the dog park. She says the defendant’s dogs attacked the plaintiff’s dog and required surgery. She’s suing for vet bills. The defendant argues there were several other dogs involved in the fight, not just her pets.

I would never take my dog to a dog park. Everyone says their dog is "friendly" until they aren't. Not worth the risk.

I hate dog parks - there’s too many behaviors I want to put a stop to immediately and too many owners who believe the dogs being friendly when it’s being a dominant boundary stomper - while panicking and stirring up the dogs over a growl. So risky!
But ppl don't see its the same with kids
When people ask if my dogs are friendly, I respond "sometimes"
When they ask if they bite, I respond "They haven't yet"
A dog is a dog. Even the best will react when provoked or upset, and those things can change with age, mood, and/or circumstances.
Exactly! Someone with sense! Dogs are animals and you never know how they will react.
A local animal shelter of mine has a large dog park and they host small dog socials every month. I think separating dogs by size should be much more common, keeps everyone a lot safer.

Unfortunately, too many owners of small aggressive dogs ignore the signs and turn them loose on the big dog side.
My chug used to start fights with our pitt Bull. He didn't have anywhere to hide. Separating them I always got bite by the chug. She also be biting the pitbull
Our dog park has two fenced enclosures. Under 25 lbs and over 25 lbs.
Exercise, sit, and train dogs for a living; I am straight up with everyone that I hate dog parks.
Owners allow outrageous behaviors that make me want to step in; mistake boundary pushing behavior as “friendly” while panicking over every sound certain breeds make (growling is not always aggression as wagging the tail isn’t always friendly - PANICKING because you heard a growl however will trigger an event)
And some dogs simply don’t enjoy playing with other dogs (a lot of guarding breeds) and that’s ok - that’s lots of other bonding activities that are much less risky.
Not only for owner and dog safety - but to also prevent negative encounters with stranger dogs.
yea i take my dogs to the park. All guard dogs. GS Italian Mastiff and English Mastiff. I keep a close eye on my dogs but i also socialized them early to try and avoid this kind of mess. But you are right. too many people don't know how to understand a dog or take the time to understand their own dog.
I liked them when I had a rambunctious puppy, but i see things differently now that I have an old dog who doesn't seem to long for canine companionship and is perfectly happy with people.
@@st-ib9xl oh I’m looking to get another dog in the next 1-2 years and the Italian Mastiff is at the top of the list - such a handsome breed and I love working with guard breeds.
It’s just sad how many people purchase dogs to be big, scary and “protect the home” than leave them to their own devices and than put them in prime situations for harm.
And definitely; the puppy socializing experience does play a large role in how much they’ll care to entertain themselves w other dogs

I own a Rottweiler and he has never been friendly with strangers, for this reason he is always in my property, I don’t walk him or take him to parks, I do take him on rides in my truck with the window half down but I never leave him alone and I never let him around kids/pets
responsibility! If all pet owners did this we wouldn't be hearing so many pitbull cases. I have wanted a pitbull my entire life but I am a cat owner I'm used to having cats I don't think I would be a good pit bull owner because I'm not very firm and I'm Not great with training so guess what I don't get a pitbull. I realize I am not what a pitbull needs in an owner, I wish more people could be honest with themselves and realize you have to raise a pitbull different... Not because they're super aggressive or any of that bullshit but because if they do for some reason want to bite they're going to fuck you up.... You have to be a responsible owner with any breed
I Thank You for being a smart, Responsible dog owner. Great job. I have a Rottweiler/ pit bull and he is Friendly with all dogs But not children so he stays on leash or on my land- no dog parks, etc. Not worth the risk plus all too often parents think the dog park is a good place for their children to run around!!?

Just curious, as I don't have a dog, but would like one one day. Have you had him since he was a puppy and do all that "socializing" I keep reading about? I'm just wondering how important all that is.
A lot of aggression issues can be solved with exercise. Rottweiler is an active working breed. They need 1-2 hours of exercise every day to be healthy and not have issues like excessive barking, destructiveness, & general grumpiness. Ownership of a working breed is a real commitment lol.
You said that you don't walk your dog? So I'm assuming that you have a big fenced-in property that he can run around in? Or maybe you work with him a lot, like agility training, fetching, etc?
I wouldn't suggest putting him around strangers, but if you could walk/train/exercise him somewhere safely, that would greatly improve his health & his general behavior.
Maybe you do this already? You sound like a responsible owner so you probably do. It just sounded odd that you don't walk a big working breed dog.
I used to love going to a dog park near my home until a dog attacked my dog and me. I was bit severely because my dog immediately went to the ground submisively but the dog kept attacking so I huddled over her to protect her. My dog was ok but I had to have rabies shots from the bites (horrifically painful). I was under watch for 2 years by my county because rabies can take 2 years to develop. Worst part was the girl with the dog literally stood there and did nothing while her dog was attacking us. She gave a fake name to somebody and snuck out while I was bleeding and while I was trying to get my dog and me safely to the car. I never went back and still have scars. A dog park isn't about how responsible you are with your dog...it's how irresponsible another person may be with their dog. It's not worth it. I don't hate the dog, I hate the owner.
Now I have a country property and my dogs have their own land to run and explore now.

I wouldn't ever my dog to a park not only chance getting attacked, but I wouldn't know if their dog has had all it's shots.
I am a small woman with a 9lb dog. My neighbors two pits broke loose and ran up on us in my yard while my fence was open…I didn’t leave my dog. Snatched her up. And was screaming and swinging at the pits so bad they got scared and ran back home. One NEVER listens and is always loose. She learned that day.
You should report these dogs. Pitt bulls are always trouble.
@@richardb7999 pitbulls are not "always trouble" 🤦🏼♀️ mine is 8 and has never ever had an issue, my gf has his sibling and never had issues. The issue with "pitbulls" is any dog that even semi looks like one is labeled as such.

Call Animal Control whenever you see dogs loose, even if their owners are walking them off-leash.
Canine Behaviorist of 18 years, I never go to Dog Parks, no matter how big, nice, different size play times, etc… The dogs are not the problem, the HUMANS are. If you insist on socializing your dog (Dog Day Cares are even a big no no), find a dog or two that you have vetted, that your dog knows and gets along with, meet at the Dog Park at dawn when other people aren't there and let them play. Otherwise, find a private property to play at, otherwise, KEEP YOUR DOGS ON LEASHES, and be a responsible owner. PLEASE.

Don’t get me started on the off leash dog running up and the owner yelling “don’t worry, he’s friendly”… that's great, what if the dog he's running at, that is leashed, ISN'T friendly?! Their poor dog is bitten and the responsible owner will deal with the guilt, whether their fault or not. I have so many scenarios from clients through the years, the sense of entitlement and selfishness still boggles my mind. Thank you for being a good and responsible dog owner. Took my dog to a dog park once. Never again. Lol. I agree with the Judge on this one I don't try to introduce my dog to other dogs he can socialize with us ! Lol

The defendant lost the moment her dog had a previous bite on another dog. I'm not even done watching this yet,,she has to be guilty.
My dog loves parks and used to go a fair amount and do great. Now he's pushing 14 and when my mom takes him he barks/growls at anyone who tries to get near her. He is very old, very cranky, and a big protective baby when it comes to my mom 😂 no more dog parks for him
Awww, my dogs just turned 14 last month and I wouldn't take a chance bringing them there anymore. Several other reasons too why I feel they aren't safe for them anymore
This is why the defendant is liable here, she had prior knowledge that her dog was aggressive since she was already sued for it once

As a kid I used to think my dogs loved the dog park. She got so excited when we said dog park, granted we had her super trained, with recall and all the things that we made sure that she was trained. Now as an adult, I would never ever take my two dogs now to a dog park. Regardless of how trained my two are.
I think if you're stupid enough to take your dog to a dog park, you assume the responsibility.

I do not agree with the judge for holding it against the plaintiff for waiting. On the outside it didn’t appear there was an issue. Any dog owner would take them to a vet immediately if they thought something was wrong. She should of gotten the full amount.
Completely agree with you. It sounds like the initial wound was just a puncture wound, and that’s always a toss up on whether or not it heals on its own. Plus, an abscess isn’t necessarily a “you waited too long” situation…sometimes animals just get unlucky and get an infection. If the dog was actively bleeding, yelping in pain, or any outward signs of favoring the wound (or obsessively licking it), I’d take my dog in. Otherwise, I’d just clean the wound daily and keep an eye on it!
I worked at vet clinics for over a decade and if the wound doesn’t require stitches, I’d imagine the absolute most they’d do is clean and flush the wound and give a round of antibiotics. And sometimes you STILL get an abscess!
Agree or not the law is the law. Everyone has a responsibility to mitigate their damages. You can't let it run out of control even if it wasn't on purpose. Just like the judge stated had she took the dog in right away maybe it would've been prescribed antibiotics or even just properly washed and treated, therefore preventing the lump from ever forming and all the extra stuff needed. It's possible through her own negligence she made the dog suffer more than need be. It's a highly probable scenario therefore she made her ruling based on that judgement and it was the right one IMO.

Dogs cannot speak so it is up to the owner to have the dog checked even if they don't notice.
Everyone has a responsibility to mitigate their damages. She should've taken the dog right away. Just cause she couldn't see a lot of damage doesn't mean there wasn't damage on the inside. There is no way for the judge to know if this was something that could've been mitigated but it seems highly probable since their wasn't anything seen right away and a week later there was. Following the train if thought, I believe she made the right judgment. People take care of your animals. If you go to dog parks you assume the risk and there are plenty of people who have no business owning animals.
So true with any animal bite. Their teeth are pointed so the puncture wound may be small but the damage--especially infection--can be huge.
Any pet that has been bitten should see a vet as soon as possible.
I have to admit the judge was wrong about the timing of an abscess. We had a dog that attacked our cat. There was no visible injury. Pus built up under the skin and we weren't aware of the problem until about a week later. We had taken the cat to the vet right away because there were other injuries and the vet was not able to see it. You can't treat an abscess until after it forms.
I don't understand the whole " take your dog everywhere into stores and businesses. NO ONE WANTS YOUR DOG THERE ! And If you can't be separated from your dog, then stay home and hold it non stop.

I had a well trained Akita. However, I was only one walking her and she was NOT socialized to other dogs for playing., I did however bring her to work daily(I was grooming pets) and she was trained to sit in driver's seat, and put her head out the window. She would totally ignore other animals IN THE VAN OR GROOMING SHOP. But I never trusted her to " just play" with other dogs. She was with me, 24/7. One of the best dogs I ever had for personal protection. Weeks, months, years of daily training!
Poor lady. She was trying to not be litigious and not unnecessarily go to a vet if it was no big deal, and got punished for it...note to self: DON'T see if the wound will heal on its own in a few days...DO immediately start suing

I like dogs but would not have one as a pet… too much liability and I just don’t have the time, energy or patience to properly care for them. This case just makes me more glad that I don’t have one… I’ll stick to goldfish lol
A black lab puppy was nipping at my Wheaton terrier at a dog park and my dog had enough (but didn't bit it). She turned and growled at it. We live on a path and our dog never responded to any dog that walked by and would run around with them, in fact, EXCEPT for ALL black labs! For the rest of her life, if we heard our dog barking in our backyard, we knew there was black lab walking by our house! She thought all black labs were THAT black lab from the park! 😂 We never went back to the dog park again...
I brought my German shepherd puppy (12 weeks) to a dog park when I was young and stupid …. She got attacked by an older husky and was almost hurt badly. Never again, did I ever step foot in a dog park with ANY of my dogs.

Having seen a few cases involving abscesses now, I don't think the judge understands how they work.

@@maicataylor2813 Another person who doesn't understand how abcesses work. Taking the dog to the vet would not have taken care of an abscess before it formed. Abcesses take days to form and if she took the dog to the vet the same day there would have been nothing for the vet to do since there wouldn't have been an abcess.

Since you take on the risk at a dog park, if your dog gets injured your pay for your own dog in some states like Florida which is a strict liability state, as JM has said several times.

I think some dog owners don't realize their dog doesn't want to be bothered with other dogs sometimes. They just wanna do their own thing without having other dogs up in their face. Dogs get in their moods just like people. I see some owners force their dogs to be friendly and that's when bad things happen. Don't assume if you're in a dog park your dog will automatically get along with the other dogs.

There is no such thing as a "friendly" dog.
Personally I hate dog parks because of this reason. But I can't fully blame the dog. It is 80% if not more the owners fault for not controlling their dog. My grandpa used to take his dog to the vet until he noticed her starting to get a little nippy at some of the other dogs. So he stopped going to prevent something like this from happening.

We walk our dog on trails, with the leash on and keep him close. I don't know why people go to dog parks where common sense should tell them this can happen. DUH!
I'm kinda surprised dog parks don't specify that ALL DOGS must be MUZZLED inside the park. You can get muzzles that allow the dog to drink. Dog Parks should have Security cameras & separate areas per size.

It's ridiculous honestly I dont think anyone should be able to sue since they both decided to take their dogs to the dog park. Dogs are gonna do what dogs do if you were walking on a trail or something and your dog attacks and severely injures another dog then that's your fault but when you decide to take your dogs to a non leash dog park you take the risk of your dog getting into a fight. I have 2 dogs one of my dogs will snap at male dogs when they try to mount her so I dont take my dog to the dog park because owners dont watch their dogs at the dog park and I'm not gonna risk my dog snipping at another dog knowing my dog doesnt like it super simple.
My City has separate parks for large/small dogs. Thought that was more common until I started watching this show
I brought my dog once to a dog park. Never again bc I thought I don’t want my dog to get sick or fleas from the other dogs. Plus my dog hated it.
I wonder if it would defeat the purpose if a park required a muzzle? My dog would love a park, but I haven't had much luck with other dogs.
Dogs are running and excited and breathing heavy. Dogs release heat through panting. A muzzle would make it extremely difficult to breathe and cool down. Think about jogging with a sock in your mouth. If you're keeping the dog on a leash and afraid of how they might react a muzzle initially may be safe but if you have to keep it on always it's best not to take the dog to the park.

I wouldn't ever let my dog in a dog park. One of these dogs are the aggressor. The defendant dog must be the problem, cause she the defendant, had another lawsuit with the same problems.

I could tell this was not a pitbull case because there are no dead dogs after the incident.
Folks stop letting your dogs run wild and free in the dog park. All dogs DO NOT get along!! A bigger dog once chased and pinned our smaller dog at the dog park we were one of the lucky ones where no serious fighting or injury occurred but after that we learned our lesson.
The defendant is not worried about taking her dog to the dog park because her dog is a bully and aggressive and she doesn’t give a flip if her dog bites other dogs. If a dog has had an incident you should not be able to visit a dang dog park.
Dog park should be ENTER AT YOUR OWN RISK.
Just a tip... huddling over your dog to protect your dog doesn't work and it won't prevent a bite. Fight back! If a dog is attacking you, your dog, or your child... hit, punch, and kick, do whatever you can to keep the attacking dog back. Sometimes one good punch to the nose is enough to get them to back off. If your dog is bitten and the other dog refuses to let go, the strangulation method is the quickest way to get the attacking dog to release. Let go of your dog and grab the attacking dog by the collar, if they are not wearing a collar put a slip lead around the attackers neck (use your belt if you have no leash). Move the collar or slip lead to the top of the neck under the ears. Twist the collar or slip lead until it's incredibly tight around the top of the neck. Lift the dog straight up until his front paws are off the ground. Hold and wait, the dog will begin to choke, after 15-20 seconds they will open there mouths automatically trying to breathe. When it opens its mouth quickly move the attacking dog away. People make the mistake of holding onto there dog during an attack or they try to pull there dog away from the attacker. Let your dog go and grab the attacker! Lifting the dogs front paws off the ground not only chokes the dog, it limits the head shaking and will prevent further damage. I've broken up several dog fights in my life and this method works every time, there are UA-cam videos demonstrating this method. Everybody needs to know how to break up a dog fight correctly!

I don’t think dog parks are a good idea because you never know what may happen to your dog or yourself. As for the plaintiff’s dog, who’s to say that the bite caused that abscess, it could have just been something with her dogs genetics that could have caused that abscess. If the plaintive really thought the bite was bad she would have taken the dog to the vet or a vet hospital asap. The defendant should stay away from that dog park because of her dogs biting other dogs and who’s to say other people wouldn’t try to blame her dogs and her for incident that weren’t even her dogs since her dogs are known for biting.

Actually there have been studies that show dogs, if given the choice, would rather spend time with their people than with other dogs. Get your lazy ass out and take your dog for a walk. My dog ended up in emergency after being attacked at a dog park. Too many things can go wrong.

I went to a dog park with my friend and her dog. People are supposed to clean up the dog poop. They don't and it's disgusting! I would not take my dog they could catch parvo
It kind of sucks she’s being blamed for not going sooner yes it might have been cheaper but either way she’d have been owed money, she was really trying to help the other lady out.
As a pet owner you take your pet in as soon as there is an injury that needs to be treated. Especially if another dog bit it. Treating it would be cheaper and less harmful for the dog. A vet could have treated the bite with antibiotics before an abscess developed. Meaning the poor pup wouldn't have had to been shaved, lanced and wear the cone of shame. Those things themselves are 20 bucks.

Other dogs do usually show up to check out a fight at the dog park. The other dogs will either go at the "weak" dog or put the aggressor in it's place. I've seen it numerous times. It doesn't help the situation at all haha If your dog starts fights all the time, STOP taking the dog to the park!
The plantiff is an idiot. "No I don't have to take my dog to the vet immediately after an attack." Uh, yeah, you do. If you had, it may not have ever abscessed like it did. It may have only needed a good clipping, cleaning, flushing and antibiotics, but because you waited, it cost you more. Don't wait. Don't ever wait. This includes if you, yourself, gets a dog, cat, other animal bite. NEVER wait. Go that day for treatment.
Dog parks are not places for dogs.
