    Perfectly well placed ,well considered pointer. By virtue of its colossal and comprehensive reach, our constitution adequately addresses almost all vital aspects of the nation. To let down the constitution is to let down the nation, to drive it in the wrong direction thereby damaging the future prospects of the nation. The tragedy is, there is no palpable attempt to make the constitution an integral part of public conscience and consciousness. Over ninety percent of our populace do not know what is there in the constitution..Even a university educated chap belongs to this range of ignorance. This ignorance helps the ruling elite and its hench men to play truant with the basic values of the constitution thereby seriously damaging its supremacy and sanctity.

      Do you think all politicians are saints? Mostly, they are rouges and fanatics. To achieve their political goals and gains, they mostly bend laws in favor of them. Never follow the constitutional rights. Ultimately, poor and innocent people are victimized for their political gains. Now a days people are highly polarized and never follow the truth and principles of the constitution and democracy.

    Constitution should never be modified and changed.If it is done then the purpose of having a constitution itself is defeated.Which is why the Indian State is in a state of disaray.No modification of any sort should be permitted from the original one .

    Late Indra Jee blazed the trail when she amended the constitution during emergency and afterwards others followed the trend set by her.Any party with two third majority in the Parliament is always prone to amend the constitution.The BJP amended it because of absolute majority in the parliament with a go- ahead by the apex court.

    Indira was right in imposing the emergency ; it led to the bureaucracy working efficiently, corruption was at its lowest, there was no breach of law and order, the crime graph had nosedived, the subaltern section received proper attention from the state machinery as all government departments were held by their collars and forced to perform as servants of the citizens instead of as masters…..the only negative was suspension of the right to life and liberty….

    Justice Lokur appears to believe the SC does not have the authority to reiterate names of future judges if the Executive returns the list. Sure, it could lead to a confrontation between the SC and the Executive, but I'd rather there is a legal confrontation than inviting the PM at home over a religious function: that sends a message of compromise. The judiciary is the last hope of the country, but a compromised judiciary, clearly a big NO.
    As for the Parliamentarians, in the past 10/11 years, each MP in the ruling party in Lok Sabha owes his/her existence to the PM: they were elected in his name. The question of them going against the diktat of the PM is unheard of. Hence, to expect them to take responsibility and accountability is foolishness: they owe their allegiance to the Party, not the Constitution under which they swear to uphold it!

    Lack of checks to PREVENT AND PUNISH MISUSE is the biggest drawback and weakness rendenring it pathetically hepless and weak when grossly and rampantly misused by all stakeholders against whom it is supposed to protect. Long way to go before we can call it truly strong.

    At location 40:18, Justice Lokur again says that the Constituent Assembly did not expect people in power (at some time in the future) to be 'unconstitutional' or 'dictatorial'. Is this really true, considering that India and the rest of the world had just witnessed the results of World War 2?!
    Didn’t they know that even leaders who rise to power through popular elections can devolve into authoritarian dictators? Or that their ability to consolidate and sustain power lay in their control over the police and military, enabling them to suppress dissent, manipulate institutions, and impose their will, regardless of democratic norms?
    Personally, I can't imagine a Dr Ambedkar or Dr Rajendra Prasad to be so naive!

    I was in the boarding when emergency happened. So at the time and for long after that I was ignorant on the subject. But after learning during the 50 decades of my life, I grudgingly think that was needed at the time with people calling for the police and army to revolt. That in my view was the last straw. The rail roko was allowable.

    If only Justice Lokur were more explicit and direct like Justice Katju, Karan Thapar's many questions would have been answered without being vague. 😞
    Why doesn't he say upfront that the Constitution of India does have loopholes which can be exploited, rather than keep repeating that it takes 'good people to be good executors of the Constitution'? Also, he keeps saying that the People should raise the alarm. But can they? Really? When there is no true Freedom Of Speech, and any protest or cry against is directly dealt with by the police and ED, how will any citizen have the courage to raise a voice?

    Puerile debate.It was an aimless dribble,till Karan came to his favourite subject,statehood of Kashmir.A clever transfer of ball to The judge elicited the required response: Modi govt. was at fault in doing the surgery it did to remove the canker of gangrene.Karan thought Indira was 'charismatic, and forceful' while the same quality in Modi exhude dictotorial attitude. Pomposities of Karan were in full force,so were his repetition.The final conclusion was : good men work a constitution very well and bad guys mess it up.Dr.Ambedkar ji had said it ages ago, which was repeated ad nausium, as if it was a new light Newton had failed to bring to light! Justice Lokur, sir,you said undefined restriction on freedom of speech in the name of an undefined concept called 'morality', was unjustified;could have elaborated how undefined 'Basic Structure' of the Constitution can be worked unbiasedly?These seventy years of our Constitution have amply demonstrated that even the judges on the Supreme Court are not above temptations afflicting ordinary legislators, or members of the executive.So finally, it is the moral fibre of all the concerned which decides how good we will be in future.

    The reverend Judge is discussing the sanctity of the constitution at length and is of the opinion that there are checks and balances everywhere to protect the constitution.It is ultimately the judiciary which has to act as the watch-dog of the constitution but unfortunately it succumbs to the executive.The apex court can play a pivotal role in protecting the constitution if it so desires.

    Karan, please speak about the real threat to the constitution from 2014 until now. My opinion is Modi have completely destroyed like Freedom of speech, CBI, ED, Election commission of India, Electrol Bond, PM CARE FUND, RTI, CJI joining Rajya Sabha after giving verdict of Ram Mandir, women world champion accusing BJP MP as rape, and many more. So every institution under threat. When people vote MLA and MP's for congress or other parties and after winning the election immediately they are joining BJP party.

    At times the discretionary power becomes dangerous more than even arbitrary power. And all that again as the Hon’ble Justice says bcz of good or not so good people whether it be the case of Legislature, the judiciary or the executive. Sometimes the ego rather bcz of excessive ego in the person sitting on responsible post becomes the cause of harming the aggrieved person, and of course with certain other reasons like the lack of morality, maturity of mind , certain isms running in the mind of the person in power etc etc .

    Solution : Liberal Democracy
    1. Bring US 1st Amendment and remove article 19
    2. Remove illiberal laws 295A, 149crpc, 49crpc, 124A, 153A, 500, 502, 504, 505, 506
    3. Individual is more important than collective.
    4. Religion should be separate from state.
    5. Introduce UCC.
    6. Limited Government

    He is playing Catch 22. If you keep saying that it's all People who operate the constitution are the problem not the constitution, then why do you even need a Constitution, why don't you just truth the people in power ?
    Talking about the people who operate constitution, remember the constitution is just binding document, it was not grown from the soil, it was written by also People, who should have taken into account the nature of humanity, nature of people who seek power, which those people didn't. Since constitution is a living document, are those people who cares about constitution willing to make structural changes if they come to power in future ?
