Israel is entitled in law to the West Bank. There has never been any such thing in law as Palestinian land. There never was a state of Palestine. When the Romans conquered the Jewish kingdom of Judea, destroyed the Jewish temple, and drove the Jews of Judea into exile, the Romans renamed it PALESTINA in an attempt to erase its Jewish identity. When the last colonial occupier of the land the Ottoman Empire fell after the first World War, the international community that carved out the Middle East to create a number of new states and countries kept the name Palestine to describe the territory which was now to be recreated as the homeland of the Jewish people. You can find on the map of this period Jewish Palestine and Arab Palestine. This was cemented at the 1920 Sano conference and given the force of international treaty law by the League of Nations in the 1922 mandate for Palestine. Britain then sliced 75 per cent off this land to create Trans Jordan or what is now known as Jordan. Palestine consists of what is now Israel, the West Bank, and Gaza. To make this quite clear, only the Jews were given the legal rights to settle the land in what is now known as Israel, the West Bank, and Gaza. That right has never been abrogated. The 1922 League of Nations mandate was ratified by the United Nations Charter of 1945, which pledged to uphold the agreement made by its predecessor, the League of Nations. The legally binding principle entitling the Jewish people to settle on all of this land was subsequently further codified in the Vienna convention on the law of treaties of 1969, which confirmed that it included Judea and Samaria ie the West Bank and Gaza. Between 1922 and 1948, "when people refer to the Palestinians, they were referring to the Jews." One reason why the term "occupied Palestinian territories" is a nonsense (Take note ignoramuses) is that "the areas in question were never Palestinian lands but was always legally designated for JEWS ALONE to be entitled to settle." When the UN finally declared the land of Israel, the Arab armies immediately attacked. This was the Israeli/Arab War of 1948 when the Israelis were forced to defend themselves from annihilation.
Israel is not in "illegal occupation" of the Palestinian territories. Anyone that says that is "legally illiterate." The Jews are the only people entitled in law to those territories.

As a Jew, I don't care whether or not Israel has a legal right to Gaza or the West Bank. The reality is that between the PA and Hamas, the Palestinians do not have the ability to effectively govern these lands and there will always be a threat to Israel. With that said, give Gaza back to Egypt and the West Bank back to Jordan. In other words, no two state solution.
The "West Bank" ie Judea and Samaria wasn't Jordan's to begin with. Nor did Gaza belong to Egypt, they were occupied by both through war. Once the Arabs calling themselves Palestinians settled there, neither country wanted them back - they wanted Israel to deal with the problem, or perhaps they wanted to keep having an excuse to blame Israel for things it hadn't done.
egypt doesn't want gaza, and Jordan doesn't want the west bank. That's the conundrum.
I agree that it extends beyond rights to the land; as a nation Israel also has the right to security. That’s the reason they occupied the West Bank and Gaza to begin with.
If my nation, Canada, was crawling with terrorist groups, constantly firing missiles at random civilian targets in the US, and regularly making deadly incursions across the border to massacre and kidnap civilians, I’d say we more than deserved to be occupied and even annexed by the US.

Claiming land inhabited by other people for thousands of years based on religious stories written down by your supposed ancestors (but more likely the ancestors of the Palestinians who live there) is laughably ridiculous, if it wasn’t for the tragic and cruel treatment of the indigenous Palestinians by Israel settlers.
If Jews have an absolute and exclusive right to inhabit Israel (and just what extent is biblical Israel?) then surely they have no right to inhabit any other part of the world. That was the concern of Lord Montague, the only cabinet member and only Jew in the cabinet, to argue, vehemently, against the making of the Balfour declaration in 1917. His concern was that by creating a Jewish homeland to solve a European problem (anti-semitism), it would take citizenship away from Jews in the many countries they inhabited. This was prescient.
The world map looked very different 2000 years ago. Trying to roll it back on the basis of traditional stories has been nothing but a delusional colonial project that has and continues to cause untold tragedy. Only when all people have equal rights and religion and ethnicity play no part in that can Jews or Arabs have any peace in the region.

It really is wild reading people who think settler colonials have the right to a land because of religious beliefs based on a text that has been demonstrated over and over, through archeology, to have almost zero historical truth in it.
Fact is that in the land of Canaan/Judea/Palestine, many religious beliefs have been followed as times and culture changes. This was the polytheism that was practiced up until 3rd or 4th century BCE, 2nd Temple Judaism forced upon the locals by elites returning from Persia (and many who remained there to form the Jewish communities that were a huge part of the rich tapestry of Iraq and Iran. This also included the many who converted to Christianity and then those Jewish Christians living in Arabia who then formed Islam.
What is also a fact, is that genetic studies show that the modern Palestinian population is the same population that has lived there for at least 4,000 years. Whereas the modern Jewish populations are partly descended from that old population, but also a mix of the genetics from the areas they have settled. This is true for Ashkenazi Jews, Arabic Jews and Sephardic Jews.
Just because your family continued to follow a religion that was one of the most common at a certain period, or you converted or married into that religion, does not give you rights to that land. It is not saying you could not migrate there, it is saying you can not move there on mass and form a nation on the ashes of the towns you have ethnically cleansed.
Even if Palestine is able to finally form a nation in a two-state settlement, it won't be the end of it. This will continue until all refugees and their descendants are granted right of return and their homes are returned to them.
They even colonized IRAN
Really? Abraham was born in modern day Iran. How do you colonize a land where you were born?
@TheBlackThorneKnight With new archeological evidence it's a toss up between Iraq and Iran. Just being sarcastic. Jews have always been present throughout the entire region
Has the ICJ declared the Russian occupation (and settlement) if the Crimea illegal? Has the ICC declared the Turkic occupation and settlement of Constantinople(1456) and the entire Anatolia peninsula illegal and that it should be returned to the indigenous ethnic Greeks with Turks returning to Central Asia? Should Koernigsberg be returned to ethnic Germans? etc. etc.
Legal experts ?????😂
Our bible has archeology to back us up!!! No change. Therefore, international law is just an addition

Long live Israel
Crimea has always been considered part of the Ukraine and over time has been conquered by the Mongols, Ottomans and Russians. In 1991 when Ukraine gained independence the majority of the population was not Ukrainain, yet under international law it became part of the Ukraine. In 2014 Russia occupied and annexed Crimea. Despite its demographics, history of being part of the Russian/USSR empire, and a population that prefers to be part of Russia, Crimea by international law is Ukraine. Should the Ukraine re-take this land and over time Ukrainians move to Crimea they would simply be moving from one part of the country to another. There cannot be one set of law for Israel and another for other countries.
You are conflating something that is nothing related to Israel's legal right to the land ... forget the fact that Judea and Samaria is the aboriginal lands of only one people .... the JEWS. But even if Jews never ever lived in the land (which is an absurd concept), under INTERNATIONAL LAW, the and belongs to Israel.
@@practice4523 LOL, the ICJ has ZERO legal jurisdiction. Where do they plan to draw it's borders; southern France or Upsala in Sweden perhaps ...

I’m sooooo incredibly shocked that the EU is aiding the “Palestinians” in breaking the Oslo Accords. I can’t believe they would do this!!! 🙄
The ICJ disagrees with your remedial and dishonest accounting.
You mean a court whose head judge has frequently come out against Israel in the past and that said-judge's own home country (Lebanon) supports a militia (Hezbollah) that seeks Israel's destruction. You mean that totally "unbiased" and "impartial" court?
Thank-you for this one. Judea and Samaria always seem so complex.
Israel is only entitled to the boundaries prior to the 1967 conflict, which she accepted from the United Nations during the partitioning of Palestine.
I imagine ICJ took your arguments into account. The prosecution was more persuasive.
The ICJ is impotent in actual fact and besides, they are an izlam pandering organization. What is the outcome .... ZERO. Antisemitic Israel denying tw@ts can go hike on their own bile :) Am Israel Chai.

Why doesn't Israel just 'annex' Gaza & West Bank and give Israeli 'citizenship' to all the people, BUT you DON'T give Israeli 'residence'?

Useless clip. The historical (indigenous) right to land is tragically wrong - it leads to wars and it's always disputable. Try to find something smarter!
Well its the Jews land so doesnt matter. 🤷♂️
As long as the difference between the "Palestinians" and a Pikachu is 32 years... No1 cares.
There's more to this. The Jews have not just randomly migrated there. Before 1948, they received the Balfour Declaration that promised them sovereignty. They bought lands and only then won more territory through wars that they did not start but were subject to.

I’m an Israeli. If we’re ever going to have any stability we need to leave Judaea and Samaria alone. The settlers here are creating problems for all of us. I don’t give a shit about what is legal and what isn’t. This has been Arab land for generations . Israel needs to respect that as the Arabs need to respect the land where most Israelis live. Two peoples live here. We need to respect each other.
Sounds great but let’s not forget it’s a brainwashing those Arabs have gone through about us Jews. From children to adults. This means if you leave them alone there is more then enough chance we will face the same tragedies all over again. Israel must govern Judah and Samaria in my view.
Is somebody expelling the Arabs from the land? No. If I was this racist towards Arabs in the UK will they also have to leave according to you?
They’re not expelling them. They’re just taking farmland and whatever else suits them. The settlers are just as fundamental as any other religion. And what has that got to do with Islam in England.

In accordance with the laws of war with Israel's victory in 1967 over the West Bank, East Jerusalem and the Gaza Strip legally belong to Israel, like Turkey in Constantinople and China in Tibet, they invaded and victory
While I believe many people are aware to the rights of Jews to judea and sumeria, we have to be smart about it.
If the icj, un, etc demands those areas returned, its not an entirely bad thing, Israel can return it to jordan, take out our security measures along the jordan valley and disconnect the areas from our infrastructure. Thus making the palestinians s jordanian problem.
Now jordan got a terrorism problem, the saudis have a terrorism problem, but israel have disconnected from it and only need to hermetically seal 1 border instead of many.
Any aggression from the palestinians would become aggression from jordan, which is a sovereign state and israel can act accordingly.
The icj and their mates cannot complain much because we have turned the palestinian problem into an issue for the arab states instead of ours.
How long before they'll come and ask israels help? Or collapse and allows other forves to take over?
I get where you're coming from, but there are some major issues with that plan.
First, Jordan has already given up claims to the West Bank and isn't interested in taking on more people. If Israel stops securing the Jordan Valley, it could seriously strain relations with Jordan.
Without Israel's security measures in the Jordan Valley, the terrorism problem could get worse, not better. Jordan might try to close the border, but that's not guaranteed. Plus, terrorists could use the high ground to launch more serious attacks, beyond just stabbings and bombings. The West Bank's higher ground gives a strategic advantage. If we pull out, weapons and fighters from Syria and Jordan could flood in, threatening our people, land, and water. If we leave the West Bank, does that mean we should also leave the Golan Heights? That would hand strategic high ground to Syria, which is super risky.
Leaving settlements isn’t just about security; it’s also about our right to be there. Abandoning them could undermine the historical connection of Jews to these lands and disrupt agreements like the Oslo Accords, leading to more instability and legal challenges.
Sealing the borders and cutting off services would likely cause a humanitarian crisis. The international community would condemn Israel for this, leading to diplomatic isolation and possible sanctions. While it might shift the problem, it could actually make things way more dangerous for Israel without solving the core issues.
In short, while your idea tries to shift the burden, it could create a much more dangerous security environment for Israel, with less control and more threats on the ground.
The court did not rule.
The court only gave an expert opinion.
Enjoy the impunity for now but tides are shifting. The older crowd only view legacy media which lies and hides the truth. The youth accesses alternative media and sees the whole picture.
That is very enlightening and reasurring......
@McCraeMoto1 there never was an ethnic group called Palestinians ever recorded in history. ‘Palestina’ is the old greco-roman renaming of JUDEA AND SAMARIA, cradle of Jewish civilisation, by Roman invaders. Romans referred to the Phillistine seafaring invaders from Agean Islands (GREEK) beaten by Egyptians and that occupied a small area near the sea (Phillisia) and were worst enemies of Israelites. Phillistines were wiped out thousands of years ago! In Hebrew, ‘Plishtim’ means ‘invaders’ ‘unholy’ ‘uncultured’
2:30 non binding resolution and legal standing are two different things. A resolution can be non binding and still be a part of the corpus that we call “international law”.
I’ll add that general assembly resolution are binding they are just not enforceable. Get your facts straight
Ollie ? The QURAN is ALSO VERY clear that even ALLAH "Allocated all that land" unto the Jewish People ! !
"Allocated unto The CHILDREN OF ISRAEL !" Surah 10:93 !
There is not even any RELIGIOUS disagreement with that FACT
So what other Quranic verses do you want to enforce?
@BarneyGimble whataboutizm of the highest puke. Don't put words in his mouth, he stated a fact.
@BarneyGimble
That's not what is being said.
The quran n Torah are historic documents thousands of years old that reveal the fact that the jews existed on that land.
There is jewish history of existing in that land 3000yrs ago,
They were conquered repeatedly on that land and even Roman history reveals all of it and how the jews were occupied.
The Arabs conquered the land and built their mosque ontop of the Temple mount.
The jews came back and bought land back in British palestine and even the partitioning of the land by the UN reveals separation mainly based on where each group resided (which was logical ) .
Each group could have self governed themselves before the constant rejection by the Arabs.
It's an unfortunate situation especially because the leaders from Iran etc want complete annihilation of the state of Israel.
Sad situation for both sides. Complex.
