- Dana Ireland was the victim of a brutal sexual assault and was killed in 1991. The hunt for her killer has taken many turns. The Hawaii Innocence Project said DNA evidence led authorities to a suspect. But now, that suspect is dead.

No body, not enough evidence. It was the photographer though. He was wisely meticulous in destroying all evidence.
That would be groundbreaking to be able to track down what happened to her. As far as I know there’s no physical evidence of any kind. Unless witnesses come forward only then can they retrace the events to find possible evidence.

You need probable cause. You might be a DNA linked to a 33yr old murder isn't enough to charge him.

they did. Prosecution didn't care. I've been following this case for a long time because it seemed SO easy to solve. Then prosecution went down a 30 year rabbit hole....
Hell, yeah- police incompetence! Outrageous-
It depends what the procedure was. The 1st sample was taken from a discarded fork. The 2nd sample was direct from the suspect. Lab work takes days before a formal arrest can be made. No one wants the killer to be free. It’s clear his suicide is indicative of a guilty conscience. He would have found a way to commit suicide anytime.
At least he would have been in custody and maybe answered some questions for the family's sake. In the end, the cops definitely handled this as badly as they did throughout the entire case.
The fork DNA evidence is Reasonable Suspicion and cannot be used to issue a warrant as they cannot prove it was directly from his mouth. For Probable Cause to arrest, detain, and have evidence admissible in court they needed a DNA sample taken in person and witnessed. In cases like this that are decades old the validity of evidence is vital. Any mistake and it can be thrown out of court

@@charly3575 that’s correct you can’t make arrests or use evidence in court based on “reasons”. It’s very delicate. Any evidence must be substantial, hence the need for a witnessed check swab

@@geoleo2597 they arrested Kohberger only on DNA evidence of his father. Then when Bryan was detained and locked up they took the mouth swab. A good police department doesn't let a guy that dangerous remain in the community. They just don't.

Ps. Everyone is asking- they did check the DNA but prosecuter floated 4th man theory, implying they all did it together. The men convicted were bad guys but didnt deserve this obviously, im sure their families will be millionaires soon.

No it was voluntary. So they couldn't arrest him until the results came back.

@@JoeBuck207 I don't like the lack of physical evidence with the police pressuring to strongarm a confession. I prefer suspects in those situations go free. Protect the integrity of the justice system over the risk of letting a criminal go for lack of real evidence. I get it they are bad guys with offending pasts. Every time you nail someone like that for a crime they DIDN'T DO or you cannot definitively prove they did- you put the final nail in the justice system. Now, DNA is different. DNA IS definitive- they should have arrested that guy ASAP. By letting him suicide -which PD allowed by all the steps they took in handling this- they show contempt for the victim's family. The Irelands have been the long suffering victims here. Public safety also was not served. Very poor handling...
This is eye-opening and really makes me doubt that the so-called guilty truly guilty ? Now I wonder are people are really guilty or are they railroaded so police look good on paper closing cases.. How can a car be tagged as evidence when it was purchased after the murder ? Now that's not DNA knowledge, not available back then . Apparently, the killer was never the mystery man from that car the brothers did not own . Was this case cleared and closed to not damage tourist from coming ? Such a injustice to Dana Ireland and her family . Those found quilty , it makes no sense

Lawson who is the Director of the Hawaii Innocence Project played a key role in bringing McCoy (Who was set free of Death Row in Delaware on technicalities) to Hawaii - to even speak at events and tell his story. From the second he landed on island he was suspected of involvement in a murder in waikiki, he was arrested for pimping. He was the driver in a violent robbery in Manoa... the list goes on and on...

Justice system is fubar
Once they confirmed that DNA match from the fork that may have been “Reasonable Suspicion” which is not evidence enough for making an arrest. They may have needed more evidence from the cheek swab to support “Probable Cause” and to issue an arrest warrant based upon that additional DNA evidence. Evidence used for Reasonable Suspicion is not admissible in court. So they may have also needed that cheek swab to positively identify his DNA as a match to be able to both issue an arrest warrant and have evidence eligible for use in court.
The DNA evidence from the fork is not admissible in court because there’s no way to positively identify that it came from his mouth only that they found a fork with a DNA match.

Evidence obtained based on reasonable suspicion MAY be admissible in court, but it may face greater scrutiny.
Evidence obtained with probable cause is generally more likely to be admissible and less vulnerable to legal challenges.
But in any case. The primary suspect is gone. Hopefully there may be some sense of closure for the family

I understand the mouth swab is needed, but they arrested or detained, Kohberger on a DNA match just from his father- before they handcuffed Bryan into custody to get the mouth swab- that seems the responsible way to handle any predator suspected at the DNA level, doesn't it?
