Well technically as producers, we're not legally obligated to clear samples, as that falls on the artist who plans to make profit from it. We ask for credit simply for promotion which grows our fanbase and allows us to make profits and clear beforehand. - 40unce

I'm not going to remove you because this is a teachable moment. I see this isn't the only comment you've made on the video about the use of the beat. So allow me to set this straight.
For one, I know Roy Ayers is the original artist and holds the copyright. _I_ out of all people should know, because I made the beat in the first place. And if you read the description, you would see that I gave the name of the sampled song and the artist. You don't have to keep to reminding people. However, I feel you may be a little confused; Roy Ayers made "Everybody Loves the Sunshine", I made this.
Which leads me to my second point. I know much about copyright law, probably more than you because I've studied it extensively since I became a producer. This falls completely under *fair use* as:
• the purpose/character of this work is merely a showcase of my talent. This would fall under transformative because rather than just taking the entire song and slapping drums on it, there's looping and cutting of the sampled work.
• This instrumental is not monetized and never was. Neither are any of my sampled instrumentals. They're not creating a rift in the market for UMG or whatever label owns the original work. Unless I sold the beat, they don't/can't care.
You think artists care when we sample their material? Of course not, or else Roy Ayers, Stevie Wonder, Keith Sweat, James Brown, The Dramatics, Herbie Hancock, David McCallum, etc., would have dragged me to court for beats I haven't even planned on releasing any time soon. We wouldn't think of selling beats if we hadn't cleared them yet, so we don't.
