I hope there is soon an option to TELEPORT person back to india as soon as extension is denied for people who are in 240 day period. May be that will ensure NTA is not issued and help people who are law abiding and tax paying legal immigrants of this great country. God bless america!
This entire process is horrible!! To do EVERYTHING properly and then be told later that it's either incorrect or unaccepted due to a minor change made overnight is absolutely ridiculous and insulting! There are GOOD hardworking HONEST people who save money , follow EVERY damn step to the letter and get gagged because of this country is currently being run. So best to avoid this situation will be to also file for H1B extension with present employer while waiting for H1B transfer to the new employer. Is it a good strategy?

What happens to someone in the 60 day grace person looking to do a h1-b transfer with a new employer after getting terminated by his current employer. Will he/she get an NTA if too? If the person's i-94 is still valid?

H1b is approved and valid only for 3 months what this mean? When applied for extension will it be approved for atleast 1year? What are the chances of approval?

H1 b is an employer responsiblity. So why an employee will get the NTA.
Should not the employee be allowed to move back to their country.
Because employer responsibility is only till H1B is valid. It's employee responsibility of anything outside of H1B. If you stole a bank on H1B would it a employer responsibility? I do agree that employees should be given a time to move back.

Hi. I just filed my i-485 application last week. marriage based. married to U.S citizen. Before that I was overstaying. I came on H1b , tried to change my status to f1. But they denied. Then I applied motion to reopen. They denied that too. .. I just got uscis letter for finger-prints. I have to appear for my interview then.. My question is How this NTA memo gonna effect me??? This is insane. First, they took 10 months to approve my H1. Then I received 221(g) at Consulate and got stuck for months. The immigration system is defunct big time. The pain is I got to repeat this vicious cycle again in few months while filing for the extension. American Dream. Are we living it?
once you are in US and apply for extension using premium processing things should go much faster and i don't think there should be any 221 g since you will already be in US.
Having said that the immigration process need to improve a lot.
To add to this, I did my Masters in States. I have been working for my employer in Florida for quite some time and suddenly the Consulate Officer at the Embassy felt the need for extra checks for my authenticity! Due to this ignorance, I got stuck at home for 3 months!! It's hilarious.
What is the difference between a I-94 POE and Petition I-94..For example, the I-94 POE date is May 10th 2019 and the petition expiry date is Aug 31st 2018 which has another I-94 date....which date is considered the legal one to be present in USA..is it May 10th 2019 or Aug 31st 2018?
The petition I-94 or the I-94 on I-797 A must be or at least used to be required to be submitted at the PoE while leaving the country. The one which you get during arrival at the PoE is the one which is the legal.
So if your transfer is denied, can't you appeal it and wait for the result even if your I-94 has expired ?
Even if it denied they should give you some time (30 days or something) to make arrangements and go back to your home country.

If H1B ends, a lot of hi-tech will move out their operations to other countries. It will be a huge loss to US economy. Obviously H1B abuse should stop but I think the program is critical for US.

H1B is a legal visa - H1B holders are very much welcome to stay in US. They don't have to go anywhere if they don't want to. Illegal (mostly Latinos) unfortunately will have to go back or they will be forcefully deported.

Why? Industry and most of republicans are telling the administration that is is very good for business. And administration has delayed any guidance on it. I think they will leave it alone and not change or end it.

H4 EAD has very strong bipartisan support and huge support from the Employers, so I will be very surprised if they touch it.
Also the group that wanted it gone (save jobs usa or something like that) already lost their case in the lower court so there is very little chance the higher court will change it.
no Jaja, H4 support is very minor when compared to H1b. i dont think they will spare H4 EAD. however, if something happened to H1B, H4 EAD will disappear.
Will NTA be issued if denial happens after I 94 expiry or of denial happens after 240 days post I 94 expiry and the person is still in USA?
If my comprehension is correct, I believe NTA will be served if you get a denial (even if within the authorized 240-day period) of an extension, change of status, etc. and your i94 already expired. It just does not state the date when you will receive the NTA, but the denial letter (according to them) would suggest that you have to leave USA immediately while NTA has not been served yet.
What should people working in the 240 day period currently do? Hope for the best or leave the country asap?
