This matter is very subjective. These discussions and debates should be done in parliament (both lokshaba and rajyasabha) not in supreme court. I remember the same happened for Jallikattu in Tamilnadu. Some animal activists very smartly approached the supreme court and made supreme court to ban the Jallikattu. The ban completely hurt the cultural sentiments of Tamilnadu at that time. Then the entire people of Tamilnadu state had to protest and removed the ban through parliamantary system. What I meant to say that people of the country should be involved in this kind of discussions. If everybody agree, then pass them as a law. By the way I neither support not opposite the same sex marriages. I respect the sentiments. I wish this has to be done in a democratic way. By doing so, the people will accept whole heartedly. It is not just about giving permission to same sex marriage, it has the potential to go beyond that. In countries where same sex marriage is allowed faced a major phycological phenomenon within that society, if 2 same gender persons are close friends people started doubting their relationship (RRR type friendship is very rare in such societies, but it is very common in India) in these countries, friends don't keep their hands on each other shoulders as other people might get them wrong. And this will lead to a dipressed society as true friendship is no longer available and in such societies suicide rate is also very high. We must consider such phycological issues before coming to any judgement, i am just highliting few of such phycological issues. It can change the fabric of our society not because of few people get married with same gender but coz it will effect everyone even those who are not interested in same sex marriage. 1. Love is Universal where as marriage is not. We love our parents, our friends, our colleagues, our neighbors, our pets but we don't marry all. Love is unconditional where as marriage may or may not be. Marriage is not the culmination of love. 2. Marriage has religious approval and sanctity. Marriage has specific end goals. Marriage is a means to achieve that end goal of religious and the spiritual nature. Marriage is also for social order. 3. To address the issues related to same sex preferences, do not interfere with marriage system which is specific for another issue. In stead, design a new vehicle or means to solve the issues of same sex preferences. 4. You have no business to meddle with the marriage system to address unrelated issues. Marriage may not be a solution to issues related to same sex preferences. It's only temporary. Whereas if any changes to marriage system happen, they have a permanent impact on the society. 5. When asked about the collegium system of judiciary and its problems, CJI suggested the current system is the best one but the problems associated can be corrected through other means. Taking the same analogy, shouldn't we be addressing the lgbtq problems without amending the marriage system, but genuinely through other means. Some of the genuine means I think of are, a. Educating the people, both lgbtq and the rest of others, b. Strict implementation of the Law and order in this regard, c. Making specific amendments to laws such as adoption, inheritance, tax laws etc. without legalizing the marriage. _----------------------------------------- I'm not sure if it is a popular belief, but marriage is not free of problems and certainly is not a panacea. By embracing marriage as the solution to the current problem that lgbtq is facing they will certainly inherit all the ills of marriage. In my view lgbtq deserves a better and more suitable solution than marriage. Marriage might work as a Band-Aid but not a foolproof cure because of the inherent problems that marriage system has. The bottom line question is what does the lgbtq community want. Solution to the problems they're facing or Marriage? As marriage system is designed to cure other social problems, the need of the hour is to design a more appropriate system for lgbtq community which will give them respect and all the benefits that other fellow citizens get. This matter is very subjective. These discussions and debates should be done in parliament (both lokshaba and rajyasabha) not in supreme court. I remember the same happened for Jallikattu in Tamilnadu. Some animal activists very smartly approached the supreme court and made supreme court to ban the Jallikattu. The ban completely hurt the cultural sentiments of Tamilnadu at that time. Then the entire people of Tamilnadu state had to protest and removed the ban through parliamantary system. What I meant to say that people of the country should be involved in this kind of discussions. If everybody agree, then pass them as a law. By the way I neither support not opposite the same sex marriages. I respect the sentiments. I wish this has to be done in a democratic way. By doing so, the people will accept whole heartedly. There is difference between normal laws and laws concernijg fundamental rights. same-sex marriage should be allowed...a good number of gay people are marrying straight people for social conformity only to divorce later, or even worse, staying together and destroying many lives in the process. This can save everyone.
It is not just about giving permission to same sex marriage, it has the potential to go beyond that.
In countries where same sex marriage is allowed faced a major phycological phenomenon within that society, if 2 same gender persons are close friends people started doubting their relationship (RRR type friendship is very rare in such societies, but it is very common in India)
in these countries, friends don't keep their hands on each other shoulders as other people might get them wrong.
And this will lead to a dipressed society as true friendship is no longer available and in such societies suicide rate is also very high.
We must consider such phycological issues before coming to any judgement, i am just highliting few of such phycological issues.

Taking the same analogy, shouldn't we be addressing the lgbtq problems without amending the marriage system, but genuinely through other means.
Some of the genuine means I think of are, a. Educating the people, both lgbtq and the rest of others, b. Strict implementation of the Law and order in this regard, c. Making specific amendments to laws such as adoption, inheritance, tax laws etc. without legalizing the marriage.

I'm not sure if it is a popular belief, but marriage is not free of problems and certainly is not a panacea.
By embracing marriage as the solution to the current problem that lgbtq is facing they will certainly inherit all the ills of marriage.
In my view lgbtq deserves a better and more suitable solution than marriage.
Marriage might work as a Band-Aid but not a foolproof cure because of the inherent problems that marriage system has.
The bottom line question is what does the lgbtq community want.

As marriage system is designed to cure other social problems, the need of the hour is to design a more appropriate system for lgbtq community which will give them respect and all the benefits that other fellow citizens get.
Another point is marriage may appear at the outset as a fashion but it comes with a lot of baggage not just of the present but past and future as well. Any married person a man or a woman can vote for this.
